{"title":"Chantagem empresarial: hard bargaining ou crime de extorsão?","authors":"Tatiana Badaró","doi":"10.46274/1809-192xricp2022v7n2p318-352","DOIUrl":"https://doi.org/10.46274/1809-192xricp2022v7n2p318-352","url":null,"abstract":"Criminalizing blackmail puts the liberal legislator in the face of a paradox: How to rationally justify the decision to make it unlawful for someone to demand others to practice a lawful act by threatening them with an equally lawful act? This paradox becomes even more evident when it comes to cases of commercial blackmail, in which both the threatened act and the demanded act are connected with the legal economic activities carried out by the blackmailer and the blackmailed. The present article analyzes three possible positions in the face of this paradox: 1) to affirm that blackmail is not and should not be a crime; 2) to argue that blackmail already constitutes a crime of extortion or criminal coercion and 3) to argue that legislators have good reasons to criminalize blackmail. This article then discusses the different theories that intend to provide the basis that legitimate the criminalization of blackmail. The conclusion is that, on the one hand, not every type of blackmail is already foreseen as a crime and, on the other hand, only some types of blackmail should initially be criminalized. However, they can be held responsible for omission, when they fail to take the necessary measures to prevent the criminal conducts committed by their subordinates. To establish that responsibility, they must have acted with criminal intent (dolus directus) or at least with dolus eventualis. In this article, the authors examine the conditions of mens rea in criminal omissions by company directors regarding facts carried out by their subordinates. After examining the legal definition of criminal intent, they especially highlight the requirements for its procedural determination. With this, the verdict of the scientific unsustainability of the retributive theory hits him, as well as other criticisms concerning his theory of criminal law. However, a close reading of his theory of law offers a much more differentiated picture. Kant’s theory of punishment is of timeless relevance and anticipates in part modern concepts such as punishment and blame. In order to understand it, one cannot choose just a few statements, as is usual, but rather, one needs to be aware of the “whole” doctrine of Law. A primeira inquietação levantada questiona, em grande parte dos casos, a necessidade de afastamento prévio que se faz de um ou mais juízes – igualmente competentes – que poderiam também e legitimamente avaliar de sua competência, caso a ação fosse distribuída aleatoriamente pelos critérios do art. 75, CPP. Chama-se atenção especialmente para os casos, cada vez mais comuns, em que uma mesma operação policial se desdobre em inúmeras fases, o que se prestaria a justificar a permanência, até a última delas, da competência do juízo vinculado ao início da operação, sobretudo a partir de eventuais identidades de fontes probatórias, resultantes apenas de casualidade, com as quais se busca estabelecer vínculos entre fatos que, no mais das vezes, não atingem o nível da conexidade exigido pela lei processual. Em um segundo momento, o texto busca a desconstrução da crença comum de que a conexão, ordinariamente, viria acompanhada do risco de decisões conflitantes. Among them are its non-standard size in criminal justice, the high number of defendants and facts imputed, the length and complexity of the evidence, amid many others. This phenomenon motivated the Brazilian legal minds to study it, developing its concept with support in foreign literature. Nonetheless, what has been observed is a certain difficulty in proposing a conceptualization immune to criticism as the literature has been guided by fragile descriptions of the phenomenon. Therefore, the article focuses on the presentation of a concept that overcomes the problems encountered so far in order to enable the next step in its study, which is the proposition of solutions to the problems already verified in criminal mega-trials. Nevertheless, the legal opinion still diverge as to the response to be offered to this kind of practice. The present article investigates the tendency of punishing “rachadinha” agreements under the crimes of articles 317 and 333 of the brazilian Penal Code. The analysis was guided by a broader reflection on the current political-criminal trends on corruption. To this end, we first analyze the hypothesis of total equivalence between consented endangerment of others and participation in responsible self-endangerment. Then, we verify the possibility of interpreting consented endangerment of others from an attempt to equate it normatively with self-endangerment. It also analyzes the position of those who maintain that consented endangerment of others is nothing more than a form of consent.
