Penelitian ini bertujuan untuk mengetahui praktik bagi hasil tangkapan ikan nelayan, aplikasi syirkah pada praktik bagi hasil tersebut di kalangan nelayan Kota Lhokseumawe serta melihat berbagai fenomena kemiskinan pada nelayan di Kecamatan Banda Sakti, kota Lhokseumawe Aceh. Metode dalam penelitian ini menggunakan metode kualitatif deskriptif dengan melakukan penelitian lapangan. Hasil penelitian mengungkapkan bahwa praktik bagi hasil tangkapan ikan yang ada dikalangan nelayan Kecamatan Banda Sakti melibatkan dua pihak sebagai pemberi modal yaitu toke boat dan toke bangku dan selanjutnya di kelola oleh pihak rakan meupakat beserta pawang (nahkoda laut). Aplikasi syirkah terletak pada kerjasama dan kesepakatan dari percampuran modal kedua pihak toke boat dan toke bangku yang kemudian dikelola bersama dengan pihak pengelola. [The phenomena related to the poverty experienced by most fishermen in the coastal areas of Lhokseumawe were caused by the economic and sosial factors. Thus, the fisherman were then unable to obtain reasonable income and adequate education. This research aims at revealing the profit sharing and syirkah (cooperation) practices related to the fish caught by the local fishermen in Lhokseumawe as well as the phenomena of poverty experienced by the fishermen in Banda Sakti sub-district of Lhokseumawe. This research used a descriptive-qualitative method with various research fields. The results of this research showed that the profit sharing practices related to the fish caught by the local fishermen in Lhokseumawe involved both parties consisting of capital providers called toke boet (boat owner) and toke bangku (capital owner) which were then managed by the rakan meupakat and pawang. Para pelaku bisnis yang mayoritas berasal dari generasi milenial tentu turut meramaikan gaung ini. Perusahaan rintisan (startup) yang biasanya bergerak di bidang teknologi dan aplikasi secara perlahan namun pasti turut mengalami perkembangan yang signifikan. Dibuktikan dengan beberapa data yang menyebutkan bahwa Indonesia menempati peringkat ke empat dunia dalam jumlah perusahaan startup. Bahkan Indonesia sendiri setidaknya memiliki 4 unicorn dari jumlah total 8 unicorn di ASEAN. Terdapat beberapa faktor yang mempengaruhi perkembangan startup di Indonesia, salah satunya adalah model bisnis kolaorasi antar beberapa startup untuk mengembangkan perusahaan. Disini peneliti ingin memaparkan bagaimana bisnis kolaborasi itu jika dilihat melalui perspekttif Islam. Penelitian ini merupakan penelitian kualitatif dengan metode deskriptif, yang mana memfokuskan kepada studi fenomenologi. Hasil dari penelitian ini adalah bisnis kolaborasi antar perusahaan startup dianggap sudah memenuhi unsur-unsur etika bisnis dalam Islam, yang memuat kesatuan, kejujuran, keadilan, kebenaran, kebajikan, kehendak bebas dan tanggung jawab. Pola bisnis kolaborasi pun dirasa cukup menguntungkan bagi semua pihak, baik antar perusahaan startup yang melakukan kolaborasi dan juga bagi masyarakat yang menjadi konsumen. [Entering the fourth industrial era, it opens up a great opportunities for digital businesses in Indonesia. The majority of business people who come from millennial generation certainly helped enliven this phenomenon. Startups which are usually engaged in technology and applications are slowly but surely also experiencing the significant developments. Evidenced by some data that says that Indonesia ranks fourth in the world in the number of startup companies. Indonesia also has at least 4 unicorns out of a total of 8 unicorns in ASEAN. There are several factors that influence the development of startups in Indonesia, one of which is the business model of collaboration between several startups to develop a company. Tujuan ini menjadikan kegiatan fundraising lebih cenderung memperhatikan keadaan mustahik zakat dan mengenyampingkan keadaan muzakki sehingga terkesan tidak seimbang antara kedua belah pihak (muzakki dan mustahik zakat). Penelitian ini bertujuan untuk menelusuri beberapa pertimbangan keadaan dan situasi (murā’ah) terhadap muzakki khususnya dalam zakat pertanian dan perkebunan yang dilakukan oleh Al-Qaradhawi sehingga mempengaruhi penetapan hukum (istinbaṭ aḥkām), tarjīh atau menguatkan hukum yang telah ada. Penelitian ini merupakan penelitian pustaka dengan analisis isi dari rujukan utama kitab “Fiqh al-Zakāh” karya Syeikh Yusuf Al-Qaradhawi. Temuan penelitian menunjukkan bahwa Al-Qaradhawi berpijak pada murā’ah muzakki dalam menguatkan hukum yang telah ada seperti kepemilikan penuh, kadar zakat yang wajib ditunaikan bergantung pada irigasi, waktu perhitungan nisab dan menunaikan zakat. Selain menguatkan hukum, Al-Qaradhawi juga men-tarjīh pendapat, diantaranya pengurangan al-matlūbat al-hallah sebelum perhitungan nisab. Al-Qaradhawi juga mempunyai sikap untuk menetapkan hukum yang tidak tertera dalam Nash berdasarkan murā’ah muzakki yaitu menetapkan kadar wajib zakat sebesar 7,5% bagi yang mengalami keseimbangan antara pemakaian irigasi dengan beban dan tadah hujan (tanpa beban). [The main goal of zakah fundraising is to increase the realization of zakah potential to create the mustahik zakah’s welfare so that they can become muzakki in the future. This goal makes fundraising activities tend to pay attention to the condition of mustahik zakat instead of the condition of muzakki so that it seems unbalanced between the two parties (muzakki and mustahik zakah). This study aims to explore several considerations of circumstances and situations (murā'ah) to muzakki, especially in agricultural zakah that is carried by Al-Qaradhawi that affects the legal establishment (istinbaṭ aḥkām), tarjīh or strengthens the existing laws. This research is library research with content analysis from the book of \"Fiqh al-Zakāh\" by Syeikh Yusuf Al-Qaradhawias as the main reference. The findings show that Al-Qaradhawi stood on murā'ah muzakki in strengthening existing laws such as full ownership, the amount of zakah to be paid that depends on irrigation, and time in calculating nisab and paying it. In addition, to strengthening the existing laws, Al-Qaradawi also did tarjih the opinions, among of them is the reduction of al-matlūbat al-hallah before calculating the nisab. Hal tersebut mendapatkan respon yang luar biasa dari masyarakat dunia terutama dari Barat dan Islam. Pro dan kontra muncul karena mereka menilai status Hagia Sophia merupakan warisan dunia yang tidak boleh berganti statusnya dan harus menjadi benda cagar budaya. Dari kubu yang mendukung memiliki argumentasi bahwa merupakan hak dan kebebasan suatu negara untuk merubah identitasnya dengan dukungan rakyatnya. Sementara mereka yang menolak status perubahan tersebut dikarenakan akses untuk mengunjungi tempat paling suci dan sakral akan mengalami kesulitan sehingga akan sulit untuk mengunjunginya dengan bebas. Penelitian ini bersifat deskriptif dengan metodologi kualitatif. Metodologi ini digunakan agar bisa menjelaskan suatu fenomena yang terjadi sekarang mengenai isu Hagia Sophia. Salah satu fenomena yang muncul di Indonesia, isu ini mendapat sorotan media nasional hingga internasional bahkan sampai viral. Sebagai umat Islam langkah yang diambil dalam mengambil keputusan yang bijak sesuai dengan sejarahnya melalui pendekatan sejarah dengan tahap heuristik, kritik, interpretasi, dan historiografi. [The Conquest of Constantinople in 1453 is in the spotlight of the world today. One of the triggers is the Turkish president Recep Tayyip Erdogan changing the policy of the status of the Hagia Sophia museum into a mosque. This has received a tremendous response from the world community, especially from the West and Islam. Pros and cons arise because they consider the status of the Hagia Sophia to be a world heritage that cannot change its status and must become a cultural heritage object. Those from the supporting camp have argued that it is the right and freedom of a country to change its identity with the support of its people. Meanwhile, those who refuse the change of the status due to access to the most holy and sacred places will experience difficulties so that it will be difficult to visit them freely. Sehingga sangat perlu mengangkat topik tentang relasi gender suami istri dalam keluarga untuk “membuka mata” akan pentingnya relasi yang sadar gender. Melalui kajian ini, diharapkan mampu mempertahankan akar hukum keluarga Islam yang ramah gender sehingga tidak akan ada lagi praktik dominasi dan subordinasi dalam kehidupan rumah tangga. Penelitian ini menggunakan metode kepustakaan (library research) dengan mengkaji berbagai macam sumber literatur yang berkaitan dengan topik relasi gender dalam keluarga sekaligus memadukannya dengan pendekatan feminis. Berdasarkan hasil penulusuran dari berbagai sumber referensi dijelaskan bahwa pola relasi suami istri yang baik itu adalah berdasar pada prinsip Al- Mu’asyarah bi Al- Ma’ruf. Hal tersebut akan terwujud jika kedua belah pihak yaitu suami istri saling memahami sekaligus menjalankan hak-hak dan kewajibannya secara resiprokal dan proposional, sehingga akan tercipta keselarasan. Tidak ada dominasi antara suami istri karena keduanya adalah saling melengkapi. Selain itu, keberadaan prinsip mubadalah dalam Hukum Keluarga Islam merupakan sebuah keniscayaan untuk mewujudkan tatanan hukum yang ramah gender dalam keluarga Islam. [This study elaborates on Islamic family law with the principle of mubadalah which aims to minimize the practice of domination, subordination and even violence in the family. Moreover, the discussion also reveals the importance of gender-awareness relations in the family life. Through this study, it is expected to be able to maintain the root of Islamic family law in the gender-friendly relation point of view. So, there will be no more practices of domination and subordination in the domestic life. This research uses the library research method by examining various sources of literature related to the topic of gender relations in the family and also involves the feminist approach. The results show that the pattern of an ideal relationship between husband and wife is based on the principle of Al-Mu'asyarah bi Al-Ma’ruf. It can be realized if the husband and wife can understand each other and at the same time carry out their rights and obligations proportionally and reciprocally, thereby the harmony can be realized. There is no domination between husband and wife because both are complementary. Di antara kesenian yang berinteraksi dan berdialektika dengan ajaran agama Islam adalah kesenian Jaranan Thek di Ponorogo. Keunikan dari kesenian Jaranan Thek ini adalah para pemain dan pawang yang memainkan Jaranan Thek menggunakan unsur magis dan kadang tidak sadar (trance), padahal mereka secara formal menganut agama Islam. Oleh karena itu, penelitian ini sangat penting dalam mengkaji fenomena Jaranan Thek yang hingga kini tetap eksis dan bagaimana para pelaku kesenian ini mendealektikakannya dengan ajaran agama Islam. Penelitian kualitatif (dengan observasi, wawancara mendalam, dan dokumentasi) ini menganalisis sejarah kesenian Jaranan Thek, strategi pelestarian, dan dialektikanya dengan Islam. Jaranan Thek di Ponorogo terkait dengan Kerajaan Kediri dan Kerajaan Bantarangin (Ponorogo). Demi pelestarian Jaranan Thek, maka komunitas kesenian ini berinovasi, yakni menyisipkan kisah Kelono Sewandono (dari Kerajaan Bantarangin) dengan Dewi Songgolangit (dari Kerajaan Kediri); menambahkan variasi lagu (shalawatan, tembang Jawa, Campursari, maupun lagu populer di masyarakat); menggunakan alat musik modern (misalnya, drum dan organ elektrik) sambil mempertahankan gamelan; menggabungkan Jaranan Thek dengan kesenian lain (misalnya, tari tayuban dan jathilan); dan menyelaraskannya dengan ajaran Islam (misalnya, doa, ayat, maupun lafadh bernuansa Islam). Dialektika Jaranan Thek dengan Islam terwujud secara mencolok dalam bentuk sinkretisme setelah unsur-unsur keislaman dimasukkan dalam pementasan Jaranan Thek. [Islam always interacts with the local culture. Among of the arts that interact and dialectic with Islamic teachings is the art of Jaranan Thek in Ponorogo. The uniqueness of this Jaranan Thek art is that the players and handlers who play Jaranan Thek use magical elements and are sometimes unconscious (trance), even though they formally adhere to Islam. Therefore, this research is very important in examining the phenomenon of Jaranan Thek, which still exists today and how the actors of this art treat it with Islamic teachings. This qualitative research (with observations, in-depth interviews, and documentation) analyzes the history of Jaranan Thek, its conservation strategy, and its dialectic with Islam. The Jaranan Thek's art in Ponorogo related to the Kingdom of Kediri and the Kingdom of Bantarangin (Ponorogo) because Jaranan Thek's art was from Jaranan art in Kediri. Maka dari itu dalam penelitian ini akan diungkapkan tentang strategi dakwah kultural walisongo di Nusantara yang terbukti efektif dalam penyebaran Islam di Nusantara. Dari kedua rumusan masalah tersebut maka kesimpulan dari penelitian ini yaitu, pertama, simbol dakwah kultural walisongo dalam kitab Tarikh Al-Auliya’ adalah simbol pernikahan dan simbol pesantren. Sedangkan kontekstualisasi simbol dakwah tersebut saat ini masih relevan digunakan dalam aktifitas berdakwah, terbukti dengan adanya perkawinan endogamous antara keluarga kyai yang bisa dijumpai di berbagai pesantren saat ini. Sedangkan simbol pesantren juga sampai saat ini relevan digunakan sebagai strategi dakwah kultural, dimana terbukti semakin berkembangnya lembaga pesantren di Indonesia dengan berbagai bentuknya. [The problem underlying this research is the existence of da'wah activities in Indonesia, which contain provocation and hate speech aimed at a certain person or group. It often ends up causing internal conflict among Muslims. Therefore, this research reveals the walisongo cultural da'wah strategy in Nusantara, which has proven effective in Islam's spread. In this study, the research object is the book of Tarikh Al-Auliya' written by Bisri Musthofa. It focuses on discussing walisongo cultural da'wah strategies from the perspective of symbolic interactionalism theory. There are two research questions in this study. First, what are the walisongo cultural da'wah symbols in Tarikh Al-Auliya' book? Second, how is the contextualization of the walisongo cultural da'wah symbol in Tarikh Al-Auliya' book in current preaching activities? From the research problems, formulations, the conclusions are drawn as follows. First, the symbol of the walisongo cultural da'wah in Tarikh Al-Auliya' book symbolizes marriage and a symbol of pesantren. Namun, ternyata hal tersebut tidak berlaku bagi masyarakat Dusun Trenceng Desa Mrican Jenangan Ponorogo. Meski masyarakatnya memiliki latar belakang perbedaan agama, namun mereka tetap mampu hidup berdampingan dengan harmonis. Hal ini tentu terjadi bukan tanpa sebab melainkan ada faktor yang turut berperan yang salah satunya adalah kearifan lokal masyarakat setempat. Untuk itu, artikel ini mengkaji secara mendalam tentang bentuk-bentuk kearifan lokal yang merajut harmoni antarumat beragama di Dusun Trenceng beserta fungsinya. Penelitian ini menggunakan pendekatan penelitian kualitatif dan jenis penelitian studi kasus. Hasil penelitian menunjukkan bahwa bentuk-bentuk kearifan lokal yang menyatukan masyarakat Dusun Trenceng yang multireligius diantaranya adalah perayaan hari raya, sambat-sinambat, gotong royong, kegiatan rutin masyarakat, perayaan hari besar nasional, dan slametan. Keseluruhan bentuk kearifan lokal masyarakat Dusun Trenceng tidak hanya berfungsi sebagai perekat hubungan antarumat beragama, melainkan juga memerankan fungsi sentral yang lain, yaitu sebagai penanda identitas, sarana resolusi konflik, memberi ‘warna’ keharmonisan dan kebersamaan bagi masyarakat, mengubah mindset dan menciptakan hubungan timbal balik individu dan kelompok dengan meletakkannya di atas common ground atau kearifan lokal yang dimiliki, dan berfungsi untuk mendorong tercipta dan terbangunnya kebersamaan, apresiasi, sekaligus sebagai sebuah mekanisme bersama untuk mencegah berbagai potensi yang mungkin saja dapat meredusir bahkan merusak solidaritas komunal masyarakat. [In some cases, differences in ethnicity, race, religion, and class often trigger conflict. But, it turns out that this does not apply to the society of Dusun Trenceng, Mrican Jenangan Ponorogo. Even though the societies have different religious backgrounds, they are still able to live in harmony. This certainly does not happen without a reason but there are factors that play a role, one of which is the local wisdom of the local community. For this reason, this paper examines the depth of the forms of local wisdom that weave inter-religious harmony in Trenceng village and their functions. This research used a qualitative research approach and type of case study research. The results showed that the forms of local wisdom that unite the multi-religious community of Trenceng village include the celebration of holidays, sambat-sinambat, mutual cooperation, routine community activities, national holidays celebrations, and slametan. Skema mudharabah biasanya diterapkan pada produk pembiayaan dan investas yang melibatkan dua pihak: shahib al-maal dan mudharib. Kedua belah pihak bekerjasama untuk mendapatkan keuntungan yang akan dibagikan sesuai dengan nisbah yang telah disepakati di awal akad. Apabila terjadi kerugian finansial, shahib al-maal akan menanggung semuanya, tetapi jika disebabkan oleh kelalaian pengelola modal maka kerugian tersebut harus ditanggung oleh mudharib. Hasil penelitian menunjukkan bahwa dalam akad mudharabah mayoritas bank syariah menerapkan prinsip revenue-sharing yang secara tidak langsung direstui oleh Fatwa DSN 07/2000. Penerapan prinsip ini dapat memicu timbulnya rasa ketidakadilan karena bagi hasil dihitung berdasarkan laba kotor yang lebih menguntungkan pihak shahib al-maal dan kurang menguntungkan bagi mudharib. Kondisi ini membuat nasabah kurang termotivasi untuk memilih bank syariah ketimbang bank konvensional. Dilihat dari perspektif fiqh, bagi hasil dihitung berdasarkan keuntungan bersih sebagaimana diterapkan pada prinsip profit/loss-sharing, yang penerapannya juga direkomendasikan oleh OKI. Pada akhirnya, penyempurnaan pada Fatwa DSN 07/2000 perlu dilakukan untuk memberikan rasa keadilan bagi semua entitas mudharabah: shahib al-maal dan mudharib. [This article was created to discuss the principle of profit-sharing in the mudharabah scheme in Islamic banking and the problems contained therein using descriptive-qualitative methods through library study and literature exploratory. Mudharabah schemes are usually applied to financing and investment products that involve two parties: shahib al-maal and mudharib. Both parties collaborate to get profits which will be shared according to the nisbah agreed at the beginning of the contract. If there is a financial loss, shahib al-maal will bear everything, but if it is caused by the negligence of the capital-user then the loss must be borne by the mudharib. The results showed that in the mudharabah contract, the majority of Islamic banks apply the principle of revenue-sharing which is indirectly blessed by Fatwa DSN 07/2000. The implementation of this principle could trigger a sense of injustice because the profit-sharing is calculated based on gross profit which is more beneficial for the shahib al-maal and less profitable for the mudarib. This condition makes customers less motivated to choose Islamic banks rather than conventional banks. From the perspective of fiqh, profit-sharing is calculated based on net profit as it’s applied to the principle of profit/loss-sharing as well as recommended by the OIC. Pondok Kabupaten Jepara ini adalah untuk mengetahui dinamika proses kebijakan pelaksanaan manajemen pendidikan di pesantren tersebut, untuk mengetahui pola manajemen yang dipraktekkan pengelola (kyai) dalam menggerakkan dan mengelola semua sumber daya di pesantren dan untuk mengetahui faktor penunjang dan faktor penghambat dalam kebijakan pengembngan manajemen pesantren sebagai tindak lanjut dalam peningkatan pengelolaan pendidikan pesantren. Penelitian ini di laksanakan di pondok pesatren memakai penelitian lapangan (field research) dengan metode kualitatif atau pendekatan deskriptif kualitatif, teknik pengumpulan data dilakukan dengan menggunakan telaah dokumentasi, wawancara dan observasi, analisis datang dengan tiga langkah yaitu: reduksi data, penyajian data, dan verifikasi data atau penyimpulan. Hasil penelitian dideskripsikan dengan dianalisis sehingga dapat menemukan menemukan teori serta pesan manajemen pendidikan madrasah pesantren (kyai) dengan manajemen pendidikan pesantren (kemenag). Hasil penelitian menunjukkan bahwa pengembangan merupakan suatu metode yang di gunakan untuk suatu hasil produk tertentu serta menguji keefektifan dari produk tersebut. Upaya untuk mengembangkan ilmu pengetahuan dan temuan temuan baru. Jadi penelitian ini adalah upaya untuk membuktikan mengembangkan dan menemukan bukti kongkret kebenaran sebuah model yang telah ada. hasil penelitian sangat mendukung dalam proses pembelajaran yaitu adanya fasiltas proyektor, laptop, audio, sehingga pada saat pembelajaran materi sangat didukung dengan fasilitas tersebut, dan juga guru sangat terbantu fasilitas tersebut itu terbukti pada saat proses pembelajran guru menyampaikan materi menggunakan semua fasilitas tersebut sehingga peserta didik tidak jenuh dikelas.
