The prerequisite for its use is the fulfilment of the conditions referred to in Article 173 § 3 of the Polish Criminal Executive Code. According to the intention of the framers, it was supposed to discipline the convicted person so that they would observe the law in force and, in the period of probation, submit to the obligations imposed on them. Since this legal institution has been in force for almost 10 years, it has been decided to have a look at how it functions in practice. For that purpose, research was carried out, in which an attempt was made to establish how court probation officers apply the institution of admonition to convicted offenders and whether it is an effective tool in influencing their behaviour. The research included 151 cases in which probation officers applied admonition in 2015-2017. The research was carried out on the basis of an analysis of probation files. As a result, it was established, among other things, that in some of the cases a change in the convicted person’s (offender’s) behaviour can be observed after the admonition was given. In Poland, the system of assisting prisoners\u0000includes not only the Prison Service and probation officers, but also the\u0000Public Employment Services, social welfare institutions, and non-governmental\u0000organizations. Helping former convicts and returning them to the\u0000paths of social functioning brings benefits that go beyond the individual\u0000dimension and pays off not only in the local space, but also in the long\u0000term – affecting subsequent generations and shaping their resources and\u0000patterns of functioning. The article draws attention to the essence of social\u0000and professional reintegration and re-adaptation of people leaving prisons,\u0000taking into account the basic goal of institutional and social interactions,\u0000which is change. At the same time, it emphasizes the importance of the\u0000functioning of institutions and non-profit organizations in the world that\u0000implement various programs of social and professional reintegration and\u0000re-adaptation of people at risk of social exclusion due to their criminal past. The purpose of the\u0000research was to determine whether and how outpatient protective measures\u0000influenced the practice of applying psychiatric detention in case of\u0000insane persons, in particular, whether outpatient treatment is used instead\u0000of placement in a psychiatric facility in the case of committing offences\u0000with a lower degree of social harmfulness. The purpose of the research\u0000on the procedural law was to determine whether the judicature of the\u0000Supreme Court emphasizing the procedural standard in cases concerning\u0000the discontinuation of proceedings against an insane perpetrator affected\u0000the observance of procedural guarantees of insane perpetrators in criminal\u0000proceedings. The conclusions of the research are based on the statistical\u0000data of the Ministry of Justice, the General Prosecutor’s Office and the\u0000file research. The conclusions of the research are as follows: there was no significant change concerning the practice of imposing placement in\u0000a psychiatric facility on insane perpetrators after July 1st, 2015. The types\u0000of prohibited acts the commission of which justify placing the perpetrator\u0000in a psychiatric facility have not changed significantly. On the other\u0000hand, the procedural guarantees of the insane perpetrator are respected\u0000to a slightly higher degree at present. Mediation is used in various areas of human life, both\u0000external, interpersonal, related to influencing human behavior, as well\u0000as internal, intrapersonal, related to emotions, experiences, feelings and\u0000social attitudes resulting from them. The use of this institution is also\u0000closer to judicial practice, both in terms of broadly understood civil law\u0000and criminal law or proceedings in juvenile cases. The analysis of this issue\u0000gives grounds for the claim that mediation, as a certain form of striving for\u0000agreement, has a real impact on every aspect of human life. However, the\u0000problem is much more complex. This analysis is only an outline of it and\u0000an attempt to draw attention to those issues that at first glance seem to be\u0000of little importance, but as a consequence have a number of far-reaching\u0000social and legal consequences.\u0000The aim of the work is to present mediation in the Polish criminal trial\u0000and its importance for every citizen, both from a legal, social and psychological\u0000perspective.
