The third and last part covers chapters four and five. The fourth chapter opens with a detailed investigation of all possible structural indications: ‘dramatis personae’, inclusions, parallel phrases, corresponding terms and parts of sentences. Taking the results of this process, it seems to be justified to consider Mk. 3, 20–35 as a concentrically structured pericope: (A) Jesus' feverish activity and the behaviour of the relatives (w. 20–21); (B) The accusation of the scribes (v. 22); (C) Jesus' own defense (v. 23–29): (a) Refutation (w. 23b-26); (b) The binding (v. 27); (a′) Judgment-logion (vv. 28–29); (B′) Repetition of the accusation (v. 30); (A′) Arrival of the relatives and the proclamation of true kinship by Jesus (vv. 31–35). Underlying all five theses is the assumption that power—taken as influence which determines people's exercise of freedom always equates authority and a certain amount of force or potential violence. Thesis I discusses how ethical man, while basically opposing all real violence, can never escape structures of power, authority and force. Violence as an abuse of power may be overcome only by confining it. Thesis II brings in the sources of violence. The main source is seen in forms of monopolizing power and in depersonalizing ways of the use of authority; such as bureaucratic, militaristic, clericalistic authoritarianism. The main criticism concerns the very definition of marriage. The committee, so the critique goes, has mixed up the contractual view of marriage with the personalistic view. The former claims both ontological and theological validity, the latter has no such claims. The draft has allowed for only those personalistic elements which admit legal treatment, e.g. the bond of husband and wife, the unity of marital love and its procreative aim; yet other elements, e.g. personal surrender and love have been omitted. This author believes a personalistic type of marriage law should be developed. In fact, true Christian law originates where the opposition between law and love has been overcome. One frightful consequence of personalistic marriage laws is the breakdown of traditional distinctions, e.g. between valid and invalid marriages.
