Through three fundamental premises for its application, it is expected that criminal procedural law can be taught linking the preconceptions of those who learn, so that from a validation process it is possible to build authentic interpretations with a sense of practical utility. {"title":"¿Qué se ha investigado en América Latina sobre condenas e imputaciones erróneas? Drawing on a systematic literature review from 2010 to July 2023 in WoS, Scopus and SciELO databases, the article identifies a universe of 50 publications. From a quantitative perspective, the paper inquiries into aspects such as years of publication, countries to which they refer, data about the scientific community that has generated this literature, and the topics they address. Then, it provides a qualitative analysis of the content of the publications, distinguishing among those that address general aspects, factors that contribute to wrongful convictions and prosecutions, correction mechanisms, and compensation mechanisms for wrongful convictions and prosecutions. Despite this, the Brazilian Regional Federal Court of the 4th Region (TRF-4) has been imposed on the monitored person the burden of bearing the expenses arising from electronic monitoring, a burden that is not supported by Brazilian legislation that deals with the subject. For this reason, it is necessary to question, as a research problem: are these TRF-4 decisions legally correct? In view of this, this article aims to critically analyze the decisions of the TRF-4 in this sense and the main arguments used, in order to verify whether they are legally correct or mistaken, due to the lack of a explicit legal provision in this regard, which, in fact, came to be recognized on several occasions by the Brazilian Superior Tribunal of Justice (STJ). The choice of TRF-4 is justified by the significant number of Court decisions in this regard, as well as by the fact that the other Federal Regional Courts do not have sentences with this content and intention. The theoretical framework uses productions related to criminal execution and its principles of legality and jurisdiction. To this end, it is based on the premise established by Foucault and deepened by Dardot and Laval that neoliberalism has become socially rooted to the point of transmuting from a simple economic model to a rationality that spreads to the most diverse social fields. The work is guided by the question: are there harmful effects beyond the loss of quality in the motivation of decisions with the adoption of efficiency logic by the criminal judge? The objective is to verify whether the management principles of this reason may be harmful to the proper functioning of the criminal process. This is an exploratory, interdisciplinary research, based exclusively on bibliographical references. We tracked the petitions, the type of imprisonment, the date of judgment, the type of legal action, and the outcomes of these requests. Subsequently, we conducted a qualitative analysis of the arguments employed by the Court in reaching its decisions. The main objective of the study is to understand how the Court ruled on requests for release from incarceration and the impact of the Covid-19 pandemic in the judicial reasoning. The findings indicate that the pandemic had no relevant impact on the Court’s decision-making process. Dismissals on procedural grounds prevailed, allowing the court to avoid ruling on the merits of a claim. On the other hand, when the merits were analyzed, the pandemic was not treated as a sufficient argument for releasing a prisoner. Additionally, during the pandemic, CNJ’s Recommendation No. 62 and ADPF No. 347 had no argumentative prominence in the few decisions that granted requests for release. This research reinforces the diagnosis that the pandemic has not changed how the Judiciary deals with imprisonment. For these purposes, it was analyzed whether such legislation complies with national and international standards regarding judicial conformity, as well as to examine its feasibility and effectiveness in terms of judicial proceedings aimed at challenging acquittal convictions. A mixed methodological approach was adopted over an extended period, covering the analysis of judicial decisions issued between the period 2010 - 2022. Through a thorough analysis, it was concluded that the principle of double jeopardy should be applied exclusively to the convicted person, highlighting that challenges related to acquittal convictions should be the competence of a Criminal or Mixed Chamber belonging to a specific Judicial District, instead of being attributed to the Supreme Court. The main goal is to understand the challenges when trying to protect the right to avoid self-incrimination while also ensuring public safety. By looking at court decisions from 2014 to 2023, the study explores how the legal systems in both countries deal with arguments for and against law enforcement being able to unlock smartphones against the will of the owner. The main issue being examined is the balance between respecting citizens' privacy rights and making sure defendants get fair treatment in the legal process. The research question driving this study is: How do Brazil and the U.S. manage the situation where law enforcement needs to unlock smartphones, while also respecting constitutional rights and public safety? To answer this question, the study looks at recent court cases from both countries and identifies important arguments about forced smartphone unlocking. The findings show problems in these legal proceedings, particularly when it comes to protecting the privacy of smartphone users and defendants' rights. A key point that comes out is that when law enforcement examines suspects' phones, it can jeopardize the proper handling of evidence and the right against self-incrimination that's protected by the Constitution. The study highlights shortcomings in the responses of the Supreme Courts of Brazil and the United States. This suggests a need for a more detailed framework that can address these challenges better and solve disagreements in lower courts. In essence, this article discusses the conflict between privacy rights and self-incrimination on one hand, and the government's duty to maintain public safety and prevent illegal evidence on the other. In conclusion, this article explores the legal issues around forced smartphone unlocking in Brazil and the United States. Assim, almeja-se problematizar a temática e sugerir critérios para definição da coautoria em trabalhos científicos com o uso de ferramentas de inteligência artificial.
