Normative legal research is used in this study. The approach used is the statute approach and the conceptual approach. Based on the analysis carried out, it was found that the provisions for the transfer of land rights are based on Law 5/1960 and PP No.24/1997 which can be interpreted as a legal act of transferring land rights that is intentionally carried out so that the rights are released from all holders and are transferred to other parties. The customary village as the owner of land rights is reviewed based on positive Indonesian law, namely that it can be domiciled as the subject of the owner of land rights which is usually found through purchasing efforts with village funds or other businesses. However, there are still potential disputes over efforts to certify customary village land. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Studi ini ditujukan ialah guna mengetahui tentang peralihan hak atas tanah dan mengkaji tentang kedudukan Desa Adat sebagai pemilik hak atas tanah berdasarkan hukum positif Indonesia. Penelitian hukum normatif digunakan dalam penelitian ini. Pendekatan yang digunakan ialah statute approach dan conceptual approach. Berdasarkan analisis yang dilakukan, ditemukan bahwa ketentuan peralihan hak atas tanah didasarkan pada UU 5/1960 dan PP No.24/1997 yang dapat diartikan sebagai perbuatan hukum pemindahan hak atas tanah yang  sengaja dilakukan agar hak itu terlepas dari pemegangnya dan beralih ke pihak lain. Desa adat sebagai pemilik hak atas tanah ditinjau berdasarkan hukum positif Indonesia ialah dapat berkedudukan sebagai subyek pemilik hak atas tanah yang biasa didapati melalui usaha usaha pembelian dengan dana desa maupun usaha lainnya. It can be concluded that uncertified land can be charged with Mortgage as long as the application for credit is carried out simultaneously with the registration of the transfer of land rights to the BPN and if the debtor dies before the repayment period ends, the debt on the credit can be transferred to the heirs of the debtor. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Artikel ini bertujuan menganalisis mengenai Pembebanan dari hak tanggungan yang belum memiliki sertifikat serta solusi jika pemberi dari Hak Tanggungan berupa tanah yang tidak memiliki sertifikat tersebut sudah meninggal dunia serta adanya pewaris sementara kredit belum lunas terbayarkan. Metode dalam penulisan ini yaitu menggunakan metode hukum yuridis normative. Penelitian ini juga menggunakan pengkajian bahan pustaka yang ada seperti aturan serta perundang-undangan, literatur yang mempunyai kaitan. The method used in this article is normative juridical which is descriptive in nature with the approach to legislation, conceptual approach and comparative approach. The results of this study indicate that the application for Electronic HT Warkah can be made through the Regional Office of the BPN by interested parties and the PPAT in its implementation must check the data documents from the parties so that the Statement of Validity and Document Truth truly guarantees the validity of a legal act. The correctness of the material when uploaded in the electronic HT service is the responsibility of the sender of the document. There are 2 (two) people who send documents in the Electronic HT System, namely PPAT and Creditors. \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tujuan dari artikel ini yaitu pengkajian tentang pengaturan dokumen Hak Tanggungan yang disimpan di Kantor PPAT yang telah menjadi warkah dalam hal terdapat permohonan oleh pihak yang berkepentingan terhadap warkah Hak Tanggungan tersebut dan implikasi hukum surat pernyataan pertanggungjawaban keabsahan dan kebenaran dokumen pada pendaftaran HT Elektronik dipandang dari sudut tugas dan kewenangan PPAT. Metode yang dipergunakan dalam artikel ini yaitu Yuridis Normatif yang bersifat Diskriptif Analisis dengan pendekatan perundang-undangan (Statute Approuch) dan Pendekatan Perbandingan (Comperative Approach). Hasil dari penelitian ini menunjukkan bahwa permohonan warkah HT Elektronik dapat dilakukan melalui Kantor Wilayah BPN oleh pihak yang berkepentingan dan PPAT dalam menjalankan tugasnya harus melakukan pengecekan data dokumen dari para pihak agar Surat Pernyataan Keabsahan dan Kebenaran Dokumen yang dibuat merupakan surat yang benar-benar menjamin keabsahan dari suatu perbuatan hukum. This research uses a normative research method, and utilizes a statutory and conceptual approach. The results of the study concluded that according to \"Balinese inheritance law\", a son who marries \"nyentana\" does not have inheritance rights in his original family because he is considered to have left the kedaton. However, after the establishment of the Pesamuhan Agung III Main Council of Pekraman Village (MUDP) Bali in 2010, boys who marry nyentana have limited space to inherit. However, the Decision of the Supreme Council III of the Pekraman Village Main Assembly (MUDP) does not automatically apply as Balinese customary law, before the values ??and principles on that Decision adheres into the awig-awig of traditional villages. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Penelitian ini bertujuan untuk mengkaji hak waris laki-laki yang kawin nyentana terhadap harta warisan di keluarga asalnya menurut hukum adat Bali. Penelitian ini menggunakan metode penelitian normatif, serta memanfaatkan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menyimpulkan bahwa menurut “hukum adat waris Bali”, anak laki-laki yang kawin ”nyentana” tidak memiliki hak waris dalam keluarga asalnya karena ia dianggap ninggal kedaton.  Pasca ditetapkannya  Pesamuhan Agung III Majelis Utama Desa Pekraman (MUDP) Bali tahun 2010, anak laki-laki yang kawin nyentana memiliki ruang untuk mewaris yang sifatnya terbatas. This research is classified as a normative juridical research that uses 3 types of approaches, including the statutory approach, legal interpretation and analysis of legal concepts. The results of the study indicate that the existence of a Commissioner in a Limited Liability Company is not regulated in the work copyright law to avoid a conflict of authority between the Commissioner and the Director who is also the sole shareholder. It is impossible for the supervisory process to be carried out by the Commissioner against the board of directors as well as the sole shareholder who has absolute power. Meanwhile, those who are then authorized to take over the duties and responsibilities of the organs of the Commissioner in an Individual Limited Liability Company are the shareholders, because there is only one personal figure in Individual Limited Liability Companies, namely the Sole Shareholders, who concurrently serves as Director. The organs of  Commissioners in a private company must be regulated and still exist, although in the process of implementation its function is only as a complement, but the void of norms can be avoided. Further regulation is needed to create legal harmonization in order to ensure legal certainty. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000  \u0000Tujuan dari penelitian ini adalah untuk mengkaji tidak diaturnya Organ Komisaris dalam Perseroan Terbatas  Perseorangan dalam Undang-undang  Cipta Kerja, dan mengkaji organ yang berwenang untuk mengambil alih tugas dan tanggungjawab organ Komisaris dalam Perseroan Terbatas Perseorangan menurut Undang-undang Cipta Kerja.  Penelitian ini tergolong jenis penelitian yuridis normatif  yang menggunakan 3 jenis pendekatan, antara lain pendekatan perundang-undangan, penafsiran hukum dan analisa konsep hukum. Hasil penelitian menunjukkan bahwa tidak diaturnya keberadaan Komisaris dalam Perseroan Terbatas Perseorangan di dalam undang-undang cipta kerja adalah untuk menghindari konflik kewenangan antara Komisaris terhadap Direktur yang sekaligus pemegang saham tunggal. The method on this article is used normative legal research with  statutory approach, a conceptual approach, and a case approach. The results of the discussion, namely the SKMHT study of the UUHT contained in Article 15 paragraph (1) of the UUHT explains: \"The Power of Attorney to impose Mortgage must be made with a notary deed or PPAT deed\". In this regulation, a Notary/PPAT have an authority to make SKMHT on that form of a deed, but in fact it fills in fields/blanks/forms that have been prepared by the land agency. The formulation of legal norms in Article 15 paragraph (1) UUHT contains contradictions. In one side, the regulation requires the encumbrance of Mortgage to be made or stated in a Notary deed, but on the other side, it requires the power to encumber Mortgage to be made with a notarial deed/PPAT deed in the form of a “Letter”. So that, SKMHT does not qualify as an authentic deed. Also, the Notary's responsibilities in the form of authority in carrying out his/her duties are stated in Article 15 of the UUJN, so that the authority can provide legal certainty that can be accounted for by the Notary which consists of 3 important aspects, namely: Outward Aspects; Formal Aspects and Material Aspects. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tujuan penulisan artikel ini untuk mengetahui kajian yuridis dalam pembuatan SKMHT menurut UU Hak Tanggungan serta mengenai tanggung jawab Notaris dalam pembuatan SKMHT menurut aturan yang diberlakukan. Metode riset yang dipakai ialah jenis penelitian hukum normatif dengan pendekatan peraturan perundangan, pendekatan konseptual, pendekatan kasus. Adapun hasil pembahasan yaitu mengenai kajian SKMHT dari UUHT yang terdapat pada Pasal 15 ayat (1) UUHT menjelaskan: “Surat Kuasa Membebankan Hak Tanggungan wajib dibuat dengan akta notaris atau akta PPAT”. Dalam peraturan tersebut, Notaris/PPAT mempunyai kewenangan dalam membuat SKMHT dalam bentuk akta, namun dalam praktiknya mengisi isian/blangko/formulir yang telah disiapkan oleh instansi pertanahan. Rumusan norma hukum dalam pasal 15 ayat (1) UUHT mengandung pertentangan. Dalam satu sisi peraturan tersebut mewajibkan membebankan Hak Tanggungan yang dibuat atau dituangkan dengan akta Notaris, namun disisi lain mensyaratkan kuasa membebankan Hak Tanggungan dibuat dengan akta notaris/akta PPAT dalam bentuk “Surat”. Sehingga, SKMHT tidak memenuhi syarat sebagai akta otentik. The results of this study indicate that the meaning of certain reasons in Article 3 point 15 is a condition that is permissible and doesn’t violate the provisions of Notary public Law or Amandments to the Notary Code of Ethics. Things that can be classified as qualifying of the certain reasons are related to the making of a relaas deed which is generally made outside the office and if the client is in a bad condition and not possible to leave the house or hospital to come to the Notary’s office. Furthermore, the violation of the provisions of Article 3 point 15 doesn’t necessarily affect the authenticity of the authentic deed. \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tujuan penelitian ini untuk mengetahui apa saja yang termasuk ke dalam kualifikasi alasan-alasan tertentu dalam Pasal 3 angka 15 Perubahan Kode Etik Notaris yang menyatakan bahwa “Notaris wajib menjalankan jabatan Notaris di kantornya, kecuali alasan-alasan tertentu yang dilakukan tidak dalam kantor Notaris sehingga terciptanya kepastian hukum.” Penelitian ini menggunakan metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa arti dari alasan-alasan tertentu pada Pasal 3 angka 15 KEN-P merupakan keadaan yang dibolehkan serta tidak melanggar peraturan UUJN ataupun KEN. Hal yang dapat digolongkan dalam kualifikasi alasan-alasan tertentu yaitu berkaitan dengan dibuatnya akta relaas yang pada umumnya memang dibuat di luar kantor serta apabila klien atau penghadap Notaris sedang sakit yang kemudian tak dimungkinkan untuk keluar rumah ataupun rumah sakit demi datang ke kantor Notaris. The method used is normative legal research. This study result is indicate that the arrangement for making a certificate of inheritance related to division of population groups in Indonesia is regulated in Article 111 paragraph (1) of Ministerial Regulation No. 3 of 1997 on the Implementation of Land Registration which divides into 3 (three) groups, namely Indonesian Citizens, Indigenous People, Chinese Descendants. and Foreign Eastern Descent, then there are also 3 (three) officials who have the authority to make a certificate of inheritance in Indonesia according to their class. This classification raises the problem that Ministerial Regulation Number 3 of 1997 on the Implementation of Land Registration is contrary to Law Number 40 of 2008 on Elimination of Discrimination which is a higher regulation and should eliminate the classification of society related to the issuance of a certificate of inheritance in Indonesia. The urgency of a notary to be given the authority to make a deed of inheritance rights because a notary is an official who makes a deed whose legal force of proof is perfect, guaranteed order, certainty, and legal protection. Article 15 paragraph (1) of the Law on Notary Positions becomes the basis for Notaries in acting and constructing a Certificate of Inheritance for all residents and/or citizens of Indonesia, in order to create legal certainty for makers of Certificate of Inheritance in Indonesia. \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tujuan artikel ilmiah ini yaitu untuk memahami pengaturan mengenai dibuatnya Surat Keterangan Waris terkait pembagian golongan penduduk di Indonesia. Metode yang digunakan adalah penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa pengaturan dibuatnya surat keterangan waris terkait pembagian golongan penduduk di Indonesia diatur pada Pasal 111 ayat (1) Peraturan Menteri Nomor 3 Tahun 1997  Pelaksanaan Pendaftaran Tanah yang membagi atas 3 (tiga) golongan yaitu golongan Warganegara Indonesia Penduduk Asli, Keturunan Tionghoa dan Keturunan Timur Asing, kemudian terdapat juga 3 (tiga) pejabat yang memiliki wewenang dalam dibuatnya suatu surat keterangan waris di Indonesia sesuai dengan golongannya. Penggolongan semacam ini menimbulkan permasalahan bahwa Peraturan Menteri Nomor 3 Tahun 1997 Pelaksanaan Pendaftaran Tanah sudah bertentangan dengan UU Nomor 40 Tahun 2008 Penghapusan Diskriminasi yang merupakan aturan yang lebih tinggi dan sudah seharusnya menghilangkan penggolongan masyarakat terkait dibuatnya surat keterangan waris di indonesia. The writing of this article uses a normative legal research method and uses a statutory approach and a conceptual approach. The results of this research are that referring to the Decree of the Ministry of Law and Human Rights Number: AHU03.UM.01.01 of 2018, the investigation team has several powers, namely receiving public complaints that are directly submitted to the regional office, helping the smooth work of the Notary Supervisory Council, and also examining complaints received. The results of the study indicate that the definition of \"certain reasons\" is a reason that is permitted by law. If a violation of this article is committed, it will not affect the authenticity of the deed because the Notary is authorized to make the deed outside the office or outside his domicile while still in the area of ??office. Kajian penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan serta pendekatan konseptual. Teknik pengumpulan bahan hukum menggunakan studi kepustakaan. Hasil penelitian menunjukkan bahwa definisi mengenai “alasan-alasan tertentu” merupakan suatu alasan yang di perbolehkan oleh Undang-Undang. Jika pelanggaran terhadap pasal tersebut dilakukan, maka tidak serta mempengaruhi ke autentikkan akta dikarenakan Notaris berwenang membuat akta diluar kantor atau diluar tempat kedudukannya selama masih berada di wilayah jabatan.
