This study aims to examine the problem of taking global cybercriminals and examine solutions to applying the Aut Dedere Aut Judicare principle through the ratification of the Budapest Convention . The research method used in this study is normative legal research with a regulatory approach, cases, and comparative analysis. The study results indicate that Indonesia does not yet have a special regulation regulating cybercrimes; however, two rules cover cybercrimes offences, namely, the Criminal Code and the ITE Law. However, these two regulations can still not deal with transnational cybercriminals specifically for fun issues. Therefore, applying the Aut Dedere Aut Judicare principle through the Budapest Convention ratification becomes urgent for implementation. The Aut Dedere Aut Judicare principle states that every country will understand with other countries to arrest, prosecute and prosecute perpetrators of international crimes. Poor administration and regulation of the waqf system cause dysfunction of this Muslim's most extensive resource. The waqf studies usually focus on issues around the misuse of waqf land, the swapping of waqf land, or the strategy for managing productive waqf land. Research on the disorganization of the waqf land remains unnoticed by researchers. This study complements previous writings' shortcomings by examining the patterns of waqf land disorganization and its consequences for the Muslims, including the waqf's low productivity, the waqf land position as a disputed source, and the waqf land as a lost-risk Muslim property. This study is empirical waqf research with interviews as the primary data and documents from online news website sources as the secondary data. This study indicates that the disorganization of waqf land is not only due to the absence of an administrative system and a lack of institutional commitment to waqf management. It is also rooted in Muslims' cosmological structure, who believe that waqf is the doer's afterlife savings. This belief resulted in the neglect of the waqf administration process, which led to the dysfunction of the community's resources. This study suggests further research on the contemporary waqf with its variants and waqf's practice from the doers’ and the managers' perspective to more comprehensively portray the problem of waqf land disorganization.Keywords: resource dysfunction; disorganization; waqf land; nazhir.Abstrak:Wakaf merupakan properti sumber kesejahteraan umat yang belum dikelola secara serius. Sistem administrasi dan regulasi wakaf yang buruk menyebabkan disfungsi sumber daya terbesar umat. Sejauh ini kajian wakaf terfokus pada isu sekitar penyalahgunaan tanah wakaf, tukar-guling tanah wakaf, atau strategi pengelolaan tanah wakaf produktif. Kajian seputar disorganisasi tanah wakaf masih luput dari perhatian para peneliti. Studi ini melengkapi kekurangan pelbagai tulisan terdahulu dengan mengkaji secara rinci pola disorganisasi tanah wakaf dan akibatnya bagi umat meliputi produktifitas wakaf yang masih dinilai rendah, posisi tanah wakaf sebagai sumber sengketa, dan tanah wakaf sebagai muslim property yang berisiko hilang. Kajian ini termasuk studi wakaf empiris dengan data primer dalam bentuk wawancara dan data sekunder yang diperoleh melalui dokumen dari sumber website berita online. Hasil studi ini menunjukkan bahwa disorganisasi tanah wakaf bukan hanya tidak tersedianya sistem administrasi dan rendahnya komitmen kelembagaan dalam pengelolaan wakaf, namun ternyata mengakar dalam sistem kosmologi kaum muslim yang meyakini wakaf sebagai tabungan akherat bagi wakif. The number of cases, the death tolls, the steps that each country’s government must take, and the activities of social life that must be practiced by all people, among others, are interesting phenomena to study. This paper tries to examine from the Islamic perspective, regulations issued by the Indonesian Government and edicts issued by religious institutions and organizations in Indonesia, especially of the Indonesian Council of Ulema (MUI), Nahdlatul Ulama (NU), and Muhammadiyah, in response to the COVID-19 outbreak in Indonesia. This study is qualitative research with a discourse analysis that discusses the legal-socio-contextual aspects of the rules and fatwās/edicts with the maqāṣid sharī'ah (purposefulness of Islamic law) approach. The results show that the regulations and edicts are in accordance with fundamental values in the discourse of obtaining the objectives of Islamic law (maqāṣid sharī’ah), and the necessity to preserve one’s soul is prioritized over preserving one’s religion since practicing religious teachings can only be conducted whenever one’s soul is preserved.Keywords: Pandemic; COVID-19; Fatwā; Indonesian Regulation; Maqāṣid Sharī'ah. Abstrak: Sejak pertama kali muncul di Wuhan, China, COVID-19 telah menjadi perhatian dunia dan kini dampaknya sebagai pandemi sudah terasa secara global. Banyaknya kasus, jumlah korban meninggal, langkah-langkah yang harus diambil oleh pemerintah masing-masing negara, dan aktivitas kehidupan sosial yang harus dilakukan oleh semua orang menjadi fenomena yang menarik untuk dikaji. Tulisan ini mencoba mengkaji, dari perspektif Islam, peraturan yang dikeluarkan oleh Pemerintah Indonesia dan fatwa yang dikeluarkan oleh lembaga dan organisasi keagamaan di Indonesia, khususnya Majelis Ulama Indonesia (MUI), Nahdlatul Ulama (NU), dan Muhammadiyah, dalam menyikapi mewabahnya COVID-19 di Indonesia. Penelitian ini merupakan penelitian kualitatif dengan analisis wacana yang membahas aspek legal-sosio-kontekstual terhadap aturan dan fatwa dengan pendekatan maqāṣid syari'ah (tujuan hukum Islam). Through WRS, farmers can access capital and obtain proper selling prices of agricultural commodities. The implementation of WRS is still interesting to study, especially in Malang Regency. This article aims to analyze the factors of the ineffectiveness of WRS in Malang Regency in terms of legal benefit theory. This article is based on empirical law research with a sociological approach. The results showed that the implementation of WRS in Malang Regency has not been able to provide solutions to farmers' problems. The policies issued by the Ministry of Agriculture are easier and less costly. This study can be used as a recommendation for the government to review the WRS arrangements so that the legal objective of WRS to provide maximum benefit to farmers and society in general can be achieved.Keywords: warehouse receipt system; farmer; agriculture; policy.Abstrak: Sistem Resi Gudang (SRG) merupakan bentuk perlindungan negara terhadap petani di Indonesia. Melalui SRG petani dapat mengakses modal dan mendapatkan harga penjualan komiditas pertanian secara layak implementasi SRG masih menarik untuk dilakukan kajian, khususnya di Kabupaten Malang. Artikel ini bertujuan menganalisis factor kurang efektifnya SRG di Kabupaten Malang ditinjau dari teori kemanfaatan hukum. Artikel ini berdasarkan penelitian hukum empiris dengan pendekatan sosiologis. Hasil penelitian menunjukkan bahwa implementasi SRG di Kabupaten Malang belum mampu memberikan solusi bagi persoalan petani. Kebijakan yang dikeluarkan oleh Kementerian Pertanian lebih memudahkan dan tidak mengeluarkan banyak biaya. As a result, several business sectors in the community experienced a decline, so the state issued a legal policy to take steps to resolve it. Legal politics as a form of government policy in an effort to restore the national economy is a necessity. This article uses a type of normative juridical research method, with a statutory and conceptual approach, legal materials (primary, secondary, tertiary) are analyzed using the content analysis method. This article shows and emphasizes the urgency of the government's legal politics in efforts to recover the national economy due to the Covid-19 pandemic. In the process of its formation, it certainly requires a comprehensive, integrated and targeted policy set. The 1945 Constitution Article 22 paragraphs (1-3) provides space for the government to stipulate Perpu No. 1 of 2020 becomes Law No. 2 of 2020 as a legal umbrella in an effort to maintain the resilience of all elements of the nation from all threats that endanger the safety of the people of the nation and state. The role of the government's legal policy in national economic recovery has a central position in anticipating a fragile \"system\" and management. The national economic recovery policy cannot be separated from the legal politics policy itself, of course by taking into account the principles of prudence, good faith and full integrity and remains based on the principles of good governance, accountability, and transparency.Keyword: Legal Politics, Economic Recovery, Covid-19, Economic Constitution.Abstrak :Pandemi Covid-19 memperlambat laju pertumbuhan ekonomi di Indonesia. Akibatnya beberapa sektor usaha bisnis di masyarakat mengalami penurunan, sehingga negara mengeluarkan kebijakan hukum untuk mengambil langkah penyelesaian. Politik hukum sebagai bentuk kebijakan pemerintah dalam upaya pemulihan ekonomi nasional menjadi keniscayaan. Artikel ini menggunakan jenis metode penelitian yuridis normatif, dengan pendekatan perundang-undangan dan konseptual, bahan hukum (primer, sekunder, tersier) dianalisis menggunakan metode content analysis. Artikel ini menunjukan dan menekankan urgensi politik hukum pemerintah dalam upaya pemulihan ekonomi nasional akibat pandemi Covid-19. Dalam proses pembentukannya tentu membutuhkan perangkat kebijakan yang komprehensif, terintegrasi dan tepat sasaran. One of the articles that also received criticism was Article 27 paragraph (3). Article a quo negates every action, including decisions, is not the object of the PTUN lawsuit. This is clearly contrary to the principle of the rule of law which guarantees the protection of the law and human rights. PTUN is one of the means of legal protection and human rights for people who are harmed by decisions or actions of state administration. By examining library materials or secondary data and using legislation, concepts, and historical approaches, this article will focus on two problem formulations, namely whether all actions and decisions according to the Perppu are included in the object of the PTUN lawsuit? and why are these actions and decisions excluded from the object of the Administrative Court lawsuit? Because of its development, the study of maqasid discourse is still in an effort to find the ideal form of the conceptual formulation. For this reason, this study will review the correlation between the understanding of maqasid sharia and social change as a necessity in an effort to do istinbath al-ahkam. This article uses a qualitative research method that uses authoritative references as primary sources and scientific publications as secondary sources of references which are then analyzed using descriptive-analytical methods. Three main points can be concluded from this article, namely: 1) the development of thought and social change influences the istinbath al-ahkam method of cases that are waqi’iyah; 2) understanding of social changes in society based on socio-anthropological aspects both in the Nubuwwah era and today is significant in maqasidi reasoning; 3) understanding maqashid sharia and social change is very urgent (essential) for a jurist, especially for the purposes of istinbath al-ahkam so that the legal conclusions drawn do not depend on a literal understanding of the text alone; Moreover, this legal case never happened in the time of the Prophet Muhammad p.b.u.h. is still alive, and it is difficult to find the text explicitly, and the resulting law can carry the spirit of the maqasid itself, namely masalih lil ‘ibad.Keywords: Maqashid Sharia; Social Change; Istinbath al-Ahkam.Abstrak: Maqasid al-syari’ah menjadi salah satu tema kajian yang menarik untuk dikaji. Sebab dalam perkembangannya, kajian diskursus maqasid masih dalam upaya mencari bentuk rumusan konsepsi yang ideal. Untuk itu, kajian ini akan mengulas korelasi antara pemahaman atas maqasid al-syari’ah dan perubahan sosial sebagai sebuah keharusan dalam upaya melakukan istinbath al-ahkam. Artikel ini menggunakan metode penelitian kualitatif yang menjadikan rujukan-rujukan otoritatif sebagai sumber primer dan publikasi-publikasi ilmiah sebagai sumber sekunder referensinya yang kemudian dianalisa dengan metode deskriptif-analitis. Various regulations have been issued to guarantee the rights of persons with disabilities. One of them is the right to have a body in the public space. However, the implementation of these regulations has not run optimally. This article aims to analyze the implementation of the policy on the religious rights of persons with disabilities and the factors that hinder its fulfillment. In addition, this article also describes what solution steps need to be taken in order to provide legal protection for the fulfillment of the right of worship accessibility for persons with disabilities in Malang City from a maqashid sharia perspective. This article is a doctrinal law research with a sociological approach. Primary data were obtained directly through interviews, while secondary data were obtained through documentation. The results of this study indicate that the state has protected the rights of persons with disabilities through Law Number 39 of 1999, Law Number 8 of 2016, Regional Regulation of Malang City Number 2 of 2014, Regional Regulation Number 4 of 1997. However, the implementation of this regulation encountered obstacles. because of the lack of socialization and coordination between the government and the community. The fulfillment of the right of accessibility for persons with disabilities in carrying out worship at the Malang City Mosque is part of the primary sharia maqashid, in particular maintaining religion (hifz al-din) and honoring persons with disabilities as human beings.Keywords: disabilites; religious right; maqashid syariah.Abstrak: Pemenuhan hak penyandang disabilitas menjadi perhatian masyarakat. Berbagai regulasi telah dikeluarkan untuk menjamin hak-hak penyandang disabilitas. Salah satunya adalah hak beribadan di ruang public. Namun, implementasi peraturan tersebut belum berjalan maksimal. Artikel ini bertujuan menganalisis pelaksanakaan kebijakan hak beragama penyandang disabilitas dan faktor-faktor penghambat pemenuhannya. Selain itu, artikel ini juga mendeskripsikan langkah solutif apa yang perlu diambil dalam rangka memberikan perlindungan hukum bagi pemenuhan hak aksesibilitas ibadah bagi penyandang disabilitas di Kota Malang perspektif maqashid syariah. Artikel ini merupakan penelitian hukum doctrinal dengan pendekatan sosiologis. Data-data yang bersifat primer diperoleh secara langsung melalui wawancara sedangkan data sekunder diperoleh melalui dokumentasi. Hasil penelitian ini menunjukkan bahwa negara telah melindungi hak-hak penyandang disabilitas melalui Undang-Undang Nomor 39 Tahun 1999, Undang Nomor 8 Tahun 2016, Peraturan Daerah Kota Malang Nomor 2 Tahun 2014, Peraturan Daerah Nomor 4 Tahun 1997. Later, the Constitutional Court's action was annulled by the Constitutional Court because it violated the formal procedure for amending the Aceh Governance Law. The research method was carried out normatively with two problem formulations, why did the House of Representative revoke two articles of the Aceh Governance Law related to election management institutions in Aceh without complying with and even violating the procedures regulated by the Aceh Governance Law as a special law? Why did the Constitutional Court annulled the revocation of the two articles and consider them unconstitutional? The result showed that the revocation of the two articles was carried out by the House of Representative for several reasons, namely removing the dualism of the election supervisory agency in Aceh and tidying up the structure of the election management body in Indonesia to comply with the provisions of Article 22E paragraph (5) of the Constitution of the Republic of Indonesia. In 1945 and strengthening election administration institutions in the face of simultaneous elections in 2019. Meanwhile, the steps were taken by the Constitutional Court to cancel the revocation of the two articles and judge them as unconstitutional because the House of Representative did not conduct consultations and asked the Aceh People's Representative Council for consideration in the revocation process.Keywords: Aceh Election Commission; Election Supervisory Committee; Aceh Governance Law; Election Law.Abstrak: Artikel ini bertujuan menelusuri langkah DPR yang mencabut dua pasal dalam Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh (UUPA), yakni Pasal 57 dan Pasal 60 ayat (1), (2) dan (4), yang berhubungan dengan lembaga penyelenggara pemilu di Aceh melalui Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Belakangan, pencabutan itu dibatalkan oleh Mahkamah Konstitusi karena dinilai inkonstitusional. Metode penelitian dilakukan secara normatif dengan dua rumusan masalah, mengapa DPR mencabut dua pasal UUPA terkait lembaga penyelenggara pemilu di Aceh tanpa mematuhi tata cara yang telah diatur oleh UUPA sebagai undang-undang khusus? Mengapa Mahkamah Konstitusi membatalkan pencabutan kedua pasal tersebut dan menilainya sebagai tindakan inkonstitusional? Of the total funding needs for strategic infrastructure from year 2019 to 2024, it is projected that the country is only able to provide less than half. Hence, Indonesia needs to seek another source to finance its infrastructure. This research aims to review and provide input to the government on the construction of state-owned infrastructure financing policies to realize national economic resilience. Through legal construction methods using a statutory approach, a conceptual approach, and a multidisciplinary approach. The results of this study show that the right state-owned infrastructure financing model to realize national economic resilience is with the Non-APBN scheme, which is a cooperation between the government and all stakeholders. The infrastructure development is supported by the VfM (Value for Money) method, with a new financing scheme in the form of participation of the entire community through the issuance of securities by the sharia-based government.
