The purpose of the study was to solve the scientific problem of determining the objective side of the crime provided for in Article 210.1 of the Criminal Code of the Russian Fed-eration. In the course of the research, the historical-legal, chronological, formally legal method was used. As a result of the study, the object of the crime, the objective side of the crime, the moment of the end of the crime provided for in Article 210.1 of the Criminal Code of the Russian Federation were established. The «occupation» of the highest position is considered as a process and as a result of the illegal activity of the subject. The competition of preparation for a crime committed for the purpose of occupying the highest position in the criminal hierarchy and preparation for a crime provided for in Article 210.1 of the Criminal Code of the Russian Federation is considered. It should be noted that the correct definition of the subject of legal regulation is the key to the effectiveness of such an impact, in addition, understanding the subject makes it possible to better systematize legal material officially and informally, as well as teach the relevant branch of law. The existence of such a branch of law as \"administrative law\" in the legal system is not disputed by anyone, however, the subject content of this branch is still important, the allo-cation of key institutions in it that form it today. Mongolia occupies a special place among friendly countries and bordering Russia in the north. In this regard, I would like to conduct a comparative legal study of the licensing institute in both countries. This article examines the fundamental provisions of licenses, their types, licensing as an administrative procedure. Special attention is paid to the conduct of licensing control and within its framework the most effective institution of administrative responsibility applied for the commission of administrative offenses in the field of licensing. The types of administrative penalties \u0000are investigated and their effectiveness in both countries is considered. The directions of historical and legal analysis of the prerequisites for the emergence of police functions are presented. The materials of the article reveal the factors that caused the peculiarity of police functions in the system of the Old Russian state, which is usually understood as the so-called pre-Mongol period of the IX -mid-XIII centuries. The paper reveals the interdependence of the level of development of the state and law, law enforcement and police functions.
