{"title":"منهج الفیروز آبادی فی الرد على الرافضة من خلال کتابه: (القضَّاب المشتهر على رقاب ابن المطهَّر) (عرض ودراسة)","authors":"أحمد مرشد حمود, عبد الحميد","doi":"10.21608/bfsa.2021.187077","DOIUrl":"https://doi.org/10.21608/bfsa.2021.187077","url":null,"abstract":"منهج الفيروز آبادي في الرد على الرافضة من خلال کتابه القضاب المشتهر (عرض ودراسة) \u0000عبد الحميد أحمد مرشد حمود \u0000قسم العقيدة والمذاهب المعاصرة، کلية الشريعة وأصول الدين، جامعة الملک خالد، أبها، المملکة العربية السعودية. \u0000البريد الإلکتروني: aamorshed@kku.edu.sa \u0000ملخص البحث: \u0000يسلط هذا البحث - الموسوم بـ (منهج الفيروز آبادي في الرد على الرافضة من خلال کتابه القضاب المشتهر (عرض ودراسة) - الضوء على منهج الفيروز آبادي في الرد على الرافضة، استخدمت فيه المنهج الوصفي التحليلي؛ حيث تناول نبذة تعريفية بالفيروز آبادي وبمصنفاته وبالکتاب الذي هو محل الدراسة، وبالرافضة الذين رد عليهم في هذا الکتاب. \u0000ثم تناول البحث موقفه من الرافضة مستعرضا واقع الرافضة في عصره وموقفه منه، ثم تناول ملامح منهجه في الرد على الرافضة، کما وقف البحث على مصادره في الرد عليهم، واستعرض السمات العامة لمنهجه، وتقييم ذلک المنهج. \u0000خرج البحث بجملة من النتائج کان أبرزها:عدم صحة انتساب الفيروز آبادي إلى کل من: أبي إسحاق الشيرازي وأبي بکر الصديق رضي الله عنه، وتأثير تنقلاته في البلدان في تکوينه العلمي وتنوعه المعرفي، ومساهمة الصراع العقدي والفکري السائد في عصره في تشکيل موقفه السني المناوئ للرافضة، وتوظيفه لقدراته العلمية المتنوعة في الرد على المخالف، وکذلک تنوع أساليب منهجه في الرد على الرفضة، وتنوع مصادره وأصالتها، واعتماده على من سبقه أو عاصره من غير إحالة إلى مصادرهم. \u0000کما خرج البحث بتوصيتين علميتين هما: المزيد من البحث والتحقيق حول قضية دفاع الفيروز آبادي عن صوفية ابن عربي، والبحث في جهود أصحاب المعاجم اللغوية في التعريف بالمصطلحات ذات البعد العقدي.  \u0000Al- Fairouz Abadi's Approach in Response to Rafida (The Rejectionists) \u0000in the Light of his Book Al- Qad'ab Al- Mushtahar, an Exposition \u0000  \u0000By: Abdul- Hameed Ahmed Murshed Hamoud \u0000Department of Creed and Contemporary Religious Denominations \u0000Faculty of Sharia and Osoul Al- Deen \u0000King Khaled University \u0000Abha- Kingdom of Saudi Arabia \u0000Abstract \u0000       This research focuses light on the approach of Al- Fairouz Abadi in his response to Rafida (the Rejectionists) and it applies the descriptive and analytical approaches. The introduction gives a synopsis defining Al- Fairouz Abadi, his classifications, the book concerned in this research and the Rejectionists to whom he responded in this book. After that the research displays Al-Fairouz Abadi's attitude towards the Rejectionists of his time highlighting his approach, its outstanding features and the resources on which he relied in his response to the Rejectionists. By the end of the research, a group of findings came to the ground. The first finding referred to the invalidity of relating Al-Fairouz Abadi to either Abi Isaac Al- Sherazi or Abu Bakr Seddik (May Allah Be Pleased with him). The second finding remarked the influence of his moves in between towns upon his scientific and intellectual formation. In addition, the doctrinal and intellectual conflict dominant in his time contributed to the formation of his Sunni attitude against the Rejectionists where he employed his varied scientific abilities in his response to those who advocated an adversary stance. Such issue is in bad need of precise treatment since setting a good example ahead constitutes an important aspect in tackling this issue. Accordingly، this research discusses this aspect and highlights its role in resisting and tackling deviation. In addition، the research stresses the need for leniency and wisdom in tackling errors، deviations، instructing the deviant person and helping him get back to the right path. As the deviant sometimes needs to be intimidated and rebuked as well as being in need of love and fear، this research has dealt with this issue and its impact upon the treatment of deviations. The research applies the deductive, inductive and analytical approaches along its course. The research also includes an introduction, a preamble, two chapters and a conclusion. The introduction discusses the purposes for selecting this topic, its importance, the general approach and its working plan. As for the preamble, it is designed to discuss the concepts of the title. Regarding the two chapters; the first one deals with the verses of command in Surat Luqman and their pedagogical significance while the second one focuses on the verses of interdiction and their pedagogical significance as well. Whereas the conclusion highlights the findings of the research for example, the verses of command and interdiction in Surat Luqman include many significant pedagogical ideals such as stressing the fact that pastime, vain desires and averting people from the way of Allah constitute deeply- rooted habits in the selves of those who have gone astray and deviated from the right path in every time and place. This epidemic has influenced people's religious، medical، educational، economic and social lives. Therefore، it has become necessary to clarify the legitimate provision related to this epidemic. Hence، this research handles the jurisprudential issues that have come up with the emerging coronavirus. Accordingly، the research tries to answer the question; how can jurisprudential rules be utilized to tackle pandemics which have neither text nor consensus regarding application? The research applies the inductive and analytical approaches due to the nature of the topic. Finally، the research concludes with the outstanding findings such as the fact that Islamic Sharia is an all- inclusive entity of provisions for all emerging issues. The second finding stresses the pending need for studying emerging pandemics because medical pandemics constitute the most common ones. In addition، there are many jurisprudential rules under which many of the infinite issues fall and the one who is knowledgeable of those rules can help forming relevant provisions when the rules come true. {"title":"مفهـــوم الموافقــــة عنـــد الجمهـور وعلاقته بدلالة النص عند الحنفیة وتطبیقاته فی قانون الأحوال الشخصیة الکویتی","authors":"يوسف عبد الله الکندري, عبد العزيز","doi":"10.21608/bfsa.2021.187078","DOIUrl":"https://doi.org/10.21608/bfsa.2021.187078","url":null,"abstract":"مفهوم الموافقة عند الجمهور وعلاقته بدلالة النص عند الحنفية \u0000عبد العزيز يوسف عبد الله الکندري \u0000قسم الشريعة الإسلامية – کلية دار العلوم – جامعة القاهرة، مصر. \u0000البريد الإلکتروني: ayk2020@gmail.com \u0000ملخص البحث \u0000يهدف إلى بيان العلاقة بين مفهوم الموافقة عند جمهور الأصوليين والحنفية من الناحية التطبيقية في الاستدلال، کما يهدف البحث إلى دراسة تطبيقات العمل بمفهوم الموافقة عند الفقهاء والقانون الکويتي مع ذکر الأمثلة في القانون الکويتي. واعتمد البحث على المنهج الوصفي من خلال عرض مفهوم الموافقة عند الفقهاء وعرض أمثلة له في القانون الکويتي، واستخدمت المنهج الحواري والتحليلي من خلال المقارنة بين تطبيقات الفقهاء وتطبيقات القانونيين على مفهم الموافقة. \u0000وتوصل البحث إلى نتائج نلخصها بما يلي: مفهوم الموافقة ذکره بعض الأصوليين بأسماء أخرى مثل: مفهوم الخطاب والقياس الجلي ولحن الخطاب وغيرها. دلالة مفهوم الموافقة جارية مجرى الدلالة اللفظية وحقيقية. هناک شروط وضوابط يجب مراعاتها عند الاستدلال بمفهوم الموافقة. أجمع الأصوليون بالاستدلال بمفهوم الموافقة عدا الظاهرية. مفهوم الموافق ينسخ وينسخ به، ويخصص به. ويساوي دلالة النص عند الحنفية مع اختلاف بعض التفاصيل. فقهاء القانون الوضعي تبع لفقهاء الشريعة الإسلامية في هذا الباب. ويأخذ فقهاء القانون الوضعي بمفهوم الموافقة ويعتمدونه مثل ما فعل علماء أصول الفقه الإسلامي. \u0000  \u0000The Concept of Agreement for the Consensus and its \u0000Relation to the Meaning of the Text for the \u0000Followers of the Hanafi School of Legal Thought \u0000By: Abdulaziz Youssef Abdullah Al-Kandari \u0000Department of Islamic Sharia \u0000Faculty of Dar Al-Oloum \u0000Cairo University \u0000Abstract \u0000 The present research aims at handling the concept of agreement for the consensus of the fundamentalists and the followers of the Hanafi School of Legal Thought regarding the practical aspect of reasoning. The research also aims at studying the practical applications of the concept of agreement for the jurists and the Kuwaiti Law with reference to some examples in the Kuwaiti Law. The research applies the descriptive approach through displaying the concept of agreement for the jurists and highlighting some examples from the Kuwaiti Law. It also applies the approach of dialogue and analysis through comparing the applications of the jurists and those of the legal advisors about the concept of agreement. By the end of the research, the researcher has highlighted the findings. For example, the concept of agreement has been mentioned by the fundamentalists but under other titles such as the concept of discourse, the obvious analogy and the rhyme of discourse…etc. The significance of the concept of agreement is real and it runs exactly like the verbal meaning. Moreover, there are terms and conditions that should be observed when resorting to the concept of agreement. The fundamentalists unanimously agree to utilize to the concept of agreement except the phenomenologists. The concept of agreement is both abrogator and abrogated, can be utilized in particularization. It also equates the significance of the text for the followers of the Hanafi school with the variation of details. Therefore، the word has a great impact as it is the medium through which the individual shapes his utterances that may lead him to good deeds and construction، or to evil work and destruction. Considering its kind، the word can be classified into two kinds; the good word and the malignant one. The good word is the word which the individual utters or hears from friend. It is also a kind of charity that grows in the heart and purifies it. As for the malignant word، it is the word which the individual utters or hears from a friend. Prophet Muhammad influenced the hearts through his good words. Through utilizing good and simple utterances which signify numerous meanings، Prophet Muhammad managed to influence the believers. Besides، the good word has a great impact upon the health of the individual both psychologically and physically; in this life and in the hereafter. Likewise، the good word has a great impact on the goodness of the society. As a result، we were obliged to utilize the good word so as to please Allah.
