Ketentuan tersebut pada intinya mengatur bahwa hakim dalam memvonis hukuman harus didasarkan pada minimal 2 (dua) alat bukti yang sah dan meyakinkan bahwa terdakwa telah melakukan suatu tindak pidana. Di dalam ketentuan Pasal 184 KUHAP mengatur mengenai 5 (lima) alat bukti, yakni : a). Keterangan Saksi; b). Keterangan Ahli; c). Surat; d). Petunjuk; e). Keterangan Terdakwa. Namun di dalam Putusan Pengadilan Negeri Jakarta Pusat Nomor : 777/Pid.B/2016/PN.Jkt.Pst, hakim menggunakan alat bukti tidak langsung (circumstantial evidence) yang tidak diatur dalam KUHAP. \u0000 \u0000 Sesuai dengan uraian tersebut Peneliti berminat untuk melakukan penelitian dengan judul “Alat Bukti Tidak Langsung (Circumstantial Evidene) Dalam Perspektif Hukum Pidana” dengan perumusan masalah Kedudukan alat bukti tidak langsung (circumstantial evidence) dalam perspektif hukum acara pidana serta Ratio decidendi Putusan Pengadilan Negeri Jakarta Pusat No. 777/Pid.B/2016/PN.Jkt.Pst terkait alat bukti tidak langsung (circumstantial evidence). Penelitian ini bertujuan untuk menjelaskan dan menganalisis keududukan alat bukti tidak langsung (circumstantial evidence) dalam perspektif hukum acara pidana, serta menjelaskan dan menganalisi ratio decidendi Putusan Pengadilan Negeri Jakarta Pusat No. 777/Pid.B/2016/PN.Jkt.Pst terkait alat bukti tidak langsung (circumstantial evidence). Metode penilitian yang digunakan adalah normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. \u0000 \u0000 Hasil penelitian ini menunjukkan bahwa alat bukti tidak langsung (circumstantial evidence) tidak diatur di dalam KUHAP. Hal itu terjadi karena adanya pembatasan kegiatan social secara menyeluruh, termasuk pada sektor Pendidikan. Pendidikan pada masa pandemi COVID-19 memaksa untuk para pengajar melakukan berbagai inovasi dalam desain bahan pembelajaran agar siswa dapat menerima pembelajaran dengan baik. Termasuk juga pada mata pelajaran Pendidikan Agama Islam, juga memerlukan inovasi bahan ajar agar dapat lebih menarik dalam pembelajaran kepada siswa. Seperti halnya pada materi fiqih ibadah haji dan umrah akan lebih menarik perhatian siswa jika diklaborasikan dengan desain bahan ajar yang inovatif. Pada hal ini, penulis mencoba untuk mengkolaborasikan materi fikih bab ibadah haji dan umrah dengan aplikasi editing Canva. Sehingga penyampaian materi fiqih ibadah haji dan umrah akan berbentuk semi aplikasi, Sehingga penyampaian materi guru tidak hanya secara verbal saja namun juga dengan memenfaatkan desain bahan ajar berbasis multimedia. Penelitian ini merupakan penelitian pengembangan (Research and Development (R&D)) dengan tujuan untuk menggali informasi mengenai perkembangan objek penelitian dan meningkatkan perkembangannya. Prosedur penelitian menggunakan model ADDIE yang meliputi empat tahap; Analisis (Analysis), Desain (Design), Pengembangan (Development), Implementasi (Implementation) dan Evaluasi (Evaluation). According to Creswell (2008), qualitative research methods define it as an approach or search to explore and understand a central symptom. The results of qualitative research are strongly influenced by the views, thoughts, and knowledge of the researcher because the data is interpreted by the researcher. This method does not use detailed questions, questions start with the general then go into detail. The description of achievement motivation in the subject is seen where the subject wants to show and prove to the old school where the subject teaches that the subject is able to develop. There are many factors that make the subject obtain achievement motivation in herself, namely: The subject has an environment with a high intellectual group, the subject is motivated by other writers in living life as a writerSubject is a teacher and also a housewife. The subject started teaching in 1997 and first taught in high school and then vocational school and stopped teaching due to marriage and then when he had children. Without realizing it, consumers have actually implemented an approach in accordance with Hermawan Kertajaya's 5A. Awareness consumers know Alfresh from their neighbors, Appeal is what makes consumers interested in Alfresh because it is attractive in terms of place and logo. Ask asks about the price and quality of the product. Act finally made a purchase at Alfresh because of the service and product quality at Alfresh. The main focus of the research is on the selection of members of the Subdistrict Panwaslu, which includes the announcement of registration, receipt of registration forms and documents, administrative assessment, announcement of evaluation results, collecting public responses, selection through written exams with CAT Socrative, interviews, and determining the selected candidates. This research also identified various obstacles faced during the recruitment process, including delays in the disbursement of budgets from the APBN, limited facilities and infrastructure, and an uneven distribution of registration announcement information. In facing this challenge, research suggests increasing socialization of the recruitment process, the use of electronic media to receive public input, and the timely allocation of funds. This research employed a virtual ethnographic approach to investigate the dynamics of social interaction within virtual English classes at Esa Unggul University. Through an ethnographic lens, this study delves into the multifaceted nature of interactions among students and lecturers in virtual English classes. Utilizing qualitative data collection methods such as classroom observation, questionnaires, interviews, and analysis of digital communication, shaping social dynamics in the virtual classroom. The findings illuminate the complexities of social interaction, highlighting the role of technology, communication styles, and cultural influences in shaping virtual learning environments.
