{"title":"PERLINDUNGAN HUKUM TERHADAP KONSUMEN LEMBAGA JASA KEUANGAN BERDASARKAN PERATURAN NO. 1/POJK.07/2013","authors":"Prima Melati","doi":"10.31980/civicos.v7i1.2981","DOIUrl":"https://doi.org/10.31980/civicos.v7i1.2981","url":null,"abstract":"Penelitian ini ditujukan untuk mengakaji dan meneliti akibat hukum, perlindungan hukum serta upaya hukum yang dapat dilakukan konsumen dalam pelaksanaan transaksi pada lembaga jasa keuangan yang dilakukan melalui telepon dikaitkan pada Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen Jo Peraturan Otoritas Jasa Keuangan Nomor. 1/POJK.07/2013 Tentang Perlindungan Konsumen Sektor Jasa Keuangan. Penelitian ini merupakan penelitian deskriptis analitis yaitu menggambarkan upaya perlindungan hukum bagi konsumen lembaga jasa keuangan atas pelanggaran dalam transaksi melalui telepon dikaitkan dengan Undang-Undang tersebut, dengan menggunakan pendekatan yuridis normatif yaitu mengkaji dan menguji data berdasarkan data sekunder, berupa studi kapustakaan serta yang didukung dengan studi lapangan yakni pemeriksaan dokumen dan wawancara. Telah dimuatnya aturan-aturan pada Undang-Undang Nomor 8 Tahun 1999, maka sesuai dengan prinsip hukum yang berlaku maka seluruh ketentuan termasuk hak dan kewajiban yang telah ditetapkan wajib dilaksanakan baik oleh pelaku usaha maupun konsumen, sehingga dapat tercipta adanya suatu kepastian dan ketaatan hukum, perlindungan hukum terhadap konsumen lembaga jasa keuangan. Metode yang digunakan adalah kuasi eksperimen dengan populasi siswa kelas IX SMP Islam Al-Jauhari Karangtengah Garut. Sampel yang dipilih berdasarkan teknik purposive sampling sebanyak dua kelas yaitu kelas IX-A sebagai kelas kontrol dan kelas IX-B sebagai kelas eksperimen. Instrumen yang digunakan berupa tes. Penelitian ini dilakukan di Kawasan Pusat Pemerintahan Provinsi Banten (KP3B) Jl. Syech Nawawi Al-Bantani Palima Curug, Sukajaya, Serang, Banten dan UPTD PPA Provinsi Banten di Jl. Ki Ajurum No.4, Cipocok Jaya, Kec. Cipocok Jaya, Kota Serang, Banten dengan menggunakan metode pendekatan kualitatif. Pengumpulan data menggunakan observasi, wawancara dan dokumentasi. Hasil penelitian ditemukan bahwa DP3AKKB sangat berperan sebagai fasilitator dalam mengatasi kasus kekerasan seksual terhadap perempuan di Provinsi Banten. UPTD PPA berperan dalam mengatasi kasus kekerasan seksual terhadap perempuan dari mulai proses pengaduan kasus yang dilaporkan, rujukan kesehatan, pendampingan bantuan hukum, pemulihan psikologis korban, mengantar kepihak kepolisian, sampai dengan kasus tersebut selesai. DP3AKKB juga menjadi tempat pendidikan dan penyebarluasan hak-hak perempuan. Berdasarkan hasil penelitian yang telah dilakukan dapat disimpulkan bahwa, peran dinas sangat penting untuk menekan kasus kekerasan seksual terhadap perempuan dengan penanganan yang sudah ditentukan oleh DP3AKKB dan UPTD PPA sebagai pelayanan masyarakat dalam menangani kasus kekerasan seksual terhadap perempuan. Cara menanamkan rasa percaya diri menggunakan bahasa Inggris ini salah satunya ialah mengadakan program bilingual di sekolah. Penelitian ini bertujuan untuk menggambarkan peran guru dalam menumbuhkan keterampilan berbahasa, inovasi yang dilakukan oleh guru dalam menumbuhkan keterampilan berbahasa, dan mendeskripsikan keterampilan berbahasa peserta didik di sekolah. Pengumpulan data dalam penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif, dimana pengumpulan datanya menggunakan teknik wawancara, observasi dan dokumentasi. Hasil penelitian ini menunjukan bahwa dengan adanya kegiatan bilingual ini, pendidik perlu mengembangkan keterampilan berbahasa asing dengan baik serta memiliki kepercayaan diri yang dimilikinya. Kajian ini akan menilai keberkesanan kurikulum ini kepada siswa guru bukan opsyen yang mengambil elektif teras Bahasa Melayu sebagai subjek minor. Model Penilaian Stufflebeam 1971 iaitu Context-Input-Process-Product (CIPP) telah digunakan dalam kajian ini. Keberkesanan kurikulum ini terhadap siswa guru akan dilihat dalam dimensi konteks, input, proses dan produk. Kaedah kuantitatif dengan menggunakan tinjauan soal selidik telah digunakan bagi mendapatkan data daripada siswa guru. Data kuantitatif diperoleh melalui soal selidik daripada 119 orang siswa guru. Analisis data menggunakan perisian IBM SPSS versi 26.0. Dapatan deskriptif menunjukkan beberapa aspek konteks, input, proses dan produk adalah baik. Melalui kajian ini didapati bahawa kurikulum Pengajaran Kemahiran Bahasa Melayu Sekolah Rendah amat memberi kesan yang positif kepada siswa guru berdasarkan keempat-empat dimensi Aspek-aspek seperti hasil pembelajaran dan isi kandungan kurikulum, sumber fizikal, sumber manusia, dan pentaksiran didapati memberi kesan yang positif kepada siswa guru yang mengambil kursus. The explanation in Law No. 7 of 1989 regarding religious courts still provides a choice of law for those who litigate and adhere to Islam. This study aims to determine the legal position of the Bandung District Court decision No. 166/Pdt/G/1991/PN.BDG after the amendment of Law No. 7 of 1989. The research method used is descriptive analytical by using literature study and using secondary and primary legal sources and interviews. The results showed that the decision of the Bandung District Court No. 166/Pdt/G/1991/PN.BDG was based on the competence of the Religious Courts contained in Law No. 3 of 2006 after the amendment of Law No. 7 of 1989 regarding Religious Courts. Weapons of Mass Destruction (WMD) or commonly referred to as weapons of mass destruction have become one of the most dreaded weapons with the emergence of chemical, nuclear, radiological, biological, and explosive weapons. In fact, the use of weapons of mass destruction has been outlawed, but production remains unsupervised, allowing a number of so-called terrorists to use readily available chemical weapons raw materials, such as Triacetone Triperoxide (TATP), to manufacture bombs and the like. In addition, chemical weapons whose circulation in liquid and gas forms is not monitored by the Chemical Weapons Convention (CWC) pose a risk of long-term damage such as permanent burns or diseases that continue to plague victims long after the war has ended. The following events are certainly a threat to national security that can be caused by irresponsible individuals with access to chemicals. Therefore, it is necessary to prevent similar occurrences in order to minimize the damage they cause. Through in-depth interviews and secondary data analysis, this study aims to establish the truth. Consequently, participation from relevant stakeholders is required. Where the threat is an effort, work, activity, or action that is deemed a threat to the security, safety, and resilience of the Unitary State of the Republic of Indonesia and various national interests. The authorities supervise the licensing, purchase, and use of these precursors as detailed below. Metode penelitian ini dilaksanakan dengan pendekatan deskriptif kualitatif sumber data yang digunakan yaitu sumber data primer dan sumber data sekunder. Informan yang terlihat dalam penelitian ini adalah Kepala Desa, Aparat Desa dan Masyarakat Desa. Teknik pengumpulan data yang digunakan adalah teknik observasi, wawancara, dan dokumentasi. Teknik analisis data meliputi data reduction (reduksi data), data display (penyajian data) dan conclusion drawing/verification. Hasil penelitian bahwa Upaya Pemerintah Desa dalam meningkatkan disiplin kerja aparat Desa di Desa Gera Kecamatan Mego Kabupaten Sikka dilakukan dengan cara Pembinaan Khusus untuk Aparat dan ada beberapa faktor penghambatan peningkatan kedisiplinan kerja Aparat Desa yaitu faktor topografi atau medan jalan yang sangat sulit, banyak Aparat yang tidak memiliki kendaraan pribadi serta Kepala Desa dan Aparat Desa tempat tinggalnya jauh dari Kantor Desa. Penelitian ini menyarankan untuk meningkatkan disiplin kerja aparat desa sebaiknya Kepala Desa memberikan motivasi secara terus menerus tentang pentingnya disiplin dalam bekerja. Kepala Desa seharusnya segera membuat Peraturan Desa sebagai dasar dalam meningkatkan kedisiplinan kerja aparat desa termasuk pemberian penghargaan dan sanksi kepada aparat desa. The purpose of developing digital comics is to help teachers in facilitating teachers in learning activities in the classroom and to attract students' attention. This research was conducted using the research and development (R&D) method using the Borg & Gall model which has been modified by Sugiono into 5 stages of development. Expert validation aims to determine the feasibility of the media carried out by two experts, namely media experts and material experts, obtaining a score of 80.00% from media experts who are categorized as feasible and obtaining a value of 81.33% from material experts who are included in the very feasible category. Trials were held to find out the responses and assessments of students which were carried out on 54 respondents who obtained a score of 83.22% which can be categorized as very feasible learning media.Keywords: Development, Digital Comic, Pancasila and Civic Education. Abstrak Penelitian ini dilakukan untuk mengembangkan media pembelajaran komik digital pada mata pelajaran Pendidikan Pancasila dan Kewarganegaraan yang dilakukan di SMP Negeri 10 Kota Serang. Tujuan dilakukan pengembangan komik digital yaitu untuk memembantu guru dalam memudahkan guru dalam kegiatan pembelajaran di dalam kelas dan untuk menarik perhatian siswa. Penelitian ini dilakukan dengan menggunakan metode penelitian dan pengembangan {R&D) menggunakan model Borg & Gall yang telah dimodifikasi oleh Sugiono menjadi 5 tahap pengembangan. Validasi ahli bertujuan untuk mengetahui kelayakan media yang dilakukan oleh dua orang ahli yaitu ahli media dan ahli materi memperoleh nilai 80,00% dari ahli media yang dikategorikan layak dan memperoleh nilai 81,33% dari ahli materi yang termasuk dalam kategori sangat layak.
