On the one hand, he opposes the equality thought of Rawls and Nozick, and on the other hand, he tries to establish a realistic and standardized Marxist view of equality. In addition, Cohen, while criticizing the arguments of the liberals, also constantly rethinks the classical Marxism on the concept of equality, and reconstructs the Marxist concept of equality to a certain extent. {"title":"Exploring the Determination of the Amount of Bribe Accepted in Equity-Based Bribery Cases","authors":"Sun Qing","doi":"10.22158/ape.v6n4p22","DOIUrl":"https://doi.org/10.22158/ape.v6n4p22","url":null,"abstract":"With regard to the determination of the actual transfer of dry shares, firstly, it is necessary to determine whether the case belongs to the dry-share type of passive bribery, mainly depending on whether the national staff member who did not make the capital contribution receives the company’s shares, and whether the perpetrator’s purpose of bribery is to obtain the company’s shares and dividends. Secondly, attention should be paid to the judgment of similar situations, such as: low-priced transferee-type bribe is not a transactional bribe but a dry-share-type bribe; in the case of shell transfer-type bribe, the defective or evaded contribution will not affect the determination of the crime of passive bribery. Finally, the determination of the actual transfer of shares should be judged from the substance of the transfer, and cannot be determined simply by whether or not an agreement has been signed. In determining the amount of the bribe, the first step is to determine whether the shares are transferred or not. In the case where the shares have been transferred, the value of the shares shall be used as the amount of the bribe, and the value of the shares shall be determined in a way that is as close as possible to the actual situation of the company. In the case where the shares have not been transferred, the amount of the bribe shall be the actual dividends received. Another theme that is overlooked by the existing China scholarship is the issue of gender. The so-called “miracle” of China’s recent rise as an economic powerhouse has also been a highly gendered process about which millions of women within China and outside the home raised concerns about the task of stronger political policies and actions that can institute gender equality and non-discrimination for women and girls. Soft power has played an important role in China’s international relations and the Party-State legitimacy among the people in China in terms of improving national pride and demonstrating that the world outside China admires the Chinese way of life—its social, economic institutions, cultural values, and the communist party of China’s (CPC) governance system. This study presents an analysis of the gender equality paradigm in China’s soft power engagement in the Global South. A history of the CPC shows a consistent policy concern for women’s empowerment and gender equality, generally represented in the concept “women hold up half the sky”, and therefore entitled to their right to resources and equal position in society. Since the 18th National Congress the CPC, President Xi Jinping and the Central Committee committed to adhering the basic national policy of gender equality “as a code of conduct and value standard” for the entire society (China Government Network 2021:3) and advocated for women’s equal rights through strategic measures like participation in economic construction in the family and society, including “equal sharing of housework” and family responsibility such as care work (Chinese Government Network, 2021:31). Transnational Corporations (TNCs) come into being in this context, making the global convergence trend of the economies of the world in production, distribution, exchange and consumption links more obvious. Because TNCs usually conduct economic activities in two or more countries, their strong economic power will inevitably affect the economic, political, cultural and social life of the country. On the one hand, the investment and business behavior of TNCs will have a series of effects on the local economy of the host country, and in some economic fields, TNCs can even interfere with the political order of the host country. Then, the article analyze the general environment of Dick Smith, including economic trend, technological change and demographic impact. After that, the article identify the industry environment of Dick Smith, followed by analysis of issues in the competitive environment through identifying five forces of which. In addition, this report describes Dick Smith’s current strategies. At last, the article explain the reasons why Dick Smith’s strategies were unsustainable, and point out the main reason contributes to its strategic failure, loss of competitive advantage and final collapse. Though Dick Smith was one of the most popular retail brands in Australia, it didn’t survive owing to its strategic failure, and was acquired by Kogan in 2016. Most cultures see women as inferior who are only useful in household chores, and reproduction. This indeed has informed the patriarchal nature of the Nigerian society, which explains underplay of women and its institutions. Thus, this paper investigated the cultural devaluation of women in the Nigerian society, with a specific focus on the “I Mbya Jin I” institution among the Jukun Wapan in Wukari area of Taraba State up to 2010. This paper particularly targeted at examining the cultural place of women and its institutions among the Jukun, trends in this institutions, and it place in the Jukun community today. The historical methodology was used, and it was structured along thematic lines. Though the research revealed that culture and religion are associated with the devaluation of women in the society, the religious claim is however untenable. What is tenable is the fact that cultural sentiments have under play the roles of women and its institutions in the society. It is also the contention of this research that women have been a significant part of the socio-cultural, economic, and political development. The three main schools of thought in international relations theory offer different perspectives on this issue. Realism asserts that the security dilemma is entirely inescapable. Liberalism, on the other hand, acknowledges its inescapability but argues that it can be mitigated through international cooperation mechanisms. Constructivism takes a different approach, suggesting that the constructed “security dilemma” can be fundamentally overcome by changing interactive behaviors. While liberalism and constructivism challenge realism’s conclusion, neither perspective can successfully refute the notion that the security dilemma is an inherent feature of international security. In the aftermath of the pandemic, it becomes imperative for China to effectively address future employment pressures while concurrently enhancing people’s quality of life. This article aims to analyze the underlying causes of unemployment in the post-epidemic era, while also delving into the challenges associated with re-employment and its subsequent impact on economic growth. The findings of this study reveal that re-employment plays a crucial role in driving economic growth. This essay will expound the definition and development history of liberal internationalism, analyze the current crisis it is facing, and point out it in combination with the current American foreign policy that although there are domestic and international challenges, the United States still has the strengths to promote liberal internationalism and maintain the existing liberal international order considering the historical background, comparison of national power, maturity of existing international order and the will of rising power.
