La Cour du Québec a axé son travail sur deux enjeux indissociables. Le premier, analysé à la lumière de l’architecture judiciaire, a pour objet une rectification des représentations que les justiciables se font de la justice dans le contexte des audiences à distance. La Cour du Québec mobilise, à cette fin, la symbolique judiciaire du palais de justice et du juge. Le second enjeu, porteur d’innovation conceptuelle, vise à assurer que l’audience à distance en est une de qualité. Le processus, amorcé en 2020, devrait s’étaler sur plusieurs mois. Dans le cadre des consultations publiques menées en début d’année 2021, Environnement et Changement climatique Canada a récemment publié un document de discussion intitulé « Vers la création de l’Agence canadienne de l’eau ». Les premiers éléments révélés demeurent à la fois larges et généraux. Les nombreuses possibilités proposées ratissent large et les formulations choisies manquent parfois cruellement de précision. Malgré tout, ce document se présente comme une occasion unique de faire état du contexte juridique de l’eau au Canada, en particulier des considérations intergouvernementales qui pourraient s’avérer au coeur de la constitution de cette structure. {"title":"Employee Participation Rights During Company Restructuring: Lessons Learned from the “Capability for Voice” in British Law","authors":"Migen Dibra","doi":"10.7202/1081842AR","DOIUrl":"https://doi.org/10.7202/1081842AR","url":null,"abstract":"In the current economic context, marked by a growing number of company restructuring processes as well as a rising unemployment rate, it seems important to address the employee’s issue of job security as well as the need to reduce the negative impacts that some restructuring processes have on businesses and employees. One solution in this regard is to ensure that employees are heard during the restructuring process. Since the Quebec and the federal Canadian legal frameworks on the subject offer insufficient protections, the author’s goal is to find solutions in order to strengthen the existing frameworks as well as to suggest different ways of adopting other legal information and consultation procedures applicable to company restructuring in general. To this end, the author is interested in whether a process of information and consultation of employees in restructuring matters, similar to what exists in the European Union, is possible in Canada, in light of the British experience. In fact, the United Kingdom’s case is particularly interesting for Canada, because this country originally applied a collective laissez-faire approach to employee participation rights during company restructuring which was similar to the North American one. It was only because of mandatory directives of the European Union on the subject that the United Kingdom has set up information and consultation procedures recognized by law. In order to perform this study, we have used the method of comparative law and as a theoretical framework we have applied the capability for voice, developed by Amartya Sen, which provides a method for assessing the impact and relevance of Parliament acts that recognize extended participation rights to employees in regard to a company’s economic decisions. Face à l’incertitude générée, les tribunaux ont été ralentis, sinon paralysés, en plus de devoir mettre en place une justice d’urgence par processus hybrides ou spéciaux. Dans un tel contexte, la recherche de mesures d’efficacité devient vitale. Le présent article contribue donc à la réflexion entreprise sur l’efficacité du système judiciaire en temps de pandémie et de post-pandémie. La crise sanitaire semble avoir encouragé une évolution rapide de l’organisation des services judiciaires. Cette évolution fera-t-elle place à une transformation durable et profonde de la justice civile? Le présent article fera état de mesures et de pratiques exemplaires établies au Québec, et ailleurs au Canada et en Amérique du Nord, visant à promouvoir l’efficacité au chapitre de l’administration de la justice et l’adjudication des litiges, et à réduire les délais judiciaires. Précisément, trois catégories de mesures et pratiques seront abordées, soit les mesures de gestion efficace des instances (Partie I), les modes privés de règlement des différends intégrés à l’activité des tribunaux étatiques (Partie II) et les mesures technologiques (Partie III). Nous verrons que chaque système de justice civile recherche le délicat équilibre entre les garanties procédurales fondamentales, la qualité et l’efficacité de la justice.
