Abstract

أحکام نازلة فيروس کورونا المستجد (کوفيد -19) في ضوء القواعد الفقهية عفاف محمد أحمد بارحمه قسم الشريعة، کلية الشريعة والأنظمة، جامعة الطائف، المملکة العربية السعودية. البريد الإلکتروني: Fiqreasercher@gmail. com ملخص البحث: تهدف هذه الدراسة إلى تأصيل القواعد الفقهية الضابطة للمسائل والفروع المختلفة لفيروس کورونا المستجد الذي اجتاح العالم، وکان لهذا الوباء تأثير على حياة الناس الدينية والطبية والتعليمية والاقتصادية والاجتماعية، فجاءت الحاجة لبيان الحکم الشرعي فيها. مشکلة البحث: يعالج هذا البحث القضايا الفقهية المرتبطة بفيروس کورونا المستجد. أسئلة البحث: کيف يمکن الاستدلال بالقواعد الفقهية على النوازل التي لا نص فيها ولا إجماع بالتطبيق على (نازلة فيروس کورونا)؟ والمنهج المتبع فيه: المنهج الاستقرائي التحليلي. أهم النتائج: 1 ـ أن الشريعة الإسلامية شاملة لکل ما يستجد من أحکام. 2 ـ الحاجة الماسة لدراسة النوازل المستجدة، وأن النوازل الطبية من أکثر النوازل توالدا. 3 ـ هناک الکثير من القواعد الفقهية والتي يندرج تحتها الکثير من المسائل الغير منتهية، وأن العالم بالقواعد هو من يخرج عليها الأحکام عند تحقق القاعدة فيها. فجاء هذا البحث لتطبيق بعض مسائل فيروس کورونا علي عشرين قاعدة من القواعد الفقهية.   Provisions of the Emerging Corona Virus (COVID- 19) in the Light of the Jurisprudential Rules By: Afaf Mohammed Ahmed Barahema Department of Sharia Faculty of Sharia and Regulations Taif University Kingdom of Saudi Arabia Abstract  The research at hand aims at rooting the governing jurisprudential rules of various issues and branches connected with the emerging Coronavirus which has plagued the world. This epidemic has influenced people's religious، medical، educational، economic and social lives. Therefore، it has become necessary to clarify the legitimate provision related to this epidemic. Hence، this research handles the jurisprudential issues that have come up with the emerging coronavirus. Accordingly، the research tries to answer the question; how can jurisprudential rules be utilized to tackle pandemics which have neither text nor consensus regarding application? The research applies the inductive and analytical approaches due to the nature of the topic. Finally، the research concludes with the outstanding findings such as the fact that Islamic Sharia is an all- inclusive entity of provisions for all emerging issues. The second finding stresses the pending need for studying emerging pandemics because medical pandemics constitute the most common ones. In addition، there are many jurisprudential rules under which many of the infinite issues fall and the one who is knowledgeable of those rules can help forming relevant provisions when the rules come true. To sum up، this research has been designed to apply some issues of Coronavirus to twenty jurisprudential rules.
