Chabanet","doi":"10.3917/rpec.202.0105","DOIUrl":"https://doi.org/10.3917/rpec.202.0105","url":null,"abstract":"L’entreprenariat social nous engage dans deux formes de responsabilite, l’une obligataire, qui ressortit au registre juridique et moral, l’autre mondaine ou cosmologique, qui ressortit au registre de l’action et de la creation. La pratique entrepreneuriale en tant que telle honore prioritairement la responsabilite cosmologique, tandis que la dimension sociale de cette pratique refere, quant a elle, au caractere obligataire. Dans cet article, nous proposons de revenir sur la genealogie de ces deux acceptions fondamentales de la responsabilite, qui ont trouve dans le kantisme a la fois leur lieu de formulation philosophique et leur point de bifurcation, mais aussi de degager la portee et les limites de leur dialectisation dans l’activite sociale-entrepreneuriale aujourd’hui. Nous montrons que la premiere convoque en son sein plusieurs traditions de philosophie morale impliquant differentes extensions du concept, ce qui oblige a nous interroger sur sa propre operabilite. La seconde, que nous aurons a cœur d’illustrer en rapportant certains discours d’entrepreneurs, a ete davantage honoree a l’epoque contemporaine par les approches phenomenologiques et de philosophie de l’action de tendance analytique. Il entama sa reflexion en appliquant l’hermeneutique phenomenologique aux pensees de Pascal et de Marx puis il se mit en quete d’une philosophie de l’histoire ou la conscience presente de l’historicite est centrale. Il allait reconnaitre un type d’humanite dotee a la fois de pathos et du logos qu’il reintepretait. Son engagement dans le movement de la culture proletarienne et dans les fondements philosophques du Mouvement de l’Ordre Nouveau fut un double echec. Today there are fervent arguments advanced in philosophical academia on what kind of, in any, taxation is justifiable, largely owing to Liam Murphy and Thomas Nagel’s The Myth of Ownership. In this controversial book, they claims that there are no such things as a morally legitimate right to pretax property or natural property rights and that taxation never infringes upon property rights because they are only institutionally created by governmental decree. Murphy and Nagel’s main target is Richard Epstein’s opposite libertarian or classical liberal view on tax. Epstein likens taxation to public expropriation or eminent domain and argues for proportionate income tax.Here, after concurring with Epstein’s view on private property with some important qualifications, I critically examine Murphy and Nagel’s statist property theory and claim that their overall egalitarianism is not argued for but merely presupposed. I conclude that estate tax is more justifiable kind of tax from the natural rights libertarian perspective than both income tax and consumption tax, which are the most common form of taxation today. Il existe diverses formes d’ethique libertarienne. Ici, dans la lignee de Nozick, la « propriete de soi » et la clause lockeenne sont reconnus comme deux rouages essentiels de l’argumentation qui conduit a leur ajustement en vue d’une ethique specifique. Nous examinons comment Nozick defend la « propriete de soi » : son argumentation respecte la separabilite des personnalites et elle accorde une grande importance a l’elaboration libre par chacun d’un mode de vie lui convenant. Une fois revisees la nature du droit dit « d’appropriation » et de la clause dite « lockeenne », nous reinterpretons cette position centrale des libertariens en considerant la position fondamentale de Nozick comme prenant appui sur une conception egalitariste de la notion de dispositions suffisantes. Les avantages de cette position sont dus non seulement a l’adequation entre la theorie et un principe de distribution, mais encore a l’image de l’individu dote d’une propriete de soi reaffirmee, dans la vision libertarienne que Nozick deploie. Cette approche fournit les bases de la morale d’une activite libre exercee sur les marches : ce point est essentiel pour les auteurs libertariens, qui refusent toute alienation de la propriete privee et toute redistribution.
