However, they are not obliged to give the right to marry to same-sex partners taking into account dominant moral beliefs in society. This paper aims to test such an approach from the perspective of four theories of justice. The aim is to see if the consistent application of precepts and principles of these theories of justice to this case law makes such an approach of the ECtHR just from the viewpoint of any of these theories of justice. Istraživanje je usmereno na analizu efekata postojeće poreske politike koja se odnosi na izgradnju, kupovinu, posedovanje i upotrebu stambenih jedinica u glavnom gradu. Istraživanje ima tri grane: prvo, rad analizira postojeći institucionalni okvir poreza na kupoprodaju nekretnina i poreza na imovinu; drugo, autori nude kvalitativno istraživanje kroz intervjue agenata za nekretnine i kupce nekretnina da bi utvrdili motive za kupovinu njihove prve, odnosno svake sledeće nekretnine; treće, rad nudi model determinanti cena nekretnina u Gradu Beogradu. Ukrštanjem rezultata empirijskog istraživanja, rad teži razvijanju alternativnih modela oporezivanja koji bi doprineli promeni podsticaja u okviru stambene politike, čime bi ih učinili delom sistema socijalne pravde. Promena podsticaja treba da dovede do toga da stambene jedinice postanu dostupnije i pristupačnije za ljude koji u njima žele zapravo da žive, a progresivno skuplje za vlasnike koji koriste stambene jedinice kao poslovni prostor, investicionu ili štednu imovinu. {"title":"Territorial Disputes in the Post - Yugoslav Space","authors":"T. Bickl","doi":"10.20901/pp.13.1.05","DOIUrl":"https://doi.org/10.20901/pp.13.1.05","url":null,"abstract":"This analysis of a sample of territorial or border disputes 30 years after the beginning of Yugoslavia’s disintegration is informed by a pluri-angle analytical framework. With territorial disputes, a single reading of the phenomenon by international law with its established principles and standards of peaceful dispute settlement can be insufficient. More often than not, territorial disputes not only relate to territorial sovereignty per se, but also to issues of nation-building and statehood, identity narratives, ontological security, and(perceived) legitimacy as to whether a border is ‘just’. In the context of EU enlargement, the level of power (a)symmetry between actors also plays a role. Looking at the case studies (i) Croatia v. Slovenia, (ii) Serbia v. Croatia, and (iii)Serbia v. This proliferation of actors posed some new questions about the relationship between them. One of the aspects of this relationship is the power of actors. The paper seeks to contribute to public policy literature in a way to explore if a policy formulation stage of a decision-making process can be used as an arena for assessing the power of the aforementioned actors. Such democratic states became characterized by multiparty elections, tolerance for opposition tolerance, media freedom, protection of human rights and respect for the rule of law. However, recent trends show that democratic growth has stalled while its gains are short-lived in many states. This is evidenced in the rise in third termism, constitutional coups, military coups and digital authoritarianism that plagues the continent – suggesting a wave of democratic relapse and autocracy. One is therefore poised to ask what the state of democracy in Africa is and what trends and practices have led to a general decline in levels of democracy. To this end, this paper assesses the incidence of democratic recession in Africa by adopting a descriptive and analytical approach that relies on secondary data sourced from peer-reviewed journal articles, reports, briefs and internet sources. It was found that the decline in democratization, otherwise democratic relapse heralds an epoch of democratic instability and entrenched autocracy in the continent. This is not unconnected with the spate of bad governance, violent electoral contestation, digital repression and widespread violation of human rights that is prevalent on the continent. The main hypothesis is that the Washington Agreement was manipulatively used for self-promotion of political elites that negotiated in Washington. The research relies on Critical Discourse Studies, instrumentalist approaches to secession, media framing and agenda-setting theories. We conclude that the issue of Serbia and Kosovo normalisation in Serbian media is mostly framed with aim to mobilises citizens’ support for executive authorities. Analiza je obuhvatila članke objavljene u politološkim znanstvenim i stručnim časopisima u razdoblju od 1990. do 2020. godine. Glavni je nalaz provedene analize da je izravna demokracija bila na marginama istraživačkih interesa hrvatske politologije. To je posebice vidljivo ukoliko se opseg tematiziranja izravne demokracije usporedi s tematiziranjem različitih institucija predstavničke demokracije. Hrvatska politologija primarno je fokusirana na model predstavničke demokracije, a tek sporadično se bavi izravnom demokracijom. {"title":"Normativni konstitucionalizam i jamstvo socijalnih prava u ustavnoj državi","authors":"Valentino Kuzelj","doi":"10.20901/pp.12.2.03","DOIUrl":"https://doi.org/10.20901/pp.12.2.03","url":null,"abstract":"U suvremenosti je napušteno umjetno razdvajanje općeg koncepta ljudskih prava na sudski ostvariva klasična liberalna (građanska i politička) prava, te aspiracijska i programska socijalna i ekonomska jamstva isključena od mogućnosti (ustavno)sudske zaštite. Stoga je razložno tvrditi da i socijalna prava predstavljaju izraz normativnog konstitucionalizma. Osobito uzme li se u obzir njihov značaj u stvaranju materijalnih preduvjeta ostvarenju dostojanstva i autonomije pojedinca kao svrhe i cilja suvremene ustavne države. Pritom njihova povezanost s proračunskom materijom, kao prerogativom tijela predstavničke demokracije, ne smije biti valjan razlog odricanja mogućnosti njihove (ustavno)sudske ostvarivosti, jer bi se time propis zakonskog ranga (proračun) izdigao ponad vrijednosne strukture temeljnoga dokumenta (ustava) koji uspostavlja pravo na minimum sredstava za vođenje dostojnoga života i autonoman razvoj ljudske osobe. S time na umu, ipak je potrebno definiranje granice do koje ustavno sudište može ići u njihovoj zaštiti, a da ne pokuša supstituirati zakonodavca. Na teorijskoj je razini nemoguće povući „krutu“ crtu razgraničenja između uloge (ustavnog)sudstva i zakonodavca pri realizaciji ustavnih socijalnih jamstava. Stoga se najpogodnijim rješenjem ističe učenje iz poredbene prakse kolumbijskog Ustavnog suda čiji je aktivistički i agresivan pristup zaštiti socijalnih prava u određenim trenucima koketirao s politizacijom Ustavnoga suda. {"title":"Pogled odozgo","authors":"Aleksandra Krstić","doi":"10.20901/pp.12.1.01","DOIUrl":"https://doi.org/10.20901/pp.12.1.01","url":null,"abstract":"Veliki broj političara koristi vizuelni medijski sadržaj za potrebe lične promocije, predizbornih kampanja i za komunikaciju sa biračima. Pored televizijskih snimaka i fotografija u štampanim medijima, političari sve više koriste vizuelno-centrične digitalne platforme, poput Instagrama, Jutjuba, Snepčetai TikToka, kako bi doprli do šire javnosti i obezbedili veću podršku. Jedan broj političara redovno koristi Instagram kao mrežu koja beleži ogroman rast u odnosu na druge poznate društvene mreže. Instagram je svojom vizuelnošću omogućio političku hiperindividualizaciju, pa se čini da su inače distancirani predsednici, premijeri i drugi političari sve „običniji” i bliži građanima. Jedan od njih je i predsednik Srbije Aleksandar Vučić, čiji je zvanični Instagram profil @buducnostsrbijeav poslednjih godina postao važan izvor informacija mejnstrim medijima u Srbiji, pa i Javnom medijskom servisu. Imajući u vidu ovaj kontekst, u radu se istražuje kako se na Instagram profilu predsednika Srbije vizuelno reprezentuju građani Srbije i kao objekati kao izvor politike.
