This article emphasizes that people who read pre-modern Arabic-Islamic literature often encounter themes of binary opposition within them, for example, the conflict between the sacred and the profane, the pious and the godless. In the Arab-Islamic tradition, literary and aesthetic elements are pre-modern, modern, and contemporary literary expressions that show the continuity of the influence of Al-Qur’an as a sacred entity. Tyeer thinks that there have been many scientific studies placing Al-Qur’an in the history of literature and investigating its influence on Arabic literature. Through critical discourse analysis method, this study has tried to describe, interpret, and critically explain Al-Qur’an esthetics discourse. This method has proven that Tyeer’s ideas concerning Al-Qur’an aesthetics are considered appropriate in elaborating and exploring the relationship between Tyeer’s thoughts on Al-Qur’an aesthetics with the cultural and social contexts that surround it. Tyeer also succeeded in explaining the relationship between the use of the beauty of Al-Qur’an language and Arab social and cultural practices. Penelitian ini menggunakan pendekatan kualitatif. Data penelitian ini dapat dikelompokkan menjadi dua sumber data yaitu: data primer yang terdiri dari direktur, wakil direktur Ma’had Aly bidang akademik urusan kurikulum, dosen, dan mahasantri. Data skunder yaitu data tentang konsep pengembangan kurikulum Dayah MUDI meliputi; latar belakang pengembangan kurikulum Ma’had MUDI; dasar atau prinsip-prinsip pengembangan kurikulum di Ma’had Aly MUDI. Data Proses pengembangan kurikulum Ma’had Aly meliputi; metode penyusunan kurikulum, penilaian kurikulum, pengawasan kurikulum. Teknik pengumpulan data dengan wawancara terstruktur, observasi dan dokumentasi. Analisis data dalam penelitian ini dilakukan sebelum memasuki lapangan, Adapun komponennya adalah reduksi data, penyajian data, dan verifikasi data. Hasil penelitian menunjukan konsep pengembangan kurikulum Ma’had Aly di Dayah MUDI semua berada pada kriteria baik. Proses pengembangan kurikulum berada pada kriteria baik, karena metode penyusunan kurikulum, penilaian kurikulum dan pengawasan kurikulum itu oleh pihak Ma’had Aly sendiri, karena Kemenag memberikan wewenang penuh kepada Ma’had Aly untuk dapat menjalankan pendidikan; dan implikasi pengembangan kurikulum Ma’had Aly terhadap kemampuan mahasantri itu bisa dikatakan baik dan berpengaruh kepada arah yang positif, sehingga mahasantri bisa mengembangkan potensinya. Muchtar","doi":"10.36667/tajdid.v28i1.424","DOIUrl":"https://doi.org/10.36667/tajdid.v28i1.424","url":null,"abstract":"This study aims to compare the inheritance law in Egypt with the existing inheritance law in the compilation of Islamic law in Indonesia. More specifically, this comparative study focuses on the issue of mawani’ irtsi (barrier of inheritance) and inheritance of dzaw arham (relatives of male or female). This is a qualitative research based on library research. The content analysis method is used to describe mawani’ irtsi and dhaw arham in the inheritance laws of Egypt and Indonesia. The results of this study indicate differences between the inheritance laws of Egypt and Indonesia; first: the compilation of Indonesian inheritance law always adjusts to the times, while the Egyptian inheritance law is still traditional by maintaining the views of classical scholars. This is evident when it explained one barrier to inheritance namely religious differences; second: Indonesian inheritance legal material explored classical books, studied modern legislation, and observed local traditions. This can be seen when it explained that men and women get the same share as long as the basis of their agreement. While Egyptian inheritance laws do not take into account modern legislation and do not adopt local traditions; third: the material description in the compilation of inheritance law in Indonesia is concise and sometimes general in nature while the description of the material inheritance law of Egypt is more detailed. This is seen when it explained one of the barrier of inheritance is intentionally killing an heir. Freedom in choosing beliefs is the right of all humans. Even in Human Rights (HAM) it has been mentioned about basic human rights in detail, one of which is freedom of interest and religion. Not only in human rights, the law in Indonesia is the same. In Islam also regulates freedom of religion. But what is happening today is the issue of apostasy, which is an important issue in Islam. This study often occurs among Muslims and is a very sensitive issue because someone who leaves Islam or is called an apostate will disturb the feelings and harmony of many parties as well as the harmony of the community. This study aims to determine how apostasy is in the perspective of fiqh, theology and human rights. This type of research is library research. Data were collected through books and journal articles related to research. The results of this study indicate that there is no compulsion in adhering to religious beliefs. A person has the freedom to choose Islam or anything else. However, if someone has made his choice to Islam, then there is no freedom to choose anymore, that person must obey and obey the teachings of Islam in a kaffah (comprehensive) manner.
