ACTUAL PROBLEMS OF QUALIFICATION OF THE ACT PROVIDED FOR BY ARTICLE 210.1 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION «OCCUPATION OF THE HIGHEST POSITION IN THE CRIMINAL HIERARCHY» (ARTICLE ONE)

Abstract

The subject of the study is the composition of the crime under Article 210.1 of the Criminal Code of the Russian Federation. The purpose of the study was to solve the scientific problem of determining the objective side of the crime provided for in Article 210.1 of the Criminal Code of the Russian Fed-eration. In the course of the research, the historical-legal, chronological, formally legal method was used. As a result of the study, the object of the crime, the objective side of the crime, the moment of the end of the crime provided for in Article 210.1 of the Criminal Code of the Russian Federation were established. The «occupation» of the highest position is considered as a process and as a result of the illegal activity of the subject. The competition of preparation for a crime committed for the purpose of occupying the highest position in the criminal hierarchy and preparation for a crime provided for in Article 210.1 of the Criminal Code of the Russian Federation is considered. The issue of determining the moment of the end of the crime provided for in Article 210.1 of the Criminal Code of the Russian Federation is considered.
