But it is sometimes the contrary and in particular as far as the contract of moving is concerned. For this contract the classification seems to be determined according to the solution which we wish to give. The intrusion of the consumer rights in the law of transportations of goods leads the judges and the legislators to intervene repeatedly and sometimes contradictorily on the legal obligations of the mover companies. Today these various reforms leave a taste of incompleteness to the point that we can wonder if the better solution would not the implementation of a standard contract of moving. To verify the relevance of such a proposition obliges beforehand to present the doctrinal analyses on the legal nature of the contract of moving, to understand the case law and legislative stakes which presided over the modifications to measure the necessity of a standard contract and think about his contents.\u0000 La qualification juridique d’un contrat est le préalable nécessaire pour déterminer quel sera son régime applicable. Mais, c'est parfois le cheminement inverse qui est retenu, tel est notamment le cas du contrat de déménagement pour lequel la qualification semble être déterminée en fonction de la solution que l’on souhaite apporter au différend. L’intrusion du droit consumériste dans le droit des transports de marchandises a conduit les juges et le législateur à intervenir à plusieurs reprises et parfois de manière contradictoire sur les obligations juridiques des déménageurs. Aujourd’hui ces différentes réformes laissent un goût d’inachevé au point que l’on peut se demander si la solution salvatrice ne se trouverait pas dans la mise en place d’un contrat type de déménagement. Literature in urban economics generally retains role of socio-economic characteristics but also urban structure of cities to explain work trips. From the Global Transport Survey of 2001 and INSEE population census of 1999, we want to test their relevance when explaining transport modal choice of workers in the region and distance our duration of journeys to work. Globally if our results highlight the key role of individual characteristics as sex, age, income and occupational status, they also show that residential location, through its urban structure, is an important determinant.\u0000 Ce travail s’intéresse aux déplacements domicile-travail au sein de la région Île-de-France. La littérature en économie urbaine met généralement en avant le rôle important des caractéristiques socio-économiques des individus mais également de la structure urbaine des agglomérations dans l’explication des mobilités quotidiennes. A partir de l’Enquête Globale Transport de 2001 et du recensement de la population de 1999 de l’INSEE, nous cherchons à tester leur pertinence pour le choix du mode de déplacement des actifs d’Île-de-France ainsi que pour l’ampleur des navettes effectuées (mesurées en termes de distance et de durée). The objective is to present an analysis of tehrani household's transportation service expenditure, from the information based on an Iranian household consumption survey (2002). Detailed analysis of a sample of households' expenditures allows us to identify the major determinants of transportation service consumption in Tehran. We define as well seven transportation-service-consumer household categories. The various factors stimulating the mobility needs of each category are likely to limit its consumption capacity. The comparison of the weight of this expenditure in households' budget and income suggests then the inequalities between the citizens of Tehran regarding transport services. These comparisons prove the concurrence between public transport and private cars in Tehran, whose possession changes radically the household's consumption of transportation service to mostly private ones, to the detriment of public transport.\u0000 Cet article s'attache à étudier le comportement de mobilité des ménages téhéranais dans un contexte où l'offre de transport est majoritairement privée. L'objectif de cet article est de présenter une analyse des dépenses des ménages en services de transport, issue des informations tirées d'une enquête de consommation (2002). L'analyse approfondie des dépenses d'un échantillon de ménages nous permet d'identifier les déterminants majeurs de la consommation en services de transport à Téhéran. Nous définissons ainsi sept catégories de ménage consommateurs de services de transport à Téhéran. Les divers facteurs stimulant le besoin en mobilité de chaque catégorie sont susceptibles de limiter sa capacité de consommation. Les comparaisons du poids budgétaire de cette dépense et de sa part dans le revenu de ces groupes de ménages suggèrent ensuite l'existence d'inégalités entre les citadins vis-à-vis des services de transport. The “contrat type” is unique to France and it is envied abroad. But, economists have barely studied it. The paper explains how this contract is used to economize transaction costs in this sector and preserves the advantages of the market governance structure. The paper emphasizes how this legal institutional tool influences the economic effectiveness by highlighting its own characteristics. Finally, the paper identifies the necessary requirements that lack today to use this contract in court.\u0000 Cet article procède à une analyse transactionnelle du contrat type d'affrètement au voyage dans le transport fluvial de marchandises. Spécificité française qui nous est enviée à l'étranger, le contrat type est pourtant peu étudié en économie. Nous montrons que, comme tout contrat, il a bien entendu pour objet de diminuer les coûts de transaction du marché spot de ce secteur pour préserver les avantages de cette forme de gouvernance. Surtout, nous mettons en évidence comment cet outil juridico-institutionnel influe, en raison de ses spécificités propres, sur l'efficacité économique du secteur. {"title":"Focus on standard agreements enforceable to inland waterway transports. Civil Structure of a normative work based on the Lex Mercatoria","authors":"Martin Ndende","doi":"10.46298/cst.12110","DOIUrl":"https://doi.org/10.46298/cst.12110","url":null,"abstract":"The inland waterway standard agreements represent in Transport Law one of the major area of expression of the Lex Mercatoria. Designed in four separate categories under the National Transport Council (CNT) and professional organizations, these standard agreements include, in fact, most of the usages and customs applicable to contracts for river transport as practiced in France. The development of such agreements respecting the customs and traditions of the professional world can effectively prevent the proliferation of all sorts of clauses in an economic environment that requires a constant effort of legal harmonization and a respect for the law against such abusive practices. But what lawfulness exactly? It is, from this point of view, very interesting that the very structure of these contracts fully comply with the normative concerns of French civil law and regulations which were, originally enacted to regulate and channel the contracting practices in the river area. But at a time when France is setting up a Transport Code (according to established law), and especially at the time of entry into force, on an international level, of the new Budapest Convention of June 22d, 2001 on the transport of goods by inland waterway (known as CMNI), a general assessment was binding on in the context of a necessary modernization of these contracts.\u0000 Les contrats types fluviaux constituent, en droit des transports, l’un des terrains majeurs d’expression de la Lex mercatoria. Conçus en quatre catégories distinctes sous l’égide du Conseil National des Transports (CNT) et des organisations professionnelles, ces contrats types intègrent, en effet, l’essentiel des usages et coutumes applicables aux contrats de transports fluviaux tels qu’ils sont pratiqués en France. L’élaboration de tels contrats respectueux des usages et coutumes du monde professionnel permet efficacement d’éviter la multiplication de clauses de toutes sortes dans un environnement économique qui exige un effort constant d’harmonisation juridique et un certain respect de la légalité notamment contre les pratiques abusives. Mais de quelle légalité précisément ? Il est, de ce point de vue, très intéressant de constater que la structure même de ces contrats respecte amplement les préoccupations normatives du droit civil français et des textes réglementaires qui furent, à l’origine, édictés pour encadrer et canaliser les pratiques contractuelles dans le domaine fluvial. {"title":"For a systemic approach of the nuisances linked to transports in urban area","authors":"F. Each nuisance is identified, then isolated, only the direct impacts are really taken into account and indirect impacts estimated negligible. This results in a separate treatment of each nuisance causing unintended effects. Negative externalities are in fact a system of interdependent nuisances that converge at the level of indirect impacts, with the formation of synergies and significant negative spirals. So it is better to prevent the nuisances rather than having to treat them. And that is why the traffic calming is an interesting solution. As for the socio-economic appraisal of nuisances, it is no longer simply a sum of individual costs.\u0000 Les externalités négatives des transports en milieu urbain sont considérées d’ordinaire comme une collection de nuisances parfaitement distinctes. Chaque nuisance est identifiée, puis isolée, seuls les impacts directs sont vraiment pris en compte et les impacts indirects jugés négligeables. Il en résulte un traitement séparé de chaque nuisance qui provoque des effets pervers et contradictoires. Les externalités négatives forment en fait un système de nuisances interdépendantes qui convergent au niveau des impacts indirects, avec formation d’effets de synergie et de spirales négatives non négligeables. Aussi est-il préférable de prévenir les nuisances plutôt que de devoir les traiter. Et c’est pourquoi les politiques de modération de la circulation sont justifiées. Changes in travel behaviour that are envisaged preferentially by households are identified, with the resources and constraints at stake for these behaviour changes. Household attitudes towards the carbon tax and personal carbon allowances are analysed. Finally, a typology of the households is drawn up, based upon the strategies they employ in response to the scenarios.\u0000 Cet article vise à présenter, à partir des résultats d’une enquête qualitative menée auprès d’un échantillon restreint de ménages, des premiers éléments d’analyse sur les attitudes et les changements de comportement de mobilité envisagés par les particuliers face à l’instauration d’une taxe carbone ou de quotas d’émissions échangeables de CO2 sur le carburant automobile. {"title":"About environment, transports and “impact laws”","authors":"M. Maurin","doi":"10.46298/cst.12105","DOIUrl":"https://doi.org/10.46298/cst.12105","url":null,"abstract":"Nowadays we are rightly more aware of environmental preoccupations, and naturally this is also the case for the consequences and impacts of Transport. The matter is to have at one’s disposal some adequate tools of evaluation and information about the resulting impacts. In general such tools and indicators do exist, but sometimes one may feel today that these indicators are very numerous, and at the same time that they are disparate, inhomogeneous and respectively ignorant of each other from one environmental profession to another. Firstly, it is thus necessary to step back, to clear up the set of existing indicators and to propose a more structured and coordinated approach in order to attain more suitable impact tools. Next, the text focuses on the “impact law” step, say the relation between an objective input variable describing exposure to pollution and an adapted new impact variable having to characterize the consequences of transportation on environment in “ad-hoc” units (say the related end-points responses). This step is essential, many users and professions have requested “a major effort” for it, and it is again useful to step back. We note that there is a strong connexion between the impact variable status and the associated impact law. The text intends to make an inventory of different methods used to do this, and then to classify and comment on them. Some other developments are also proposed, new or extracted from the vast mathematical arsenal, as parts of suitable impact laws for less considered pollutions than noise and air pollution, such as visual impact in landscapes and rural space fragmentation by new infrastructures.\u0000 Les préoccupations environnementales prennent à juste titre de plus en plus d’importance, et cela n’épargne pas, naturellement, les effets du transport sur l’environnement. Il s’agit ainsi de disposer d’outils adéquats pour mener une évaluation de l’impact des moyens de transport. D’une manière générale de tels outils existent déjà, et l’on serait à présent plutôt confronté à une situation comprenant trop d’outils, des outils disparates et en grande partie ignorants les uns des autres. Il importe donc en premier de prendre du recul, de procéder à un nettoyage de l’existant et d’en profiter pour proposer une démarche plus structurée, coordonnée et globale, avec une vision claire de la morphologie des indicateurs d’impact. L'article s’intéresse ensuite à l’étape de la loi d’impact, c’est-à-dire à la relation qui relie des grandeurs objectives de pollutions (la source) à de nouvelles grandeurs dites d’impact chargées de caractériser les conséquences des pollutions sur l’environnement (la cible touchée et sa réponse). Cette étape est essentielle, plusieurs métiers de l’environnement l’ont souligné, et là aussi il y a lieu de prendre du recul pour une vision plus claire des outils en présence. Our methodology is based on this premise. Modal developments are the consequence of the differentials in modal competitiveness and changes in production systems with their attendant logistics problems. Road transport seems to provide the best response to the need for a competitive edge while rail transport is the most fragile of systems, both from a structural perspective and because of the industry‘s specific history. However, river and canal barge transport, although still limited, have been adapting to the market since the beginning of this century.\u0000 Analyser l'évolution de la répartition modale des quinze dernières années, c'est identifier et pondérer les différents paramètres (potentiel transportable ; modification de la structure de fret par produit ; compétitivité modale) explicatifs de cette évolution, ce que permet la méthode exposée. Cette évolution modale est la conséquence de la mutation du système productif et de ses connexions logistiques.
