The purpose of this research was the basics and challenges of the criminal law of refusing to help the injured and removing the risks of life approved in 1975. Descriptive analytical research method was to identify the blind and ambiguous points of the unit's material, refraining from helping the injured and identifying the weak points of the unit's material. The results of the research showed that as long as the law and the legislator have turned a moral duty into a legal duty; And he did not pay attention to verifying the relationship of cause and effect; Therefore, if a person who sees someone in need of help but refuses to help, it is considered a crime of omission and is subject to punishment, and in this omission, the causality relationship must also be established. It is not a crime that the legislator did not pay attention to the motive of the willfully refraining or his negligence while performing the duty prescribed by the law, which is effective in the conviction, while in the case of intentional homicide, the perpetrator is the main basis for the conviction of leaving the act of malice. Over the years, other laws have been passed to solve the shortcomings and challenges of this article, and it has been a complement to the penal law of refusing to help the injured. The findings emphasize the importance of thorough environmental control across all stages of offshore oil and gas resource development, including exploration, production, transportation, and relocation. Inadequate management of oil and gas leaks in saltwater causes pollution, resulting in severe environmental consequences and eventual accountability. Such responsibility takes the form of both pollution control, and in cases of negligence, civil liability imposed on polluters. Notably, international accords addressing duties arising from maritime oil contamination are critical subjects in oil legislation. This article critically examines the provisions of these treaties that relate to oil pollution-related duties in marine ecosystems, as documented in international legal instruments. In conclusion, the research shows that relying solely on the traditional civil liability foundation for marine oil contamination not only fails to compensate for real-world harms but also jeopardies human rights. The novel deals with the theme of love, romance and marriage, but also highlights the commodification of marriage in a capitalist society. The two main characters, Alexandria and Nicholas, use marriage as a means to solve their economic problems, challenging the traditional notion of marriage as a bonding of two souls. This research aims to explore this phenomenon. This qualitative study employs a Marxist literary analysis of the novel, focusing on the commodification of marriage and human emotions in the late capitalist society. It examines how the novel’s characters challenge the traditional concept of marriage and use it as a commodity to satisfy their material needs. The core finding of this research is that under the harsh economic pressures of late capitalism, human emotions and social institutions like marriage are commodified, and people compromise their ideals for economic gain. The novel shows how marriage is used as a commodity to solve economic problems, and how the traditional concept of marriage is being challenged by the utilitarian values of modern societies. The research concludes that The Marriage Bargain is an illustrative example of the commodification of marriage and human emotions in late capitalism. The exploration of this discourse clarifies how the institution of marriage is being used as a commodity to satisfy material needs. Si, occidentalizada, escueta, reduccionista, separando el ser humano de su complejidad. Topoi que se desligan del pensamiento abismal: ciencias-filosofía, ciencias-teología, teología-filosofía; ser humano-Dios, ser humano-naturaleza, filosofía-saberes ancestrales, filosofía-coloniales; entre otros; ahora como diatopías. Como objetivo complejo analizamos la decolonialidad planetaria - pensamiento complejo en el des-ligaje de la colonialidad de la filosofía. Se trata de estudios de las líneas de indagación: transepistemologías de los conocimientos-saberes y transmetodologías transcomplejas; decolonialidad planetaria-complejidad en re-ligaje. Todo ello realizamos con una indagación rizomática antítesis de las investigaciones coloniales reduccionistas. Vamos con el transmétodo la hermenéutica comprensiva, ecosófica y diatópica pasando por los momentos: analíticos, empíricos y propositivos. En los momentos propositivos la diada decolonialidad planetaria-pensamiento complejo en la filosofía complejiza las concepciones del ser humano: naturaleza-cuerpo-mente-alma-espíritu-Dios; con lo que comprehende los saberes ancestrales en su esencia. Pues no busca juzgarlos, no desmitificarlos sino la comprehensión compleja que le da sentido de existencia incrustados en sus civilizaciones. No desmitifica civilización alguna; en tanto nivel de superioridad que le daría la vuelta al comienzo de la problemática colonial. Debemos aprender a afrontar la educación desde un cambio de pensamiento innovador, superando las caducadas antinomias y divisiones de topois, teoría y práctica, ciencias duras, ciencias blandas; saberes, conocimientos; entre otras. El objetivo complejo de la presente indagación es sustentar estrategias complejas en la educabilidad - formación universitaria municipalizada- imaginarios sociales complejos. Se trata de una pesquisa compleja, decolonial que tiende a ir más allá de la filosofía tradicional. En dicha triada se muestran estrategias complejas a la luz de la decolonialidad planetaria, en su teoría y práctica. Tomando en consideración sus reconstrucciones en la ecología de la acción. Hay que estar claro que desde la complejidad toda estrategia nos conlleva a unas u otras acciones a seguir para su realización, una estrategia compleja requiere siete (7) condiciones que la hacen compleja y recursiva en su practicidad; estas son: sistema, circularidad, dialógica, causalidad compleja, interacciones, círculos polirrelacionales y religazón.
