Hal ini berimplikasi pada potensi tidak tercapainya pembangunan berkelanjutan sebagaimana telah dicanangkan dalam Peraturan Presiden Nomor 59 Tahun 2017. Hasil penelitian ini menunjukkan bahwa masalah dan dampak pemidanaan pada kluster lingkungan di UU Cipta Kerja terhadap arah pembangunan berkelanjutan, disebabkan belum optimalnya penegakan hukum pidana lingkungan, pemidanaan yang tumpang tindih, ancaman hukuman tidak proporsional, pengaburan norma pertanggungjawaban mutlak, dan pereduksian pidana korporasi. Hal itu berpotensi menurunkan perlindungan dan pengelolaan lingkungan hidup, karena tidak timbulnya efek jera terpidana pidana lingkungan maupun masyarakat umum dan menurunkan kepatuhan pelaku usaha. Oleh sebab itu, perlu dilakukan upaya penguatan arah pembangunan berkelanjutan dalam pemidanaan tersebut, diantaranya dengan optimalisasi penegakan hukum pidana lingkungan, revisi UU Cipta Kerja dengan mengubah maupun menghapus pasal bermasalah, serta penguatan pengawasan lingkungan hidup. Dengan demikian, upaya pemidanaan dapat berimplikasi signifikan pada upaya perlindungan lingkungan dan tercapainya pembangunan berkelanjutan di Indonesia. \u0000Kata kunci: Pemidanaan; Kluster Lingkungan; UU Cipta Kerja; Pembangunan Berkelanjutan. \u0000 \u0000ABSTRACT \u0000The enactment of Law Number 11 of 2020 concerning Job Creation has caused various problems, especially related to criminal acts in environmental clusters. This has implications for the potential for not achieving sustainable development as proclaimed in Presidential Regulation Nomor 59 of 2017. The results of this study indicate that the problem and impact of punishment on environmental clusters in the Job Creation Act on the direction of sustainable development, is due to the non-optimal enforcement of environmental criminal law, overlapping penalties, disproportionate punishment threats, blurring of absolute liability norms, and reduction corporate crime. This has the potential to reduce environmental protection and management, because there is no deterrent effect on environmental criminals and the general public and reduces the compliance of business actors. Therefore, it is necessary to make efforts to strengthen the direction of sustainable development in the punishment, including by optimizing environmental criminal law enforcement, revising the Job Creation Law by changing or removing problematic articles, as well as strengthening environmental supervision. Oleh karena itu, negara harus bijak dalam menentukan peraturan dan aktivitas apa saja yang dapat dilakukannya di wilayah negaranya agar tidak menyebabkan kerusakan pada negara lain. Keputusan Pemerintah Jepang untuk melakukan pembuangan air radioaktif dalam dua tahun ke laut Pasifik menimbulkan perdebatan dalam dunia internasional dimana hal tersebut dapat mengakibatkan Jepang sebagai negara melanggar hukum lingkungan internasional. Jika Pemerintah Jepang memutuskan untuk membuang air radioaktif tersebut ke laut dan menyebabkan kerusakan pada lingkungan, Pemerintah Jepang dapat dimintai pertanggungjawaban negara dikarenakan telah melakukan pencemaran lintas batas dengan negara tetangganya. \u0000Kata Kunci: Hukum Lingkungan Internasional; Kewajiban Internasional; Pertanggungjawaban Negara. \u0000 \u0000 \u0000ABSTRACT \u0000A State has the obligation to ensure that the activities in its jurisdiction do not cause harm to the environment of other States. Therefore, A State has to be cautious in adopting its policies and activities within its jurisdiction do not cause damage to other States. The decision of Japan to discharge the radioactive water to the Pacific ocean in two years has caused an international debate, this could lead to Japan as a State violating its obligation under international environmental law. Relevansi penelitian ini memberikan dampak yang signifikan terhadap pendapatan negara juga menjadikan keresahan di lingkungan masyarakat yang terdampak Sebagaimana Peraturan Perundang-undangan No. 32 Tahun 2009 pasal 67 terkait dengan kewajiban melestarikan lingkungan hidup. Penelitian ini menggunakan metode yuridis normatif yang menekankan pada studi law in book diantaranya menggunakan bahan literatur buku-buku, jurnal-jurnal, peraturan-peraturan dan sebagainya. Selain itu juga menggunakan metode yuridis sosiologis atau empiris yaitu melalui pengamatan di lapangan. Urgensi perlunya pengawasan terhadap muatan angkutan barang perusahaan wajib mematuhi ketentuan yang berlaku Sebagaimana Peraturan Menteri Perhubungan Republik Indonesia Nomor 60 Tahun 2019 tentang penyelenggaraan angkutan barang dengan kendaraan bermotor di jalan pasal 71 ayat 1. Salah satu prinsip yang dianut oleh UUPA adalah prinsip Nasionalitas. Hanya WNI yang dapat mempunyai hubungan sepenuhnya dengan tanah. Hubungan dimaksud adalah dalam wujud Hak Milik, Hak Guna Usaha dan Hak guna Bangunan atas tanah, sedangkan untuk orang asing dan badan hukum asing yang mempunyai perwakilan di Indonesia dapat diberikan Hak Pakai atas tanah. Metode pendekatan yang digunakan adalah metode pendekatan yuridis normatif, yaitu menelusuri, mengkaji dan meneliti data sekunder yang berkaitan dengan materi penelitian ini. Digunakannya pendekatan yuridis dengan pertimbangan masalah yang diteliti berkisar pada keterkaitan suatu peraturan dengan peraturan lainnya. Hasil penelitian menunjukkan bahwa pengaturan pemilikan rumah susun bagi orang asing tidak sesuai dengan UUPA dan UU Rumah Susun yang menganut prinsip nasionalitas sehingga menimbulkan ketidakpastian hukum. \u0000Kata kunci: Kepastian Hukum, Orang Asing, Prinsip Nasionalitas, Rumah Susun \u0000 \u0000ABSTRACT \u0000In the framework of the National Land Law, the legal relationship between people, both Indonesian Citizens (WNI) and Foreign Citizens (WNA), as well as their legal actions related to land have been regulated in Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA). One of the principles adopted by the UUPA is the principle of Nationality. Only Indonesian citizens can have full relationship with the land. The relationship in question is in the form of Hak Milik, Hak Guna Usaha and Hak Guna Bangunan on land, while foreigners and foreign legal entities that have representatives in Indonesia may be granted Use of Land rights. The approach method used is a normative juridical approach, namely tracing, reviewing and researching secondary data related to this research material. The use of a juridical approach with consideration of the problem under study revolves around the linkage of a regulation with other regulations. Pemberian perlindungan terhadap kepentingan lingkungan hidup salah satunya dapat dilakukan melalui hak konstitusional yang dimiliki oleh warga negara, salah satunya dapat dilakukan dengan upaya gugatan citizen lawsuit. Citizen lawsuit merupakan upaya warga negara untuk mengajukan gugatan ke pengadilan untuk dan atas nama kepentingan warga negara dan/atau kepentingan publik yang bertujuan untuk melindungi kepentingan warga negara atas terjadinya kerugian yang ditimbulkan oleh Penyelenggara Negara. Gugatan citizen lawsuit dalam konteks lingkungan hidup dapat dilakukan agar penyelenggara negara mengeluarkan suatu kebijakan yang bersifat umum agar kelalaian dalam pemenuhan hak warga negara untuk mendapatkan lingkungan hidup yang baik dan sehat dapat terpenuhi. Pengaturan hukum acara citizen lawsuit di Indonesia belum diatur secara jelas, akan tetapi Langkah ini dapat ditempuh sebagai alternatif untuk menuntut pemenuhan tanggung jawab negara. Providing protection to environmental interests one of them can be done through constitutional rights owned by citizens, one of which can be done by efforts to lawsuit citizen. Citizen lawsuit is an attempt by a citizen to file a lawsuit to the court for and on behalf of the interests of citizens and / or public interests aimed at protecting the interests of citizens for the occurrence of losses incurred by state organizers. Citizen lawsuits in the context of the environment can be done so that state organizers issue a policy that is general in nature so that negligence in the fulfillment of the right of citizens to obtain a good and healthy environment can be fulfilled. The legal arrangement of citizen lawsuits in Indonesia has not been clearly regulated, but this step can be taken as an alternative to demand the fulfillment of state responsibilities. Namun dalam implementasinya, pengelolaan hutan belum dilakukan secara optimal, dibuktikan dengan masih adanya kasus kebakaran hutan, yang mempunyai implikasi terhadap kesehatan masyarakat dan lingkungan. Hal ini bertentangan dengan Pasal 28H ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yang menjelaskan bahwa setiap warga negara berhak mendapatkan lingkungan hidup yang baik dan sehat. Penelitian ini menggunakan metode yuridis normatif. Pendekatan yang digunakan yaitu perundang-undangan, konseptual dan studi kasus. Jenis data yang digunakan yaitu data kualitatif yang menggunakan sumber data sekunder. Metode pengumpulan data yang digunakan adalah studi kepustakaan. Dalam penelitian ini, penulis menemukan bahwa peran Polisi Kehutanan belum maksimal dalam pengendalian kebakaran hutan. Oleh karena itu, diperlukan penguatan peran Polisi Kehutanan untuk melakukan pengendalian kebakaran hutan. Dengan upaya tersebut, diharapkan dapat meminimalisir kasus kebakaran hutan serta dampak yang ditimbulkannya agar selaras dengan Sustainable Development Goals. \u0000Kata kunci: Kebakaran Hutan; Polisi Kehutanan; Sustainable Development Goals \u0000 \u0000ABSTRACT \u0000Indonesia is known as one of the lungs of the world because more than 50% of its land area is forest. However, in its implementation, forest management has not been carried out optimally, as evidenced by cases of forest fires, which have implications for public health and the environment. This is contrary to Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia which explains that every citizen has the right to a good and healthy environment. This study uses a normative juridical method. The approach is legislation, conceptual and case studies. The type of data is qualitative data using secondary data sources. The data collection method is literature study. In this study, the authors found that the role of the forest police had not been maximized in controlling forest fires. Therefore, it is necessary to strengthen the role of the forest police in controlling forest fires. Jenis penelitian menggunakan yuridis-normatif dan teknik pengumpulan studi kepustakaan dengan menggunakan content analysis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa konsep pemulihan pada putusan kasus tersebut memberikan tuntutan ganti kerugian akibat tindakan pencemaran lingkungan berupa biaya pemulihan yang sesuai dengan prinsip strict liability dan poluters pay, yang diperkuat oleh ahli Eddy Soentjahyo yang didasarkan pada PermenLHK Nomor 13 Tahun 2011 tentang Ganti Kerugian Akibat Pencemaran dan/atau kerusakan lingkungan hidup dan PermenLHK Nomor 7 Tahun 2014 tentang Kerugian Lingkungan Hidup Akibat Pencemaran dan/atau Kerusakan Lingkungan Hidup. Hal tersebut berjalan beriringan dengan Prinsip tanggung jawab Negara yang tercantum pada principle 7 dan precautionary principle yang tercantum pada principle 15 The Rio Declaration on Environment and Development: An Assessment. \u0000Kata kunci: Lingkungan Hidup; Pemulihan; Pencemaran. \u0000 \u0000ABSTRACT \u0000This study aims to determine the concept of recovery on environmental pollution that occurred in the case of the North Jakarta District Court Decision Number 735/PDT.G-LH/2018/PN.Jkt.Utr. This type of research uses juridical-normative and library research collection techniques using qualitative descriptive content analysis. The results show that the concept of recovery in the decision of the case provides a claim for compensation due to environmental pollution actions in the form of recovery costs in accordance with the principles of strict liability and polluters pay, which is reinforced by expert Eddy Soentjahyo based on Minister of Environment and Forestry regulations Number 13 of 2011 concerning Compensation due to Pollution and/or environmental damage and Minister of Environment and Forestry regulations Number 7 of 2014 concerning Environmental Losses Due to Pollution and/or Environmental Damage. Terdapat dua masalah utama, pertama, mengapa terjadi reduksi hak otonomi Pemerintah Daerah dalam hal melakukan pengelolaan atas sumber daya air pasca berlakunya UU No. 11 Tahun 2020? Kedua, bagaimana upaya yang dilakukan untuk tetap mengoptimalkan hak otonomi pemerintah daerah dalam melakukan pengelolaan sumber daya air pasca berlakunya UU No. 11 Tahun 2020? Penelitian ini merupakan penelitian yuridis normatif. Dilakukan pendekatan perundang-undangan, dan hermeneutika. Pasal 33 ayat (3) UUD NRI 1945, menjadi dasar konstitusional bagi Pemerintah Pusat untuk memperkuat kewenangannya atas sumber daya air. Pemerintah daerah lebih diarahkan sebagai pelaksana dari pemerintah pusat. Apalagi, UU No. 11 Tahun 2020 dimaksudkan untuk percepatan pertumbuhan investasi oleh Pemerintah Pusat. Oleh karena itu, dekonstruksi atas prinsip pembangunan berkelanjutan ini dilakukan dengan mengarahkan pada prosperity bagi masyarakat ditingkat daerah dari adanya sumber daya air. The tug-of-war between the central government and local governments has taken place since Law Act Number 11 of 2020 concerning Job Creation (Omnibus Law) was introduced. First, why there are a reduction in the autonomy rights of the Regional Government in terms of managing water resources after the enactment of Act No. 11 Year 2020? Second, how are the efforts made to continue to optimize the autonomy rights of local governments in managing water resources after the enactment of Act no. 11 Year 2020? This research is a normativejuridical research. A statutory and hermeneutical approach is carried out. Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia becomes the constitutional basis for the Central Government to strengthen its authority over water resources. Perubahan tersebut berdampak pada regulasi sektor lingkungan, ditambah lagi terdapat perubahan konsep bahwa perizinan lingkungan menggunakan pendekatan berbasis risiko. Di sisi lain, perubahan tersebut merupakan suatu inovasi yang dilakukan oleh Pemerintah untuk menyederhanakan regulasi untuk meningkatkan perekonomian nasional. Konsep Pendekatan Berbasis Risiko merupakan hal baru di Indonesia. Pendekatan tersebut sebelumnya telah diterapkan di berbagai negara seperti Inggris dan Kanada. Pendekatan Berbasis risiko dalam melakukan kegiatan usaha memperhitungkan berbagai aspek seperti, kesehatan, lingkungan, potensi, serta ancaman yang akan dihadapi. Konsep Pendekatan Berbasis Risiko tidak menggantikan amdal melainkan sebagai pelengkap dalam melakukan setiap perhitungan dalam kegiatan usaha. Implementasi pendekatan berbasis risiko dalam persetujuan lingkungan harus diperhatikan baik dari tahap perencanaan, pelaksanaan hingga pengawasan, sehingga kegiatan usaha yang memiliki risiko dapat dicegah dan dikendalikan. Pendekatan Berbasis Risiko dalam Undang-Undang Cipta Kerja diharapkan dapat memberikan keseimbangan antara pembangunan ekonomi dan kesehatan lingkungan. \u0000Kata kunci: Cipta Kerja; Perizinan; Risiko; Lingkungan \u0000 \u0000ABSTRACT \u0000On the Job Creation Law, Environmental Permit changed bcome an Environmental Agreement. Environmental Agreement agreed or recommended by the centra government or regional government. The alteration has impact on the regulatons, especially in environmental sector, furthermore environmental agreement use a new approach as known as Risk Based Approach. On the otherside, the new approach become an inovation by the Government to simplified many regulaton that exist to increase economic growth. Risk Based Approach is a new concept in Indonesia. The approach is also used by Great Britain and Canada. Risk Based Approach is a tool for identifying a risk based on many aspects such as, environmental aspect, health aspect (public health care, human health, environmental health etc), strength and threat from the business activity. Risk based on environmental study called ‘Environmental Risk Assessment'. The environmental risk assessment didn't remove the environmental impact assessment but as complementary. The Implication on Risk Based Approach on the Environmental Agreement must be considered from the planning phase, implementation and monitoring, so any business activity that have a risk are under control.
