This study departs from the existing studies on Muslim women's emancipation movements, particularly which have become a common trend in the modern Muslim world, including in Indonesia. Shihab's thoughts on Muslim women are worth studying because he attempts to unravel the primary Islamic religious texts that deal with women's issues within their initial context to provide religious instructions for Muslim women today without necessarily renouncing the traditional methods of reasoning. This article argues that Shihab's articulation of Indonesian women's fiqh (jurisprudence) using exegetical logic opens a broader space and provides an alternative for more emancipatory interpretations of religious texts operating within the grand corridor of Islamic religious and intellectual tradition.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"70 3","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-07-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141696708","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

However, Intellectual Property Rights are not adhered to by the public as there is much piracy. This is evident in the proliferation of websites providing pirated music, photocopies of books, and uploading songs that are sung again without permission from the creator. This necessitates a study related to the protection of Intellectual Property Rights (IPR) from the perspective of Islamic law. Building on the theory of maqasid sharia, the study shows that Islamic law views copyright as protected property because it is haq al-ibtikar containing the creator's exclusive, economic, and moral rights. From a fiqh perspective, the solution should be based on moral and economic demands. Therefore, it is necessary to strictly enforce the law against violations of Intellectual Property Rights because it is based on the appreciation and protection of creative rights, which signify professionalism.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"121 27","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-05-18","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141125170","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The rise in the rate of sexual violence from year to year is thought to be related to the state of education. So, many things about education need to be fixed to stop acts of sexual violence that have long-term effects. Handling cases of sexual violence is insufficient for punishing perpetrators because victims who have experienced violence cannot return to normal in their physical, psychological, or future conditions. More research, particularly on hadiths related to the prevention of sexual violence behavior, is required. In Islam, various strategies have been set up that are considered capable of saving the younger generation from sexual violence. Therefore, this article aims to present traditions related to efforts to prevent the prevalence of sexual violence in society. This study used a qualitative approach with a literature review model, and the data was analyzed using the fiqhul hadith approach. This approach is a method of understanding and interpreting Islamic jurisprudence based on the hadith of the Prophet Muhammad. The study discovers various strategies promoted by hadith to prevent sexual violence, such as managing the views of men's and women's genitals; managing educational institutions and gathering places that are separate for men and women; and promoting youth awareness to marry if they already have the ability to do so.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":" 1193","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-12-31","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139136111","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This study explores the views of a contemporary Orientalist, namely Jonathan Andrew Cleveland Brown, on Hadith. Grounding on Brown's works on hadith and related topics as the main data,  this study found that Brown has introduced a distinctive concept known as “the canonization theory”, typically applied as a stage in the cult or development of the Bible and Torah. Brown has applied the theory to explore the history of the books of hadith composed by Bukhari and Muslim. His perspective ultimately supports the consensus of Muslim scholars who consider Sahih Bukhari and Muslim as the primary source of Islamic law after the Quran. The canonization of Sahihain has undergone extensive study and critique from hadith experts. The reception of Sahih Bukhari has also experienced dynamics, such as the rejection by the Naisabur community, who favored Sahih Muslim, until Sahih Bukhari was established as the foremost reference on hadith, inspiring the development of a new epistemology in the study of hadith. Overall, Brown advocates for a balanced approach to Hadith, respecting Islamic tradition while maintaining a critical and scientific perspective in understanding and interpreting hadith.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"12 4","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-12-28","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139150171","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The Quranic injunction to travel that uses the word sīrū contains orders to contemplate, think, and take lessons from the attitude of the former people who denied the Prophet and Messenger of Allah and the consequences experienced by these people. Productive tourism in the Qur’an is carried out with a good purpose, benefiting oneself, others, and the surrounding environment and maximizing the use of reason, mind, and heart. In the Qur'an, the orientation of travel is very varied, namely, seeing the behavior of the former people, knowing the universe and its contents, adding insight, clearing the heart, softening the mind, and so on. The phenomenon of travel and efforts to develop the tourism sector in various countries are currently very diverse and continue to develop significantly in various means and forms so that they can provide benefits for social, political, cultural, and religious life. The order to travel contained in the word sīrū must be actualized in today's modern life by sticking to and being guided by the values in the holy book of the Qur'an.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"17 8","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-12-11","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"138980811","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This paper delves into the daily lives of female santris at Pondok Pesantren Sunan Pandanaran in Sleman, Yogyakarta. It examines the creative tensions that confront these santris, who commit the Qur’an to memory while concurrently being avid enthusiasts of Korean popular culture, including K-Pop and K-Drama. For the santris who prioritize memorizing the Qur’an, they are compelled to steer clear of any elements that could impede their concentration. This holds especially true for santris who also indulge in Korean popular culture activities—actions that some deem incongruent with Islamic values. This study discerns that the santris are capable of engaging in both activities concurrently, without perceiving K-Pop as detrimental to their memorization endeavors. By assimilating practices from Korean popular culture and skillfully harmonizing them with their religious traditions, the santris occupy a distinctive position at the confluence of Islam, globalization, and youthfulness. Constituting a pivotal segment of the global populace, they strive to harmonize their religious principles with the influences of an ever-evolving world, all while preserving their youthful spirit.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"133 ","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-12-03","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139012700","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

To this end, I identify three areas requiring revisiting: the challenges facing teachers of IRE regarding the promotion of intra- and interreligious tolerance, the implications of these challenges for typologies of student tolerance and intolerance, and the proposed strategy to cope with the challenges. The study utilizes a qualitative approach across multiple sites. Data were collected through in-depth interviews, document analysis, and observation at a madrasah (MA, Indonesian: Madrasah Aliyah) and two high schools (SMA, Indonesian: Sekolah Menengah Atas). Data were analyzed through six steps of Braun and Clarke's thematic analysis. This research finds that: (1) challenges related to the emergence of intra- and interreligious intolerance are traced to the domination of the mono-religious education model within the study of IRE in MA and SMAs; (2) the domination of this mono-religious education model is implicated in several tolerance and intolerance student typologies, such as active-passive intolerance and active-passive tolerance and active intra- and interreligious tolerance; (3) the proposed strategy to cope with challenges faced by IRE teachers to promote intra and inter-religious tolerance is mutual enrichment religious education model, which could be supported via macro-, meso-, and micro-educational system policy and regulation. The proposed model significantly contributes to integrating gradually three pivotal elements constructing intra and interreligious tolerance, namely, \"my truth,\" \"your truth,\" and \"our truth.\"","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"22 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-16","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"136114118","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Based on the empirical research in Toro Village, Bone, South Sulawesi, the study employed observation and interview to collect the data. This study found that despite the negative impacts of game, like other games that often take excessive time and neglects daily routines amongts children or youth, the study shows that noble characters are inherently present in the traditional game. The player of mappasajang can learn how to make balance, create resilience, and establish cooperation, unity and creativity since all these characters and skills are badly needed to play the game successfully. In addition to sharpen motoric skills, unlike online games, the traditional game also helps to nurture one’s personality in dealing with others and strengthen social bond and community cohesion. This is relevant to the principle of traditional game or sport promoted by Islam.","PeriodicalId":55654,"journal":{"name":"Ulumuna","volume":"7 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135253248","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It may also be the result of a marriage between religious understanding and the tradition of its adherents or the relationship between religion and local traditions. In this regard, this study aimed to unveil and analyze the cultural realities within the ‘Maleman’ tradition of the Sasak community as a product of interpreting the Quranic text regarding the night of ‘lailatul qadar’, which was the focal point of this study. Anchored in a phenomenological qualitative approach and an interactive analysis model from in-depth interviews and participant observations, symbolic meanings and religiosity values were discovered within the ‘Maleman’ tradition. It was the result of the Sasaknese community’s interpretation within their cultural landscape that has been preserved to this day. Additional findings indicated that the ritual of lighting the ‘dile Jojor’, a traditional torch made from the castor seeds, on the odd nights of the 21st, 23rd, 25th, 27th, and 29th of Ramadan was intended to welcome ‘laelatul qadar’, which the Sasak community of Lombok believed to be a night that must be ‘pursued’ (QS. al-Qadr [97]): 1-5 and guided by (QS. al-Taghabun [64]): 8. Similarly, the selection of raw materials for ‘Dile Jojor’ from the fruit of the ‘Jarak’ (Castor) tree, symbolically analogized from the term ‘syajarah mubarakah zaituna’ (QS. al-Nur [24]): 35. The ethnographic method summarised qualitative data through in-depth interviews and participatory observations for four months at the research site. Data analysis is sourced from primary data in the form of contact persons who know the identity of the data studied (elders, traditional leaders and indigenous youth) who have settled permanently. Research samples are taken purposively for data representation that must be valid and provide accurate and factual information. Secondary data in the form of literature references are also material for improving this research. The results showed a close relationship between Islam, the traditional house of the Limbungan community and the positioning of cultural tourism by the local government. The traditional house of the Sasak tribe of Limbungan Perigi has Islamic architectural values such as Bale (houses), roofs, walls, doors, floors, foundations, stairs, barns, and others. This value contains aesthetics, holistic education, manners, and social, cultural and economic values.
