Smart environment mentransformasikan revolusi teknologi (4IR) sehingga merefleksikan nilai-nilai etis dan moral Society 5.0 berupa kemanfaatan lingkungan hidup bersama. Standar pencapaian smart environment diukur dari ketersediaan layanan publik, antara lain terkait : energy, water/air/land management, waste management, dan region management, melalui remote sensing, data oceanografik, dan early warning alert system berbasis high performance computer. Berbagai daerah (kabupaten/kota) telah memiliki regulasi smart city yang secara langsung/tidak mengatur smart environment. Optimalisasi implementasi kebijakan smart environment membutuhkan komitmen yang mengintegrasikan regulasi dan kelembagaan daerah dan nasional sehingga terkoneksi dengan standar sistem manajemen lingkungan (SSML) secara global.Kata kunci: integrasi; smart environment; smart city; standar; manajemen lingkungan global AbstractSmart environment policy is an integral and important part of the Smart City Development Pillar and Model. Smart environment transforms the technological revolution (4IR) so that it reflects the ethical and moral values of Society 5.0 in the form of shared environmental benefits. Smart environment achievement standards are measured from the availability of public services, including those related to: energy, water / water / land management, waste management, and region management, through remote sensing, oceanographic data, and early warning alert system based on high performance computer. Various regions (districts / cities) already have smart city regulations that directly / do not regulate the smart environment. Mengatasi hal tersebut maka dibuatlah peraturan unutk membagi hak-hak atas tanah tersebut. Namun adakalanya gesekan yang berujung sengketa tidak dapat dihindari seperti yang terjadi pada kasus Dumana Harahap dimana tanahnya hendak dijual tanpa persetujuannya oleh Jhonny Silitonga yang tidak lain adalah anaknya, bahkan PPAT sampai terlibat dalam hal ini karena PPAT tidak menjalankan tugas sebagaimana fungsinya dan aturannya. Metode penelitian yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif serta metode analisis dengan menggunakan pendekatan yuridis kualitatif. Berdasarkan hasil penelitian, PPAT terbukti lalai dan melanggar beberapa ketentuan yang diatur dalam Peratuan Pemerintah No 24 Tahun 1997 tentang Pendaftaran Tanah dan Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah. Akibat hal ini aka akta yang diterbitkan oleh PPAT menjadi batal demi hukum dan sertifikat atas nama tergugat menjadi tidak sah di mata hukum.Kata kunci: akta; pendaftaran tanah; ppat ABSTRACTLand as an important aspect of human life is prone to ownership disputes. To overcome this, regulations are made to divide land rights. But sometimes friction that leads to disputes cannot be avoided as happened in the case of Dumana Harahap where his land was about to be sold without his consent by Jhonny Silitonga who was none other than his son, even PPAT was involved in this because PPAT did not carry out its duties as its function and rules. The research method used in this research is a normative juridical approach and analysis method using a qualitative juridical approach. Based on the results of the research, the PPAT was proven to be negligent and violated several provisions stipulated in Government Regulation No. 24 of 1997 concerning Land Registration and Government Regulation No. 37 of 1998 concerning Regulations on the Position of Land Deed Officials. Dalam konteks penggunaan nuklir sebagai sumber energi, perlu ada peraturan yang mengatur penggunaan energi nuklir secara khusus. Hal ini digunakan sebagai indikator kesiapan Indonesia dalam mengelola energi nuklir, dengan tetap memperhatikan kelestarian lingkungan hidup dan dampak yang mungkin timbul dari penggunaan energi nuklir untuk memenuhi kebutuhan energi nasional.Namun, dari hasil penelitian, terungkap bahwa penyertaan nuklir dalam RUU EBET tidak selaras dengan tujuan pembentukan RUU EBET itu sendiri, yang seharusnya bertujuan untuk meningkatkan penggunaan energi yang bersih dan terjangkau. Oleh karena itu, penting untuk menganalisa kesiapan Indonesia dalam mengadopsi penggunaan energi nuklir dengan cermat. Ini harus mempertimbangkan dampaknya terhadap lingkungan hidup, yang jika tidak diperhatikan dengan baik, dapat mengancam kehidupan masyarakat.Kata kunci: energi; nuklir; limbah; regulasi AbstractIndonesia has a goal to promote the development of new and renewable energy through the drafting of the New and Renewable Energy draft Bill (RUU EBET). In the context of using nuclear energy as a source of power, there is a need for specific regulations to govern the use of nuclear energy. This is used as an indicator of Indonesia's readiness to manage nuclear energy while considering environmental sustainability and potential impacts from the use of nuclear energy to meet national energy needs. However, the resultsof the research have revealed that the inclusion of nuclear energy in the RUU EBET is not in line with the intended purpose of the RUU EBET itself, which should aim to enhance the use of clean and affordable energy. Therefore, it is important to carefully analyze Indonesia's readiness to adopt nuclear energy use. Namun dalam praktiknya, amanat tersebut tidak terlaksana dengan baik. Salah satu permasalahan pertanahan adalah adanya dua lembaga peradilan yang berwenang menyelesaikan sengketa pertanahan yang mengakibatkan adanya penyelesaian pertanahan yang masih belum optimal. Polemik tersebut kemudian berimbas pada hak atas tanah sebagai hak asasi manusia yang mendasar dikarenakan sering terjadinya pertentangan putusan. Pembentukan pengadilan khusus pertanahan kemudian dapat menjadi langkah konkret pemerintah agar amanat yang diformulasikan dalam Pasal 24 jo. 28D ayat (1), Pasal 28H ayat (2), dan Pasal 33 ayat (3) UUD 1945 terwujud. Melalui penelitian yuridis normatif dengan pendekatan deskriptif analisis dan studi perbandingan Negara Filipina dan Negara Australia yang saya rasa telah selaras dengan cita-cita pengelolaan hak atas tanah sebagai hak asasi manusia. Tulisan ini akan mengkaji eksistensi pengadilan khusus pertanahan untuk mewujudkan pengarusutamaan land rights sebagai hak asasi manusia tanpa memberikan permasalahan baru terhadap masyarakat.Kata kunci: pengadilan khusus; pertanahan; land rights; hak asasi manusia ABSTRACTLand is a natural resource that the constitution entrusts to the state. But in practice, this mandate is not well implemented. One of the problems with land is the existence of two legal institutions authorized to resolve land disputes. This results in a land settlement that is still not optimal. Frequently conflicting rulings undermine the basic human right to land. The establishment of a special land court can then be a concrete step by the government to fulfill the mandate formulated in Article 24 jo. 28D (1), Article 28H (2) and Article 33 (3) of the 1945 Constitution. Through normative legal research, which I believe is in line with the ideals of managing land rights as human rights, using a descriptive analytical approach and a comparative study of the Philippines and Australia. Pemerintah melalui Kementerian ATR gencar melaksanakan pendaftaran tanah pertama kali melalui Pendaftaran Tanah Sistematis Lengkap (PTSL). Dalam pelaksanaan PTSL, Kantor Pertanahan menemui hambatan dan permasalahan setelah terbitnya sertipikat. Tujuan diadakan penelitian ini adalah untuk mengetahui dan menganalisis mengenai pelaksanaan Program PTSL dalam mewujudkan kepastian hukum dan menganalisis kedudukan PTSL sebagai penataan akses dalam kerangka reforma agraria. Metode penelitian yang digunakan adalah yuridis normatif dengan teknik pengumpulan data primer dan sekunder. Hasil dari penelitian adalah dilaksanakannya PTSL dengan peningkatan kualitas akan menjamin kepastian hukum pemegang hak atas tanah dan pelaksanaan pendaftaran tanah di Indonesia akan berjalan dengan cepat serta menyeluruh sehingga mencapai target. ABSTRACT Land registration is intended to realize legal certainty for the Indonesian people with the aim of maximizing the value of land rights, so complete arrangements are needed in terms of use, utilization, ownership, and regulation. The government through the Ministry of ATR intensively carried out the first land registration through the Complete Systematic Land Registration (PTSL). In implementing PTSL, the Land Office encountered obstacles and problems after the issuance of certificates. The purpose of this research is to find out and analyze the implementation of the PTSL Program in realizing legal certainty and analyze the position of PTSL as an access arrangement within the framework of agrarian reform. The research method used is normative juridical with primary and secondary data collection techniques. The result of the research is that the implementation of PTSL with quality improvement will ensure legal certainty of land rights holders and the implementation of land registration in Indonesia will run quickly and comprehensively to achieve the target. Metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif yang menghubungkan antara permasalahan dan latar belakang masalah kemudian dianalisis dengan kerangka pemikiran hukum kualitatif. Berdasarkan penelitian ini, Pemerintah mengeluarkan kebijakan publik berupa Refinery Development Master Plan (RDMP) sebagai perwujudan pembangunan infrastruktur pada masa pemerintahan Jokowi. Pembangunan ini terbagi menjadi lima daerah, salah satunya Balikpapan, Kalimantan Timur. Proyek ini memiliki prospek agar Indonesia terbebas dari impor BBM tahun 2026. Dalam pelaksanaannya terdapat kendala di mana kilang itu dibangun tepat di samping unit kilang lama yang masih beroperasi, sehingga berimplikasi pada pembuatannya yang memakan waktu lama. Kendati demikian, pembangunan infrastruktur ini telah sesuai dengan arah kebijakan nasional dan asas-asas umum kebijakan publik, sehingga memberi dampak positif terhadap ketahanan energi dan pendukung revitalisasi ekonomi Indonesia. \u0000Kata kunci: Kebijakan Publik; Pembangunan Infrastuktur; Refinery Development Master Plan \u0000 \u0000ABSTRACT \u0000The fulfillment of the complex needs of human life is directly proportional to the increase in rate of energy consumption. In Indonesia, the high scale of fossil energy use makes it necessary to optimize productivity. The research method used is normative juridical which connects problems and backgrounds then analyzed with a qualitative legal framework. Based on this research, the Government issued a public policy in the form of the RDMP as a manifestation of infrastructure development. This development is divided into five regions, one of which is Balikpapan, East Kalimantan. This project has prospect that Indonesia will be free from imports of fuel in 2026. There are obstacles so the construction take a long time. Salah satu sektor yang mempengaruhi perubahan iklim adalah sektor ketenagalistrikan yang contohnya adalah penggunaan bahan bakar fosil pada Pembangkit Listrik Tenaga Uap (PLTU). Artikel ini akan membahas mengenai arah pengaturan terkait dengan pembangunan PLTU di Indonesia dengan melihat juga komitmen Indonesia terhadap Paris Agreement. Berdasarkan hasil penelitian, tingkat ketergantungan Indonesia terhadap PLTU masih tinggi sampai dengan tahun 2030, akan tetapi pemerintah sudah mulai menyelaraskan target kebutuhan listrik dalam negerinya melalui RUPTL 2021-2030 dengan target capaian yang tercantum pada dokumen NDC sebagai bentuk tanggung jawab Indonesia dalam melaksanakan implementasi dari Paris Agreement. Persentase target pembangunan PLTU menjadi berkurang, dan target pembangunan pembangkit listrik non-energi fosil bertambah. Sehingga, dapat dikatakan bahwa sudah terlihat adanya keselarasan yang dibentuk oleh pemerintah Indonesia antara pemenuhan kebutuhan listrik dalam negerinya dengan tanggung jawab Indonesia sebagai pihak dalam perjanjian internasional. \u0000Kata Kunci: Paris Agreement; Perubahan Iklim; PLTU. \u0000 \u0000ABSTRACT \u0000 Climate change has impacts on people's lives and threatens inter-generational equity, that's why the Paris Agreement was formed. One of the sector that affects climate change is electricity, which is the use of fossil fuels in Steam-Fired Power Plants. This article will discuss the direction of regulation related to the PLTU establishment in Indonesia by looking at Indonesia's commitment to the Paris Agreement. Based on this research, Indonesia's level of dependence on PLTU is high until 2030, however, the government has begun to align its electricity demand-targets through the 2021-2030 RUPTL with the targets listed in the NDC as a form of Indonesia's responsibility on Paris Agreement. The target percentage for PLTU establishment reduced, and for the construction of non-fossil power plants is increasing. Hasil dari penelitian ini menunjukkan bahwa regulasi keefektifan pengelolaan limbah medis di daerah Bandar Lampung berdasarkan Perda Bandar Lampung nomor 05 tahun 2015 tentang Lingkungan Hidup, bahwa peraturan yang ada di daerah Bandar Lampung belum sesuai dengan penerapan sistem SDGs dikarenakan beberapa faktor seperti kurangnya data dan tempat pengelolaan atau pembuangan akhir sampah yang kurang sesuai dengan tujuan SDGs. Maka hal ini regulasi pengelolaan limbah di bandar lampung perlu disesuaikan dengan ketetapan SDGs. \u0000Kata Kunci: Limbah Medis; SDGs; Peraturan Daerah. \u0000 \u0000ABSTRACT \u0000This research is a review into the effectiveness of medical waste management during this pandemic by using matching indicators of SDGs to the conformity of the regulation of autonomy of Bandar Lampung region, the subject of this study is the policy of the local government of Bandar Lampung on waste management regulation, by the application of SDGs system to achieve the level of sustainable development. Hal tersebut tidak terlepas dari pengaturannya yang belum memberikan kepastian hukum khususnya pengaturan mengenai subjek dan kewenangan hak pengelolaan. Dengan berlakunya UU Nomor 11 Tahun 2020 yang turut pula mengatur tentang hak pengelolaan, perlu ditinjau sejauh mana Undang-Undang tersebut memberikan solusi terhadap permasalahan yang berkenaan dengan hak pengelolaan, khususnya berkenaan dengan objek tanah yang merupakan hak pengelolaan sekaligus juga dikategorikan sebagai Barang Milik Negara/Daerah. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukan UU Nomor 11 Tahun 2020 mempertegas kedudukan hak pengelolaan sebagai hak menguasai negara dan akibat hukum dari pengaturan hak pengelolaan dalam UU Nomor 11 Tahun 2020 terhadap kepemilikan barang milik negara/daerah adalah tidak akan ada dualisme pengaturan terhadap satu objek tanah yang menyangkut hak pengelolaan dan barang milik negara/daerah berupa tanah. \u0000Kata kunci: Hak Pengelolaan ; Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja ; Barang Milik Negara/Daerah. \u0000 \u0000ABSTRACT \u0000The position of management rights in national land law does not provide legal certainty. this is inseparable from the regulation which does not provide legal certainty, especially the regulation regarding the subject and purpose of management rights. With the enactment of Law Number 11 of 2020 which also regulates management rights, it is necessary to review the extent to which the law provides solutions to problems related to management rights, especially with regard to land objects which are management rights and are also categorized as State/Regional Property. The research method used is normative juridical. Tujuan penelitian ialah mengidentifikasi dan menentukan keterkaitan dan kedudukan instrumen kajian lingkungan hidup strategis dalam penyusunan rencana tata ruang guna mewujudkan perlindungan terumbu karang ditinjau dari prinsip kehati-hatian. Metode penulisan menggunakan metode pendekatan yuridis normatif, bersifat deskriptif analitis dan analisis data secara kualitatif. Tahap penulisan dilakukan dengan data sekunder menggunakan bahan hukum dan berbagai data sekunder terkait. Hasil penelitian menunjukkan KLHS belum menjadi dasar dalam alokasi ruang-ruang dengan fungsi pemanfaatan di pesisir, sehingga diperlukan pendekatan hukum guna menghasilkan KLHS yang mampu menjawab isu-isu spasial dalam penyusunan regulasi tata ruang pesisir Indonesia. \u0000Kata kunci: Tata Ruang Pesisir; Kajian Lingkungan Hidup Strategis (KLHS); Perlindungan Terumbu Karang \u0000 \u0000ABSTRACT \u0000The research was conducted on the problem of the high level of damage to the function of coral reefs in the coral triangle area of Indonesia as a result of various uses of natural resources in coastal areas. The purpose of the research is to identify and determine the interrelationships and legal status of Strategic Environmental Assesment (SEA) in the preparation of spatial plans in order to realize coral reef protection in terms of the precautionary principle. The writing method uses a normative juridical approach, analytical descriptive and qualitative data analysis. The writing stage is carried out with secondary data using legal materials and various related secondary data.
