It argues that the functions of the 1945 Constitutional Preamble vary from time to time. In the Old Order and the New Order governments, the Preamble enjoyed its highest status but it somehow lacked of legal binding. In recent years, particularly after the recent constitutional amendments, the status of the Preamble arguably shifted from lacked of legal binding to have legal binding status. This shift is primarily because of the recent constitutional amendments. Intisari Dengan menggunakan Pembukaan Undang-Undang Dasar 1945 sebagai studi kasus, artikel ini bermaksud menjawab sebuah pertanyaan penting yaitu apa fungsi sebuah pembukaan? Artikel ini berpendapat bahwa fungsi dari Pembukaan UUD 1945 berbeda dari waktu ke waktu. Pada masa Orde Lama dan Orde Baru, Pembukaan mendapatkan tempat tertinggi. Namun pada saat yang sama ia tidak sepenuhnya mempunyai kekuatan mengikat secara hukum. Sejak perubahan Undang-Undang Dasar 1945 pada tahun 1999-2002, status Pembukaan berubah dari yang sebelumnya tidak sepenuhnya mempunyai daya ikat menjadi mempunyai kekuatan mengikat secara hukum. Hal ini sebagai konsekuensi dari perubahan Undang-Undang Dasar. Hampir dua dekade penegakan kartel, khususnya kartel di luar persekongkolan tender, belum berjalan maksimal. Terdapat beberapa hambatan dalam penegakkannya, antara lain, UU Persaingan Usaha tidak mengenal keberadaan indirect evidence, sehingga praktik peradilan pun memiliki perbedaan pandangan terkait kedudukannya dalam sistem hukum acara. UU Persaingan Usaha tidak memberikan kewenangan pengeledahan dan penyitaan bagi KPPU untuk memperoleh dokumen-dokumen sebagai bagian proses pembuktian. Pemaknaan kartel sebagai perjanjian sebagaimana diatur dalam KUH Perdata mengakibatkan terjadi penyempitan makna kartel yang hanya terbatas pada perbuatan dalam artian perjanjian saja.AbstractCartels are classified as serious violations of business competition law due to its impact on reductions in social welfare is considered very real. Almost two decades enforcement of cartels outside tender conspiracy, has not run optimally. There are several obstacles in its enforcement, as follows, business competition law does not recognize the existence of indirect evidence hence the practice of judicial practices has different point of views related to their position in the procedural law system. The Business Competition Law does not authorize search and seizure for Commission for the Supervision of Business (KPPU) to obtain documents as part of the verification process. On one hand, corruption has become a massive issue in Indonesia, but on the other hand, the existing Anti-Corruption Act has yet to be in compliance with the relevant international instrument. Therefore, the implementation of UNCAC has become more urgent. It categorized as one form of the criteria for Transnational Organized Crime/TOC, includes crimes committed in one country, but involves organized criminal groups from more than one country. This paper will construct how the dispute resolution process must be carried out if it consists of UN procedures, UNCLOS 1982 by \"International Tribunals for the Law of the Sea (ITLOS)\" and the Association of Southeast Asian Nations (ASEAN) Regional. The type of research used is normative juridical. IntisariPraktik illegal transhipment merupakan suatu permasalahan yang serius karena termasuk dalam modus pencurian ikan, yaitu melalui pemindahan muatan ikan yang terjadi di tengah laut lepas dari satu kapal ke kapal asing tanpa melaporkan hasil tangkapannya tersebut. Dikategorikan sebagai salah satu bentuk kriteria Transnational Organized Crime/TOC, meliputi kejahatan yang dilakukan di satu negara, akan tetapi melibatkan kelompok kriminal terorganisasi yang berasal lebih dari satu negara. However the transaction with this system (voorschot) always happened in the society. This research is aiming to give a concept and practice by consequences of law from a custom giving a voorschot in transaction. This research is using a documentary and library research. The result of this study showed that with a concept and practice of giving voorschot who is recognized by positive law as well as customary law, civil law and islamic law. Then in the development of the practice this transaction of buying a product with this system is approved as a sign of agreement and can be allowed to held it. IntisariPemberian uang panjar dalam transaksi jual beli suatu produk barang adalah merupakan kebiasaan yang terjadi di masyarakat Indonesia. Transaksi jual beli produk barang sebagai upaya dalam memenuhi kebutuhan dan cara mendistribusikan kebutuhan, yang mana konsep dan praktiknya melandaskan pada filosofi yang berbeda-beda. Pemberian uang panjar sebagai konsep perjanjian, adalah selaras dengan asas kebiasaan dalam perjanjian, sehingga uang panjar sebagai uang tanda jadi dan uang muka dalam transaksi jual beli produk barang juga dalam praktik tergantung kesepakatan akan di kembalikan atau tidak, termasuk bagian harga jual ataupun tidak. As a consequence, not only the citizens become the sufferer, but this will also result in deviation in the law enforcement process. This article compares the conventional law enforcement and the potential to adopt environmental law enforcement in forest and land fire cases using holistic approach - an ecological perspective which considers the law not only as a strict rule but also an integral part together with all of the elements which will enable law enforcement to put forward the aspects of ecological sustainability than others interests. IntisariTidak Optimalnya penegakan hukum secara konvensional sebagai bentuk penyelesaian terhadap kasus kebakaran hutan dan lahan disebabkan karena kurangnya pengetahuan para penegak hukum terkait tata cara penanganan aspek hukum kebakaran hutan dan lahan maupun terjadinya penyimpangan pada proses penegakan hukum konvensional baik di tingkat kepolisian hingga tingkat pengadilan. Akibatnya tidak saja warga negara yang dirugikan (suferer) tetapi juga tidak jelasnya proses penegakan hukum konvensional akan menyebabkan terjadinya penyimpangan dalam proses penegakan hukum. Thus, there have been some concerns regarding the issue of multi-interpretation in the enforcement of adat criminal law. Having a reflection on the reality of the judges’ interpretation in absorbing adat law while deciding the punishment in accordance with the living and developing justice in society, a further and deeper study in jurisprudence is required to reconsider and reformulate the adat criminal law values in the Draft of Criminal Code Bill. IntisariRancangan KUHP mengatur hukum yang hidup dalam masyarakat sebagai bentuk perluasan asas legalitas, tetapi dalam penjelasannya tidak diatur secara definitif tentang ruang lingkup dan kualifikasi yang memadai. Timbul kekhawatiran persoalan multi tafsir dalam penegakan hukum pidana adat. It is contrary with principle of inheritance on adat law, especially in patrilineal communities. Therefore this article analysis legal reasoning in Supreme Court decisions within equality between men and women in inheritance cases and their implications to cultural identities. Analysis in this article uses case approach to Supreme Court decisions in 1974 to 2016. The case approach in this article found that Supreme Court decisions use the perspective of human rights to criticize inequality between men and women on inheritance law in adat law. However, Article 28I par. 3 the 1945 Constitution of the Republic of Indonesia states that cultural identities and rights of traditional communities shall be respected in accordance with the “development of times and civilisations”. This facts show that the definition of \"the development of times and civilisations\" as the basis of reviewing adat law is important. Supreme Court has to formulates the definition of “the development of times and civilizations” in order to prevent disappearance of cultural identities.s and civilisations. IntisariMahkamah Agung dalam beberapa putusannya telah menetapkan bahwa anak perempuan memiliki hak untuk mewarisi harta ayahnya. Putusan-putusan tersebut bertentangan dengan prinsip pewarisan dalam hukum adat, khususnya dalam masyarakat adat dengan sistem patrilineal. Oleh karena itu artikel ini menganalisis penalaran hukum dalam putusan Mahkamah Agung terkait dengan keseimbanganlaki-laki dan perempuan dalam sengketa waris adat dan implikasinya terhadap identitas budaya. Analisis artikel ini menggunakan pendekatan studi kasus putusan Mahkamah Agung dan Pengadilan Negeri dari tahun 1974 hingga 2016. Analisis dalam artikel ini menunjukkan bahwa putusan-putusan Mahkamah Agung tersebut menggunakan perspektif hak asasi manusia untuk mengkritik ketidakseimbangan laki-laki dan perempuan dalam hukum waris berdasarkan hukum adat. Namun Pasal 28 I ayat (3) Undang-Undang Dasar NRI Tahun 1945 menyatakan bahwa identitas budaya dan hak-hak masyarakat tradisional dihormati selaras dengan “perkembangan zaman dan peradaban”. Kondisi ini menunjukkan definisi “perkembangan zaman dan peradaban” sangat penting untuk dirumuskan sebelum mengevaluasi hukum adat.
