Unfortunately, fiscal pressures obliged the government to deviate from its Canada First Defence Strategy, cutting staff and delaying military hardware acquisitions. However, the introduction this year of the Defence Procurement Strategy should allow Ottawa to use improved approaches to buy equipment that would otherwise have been purchased already under the DND’s opaque capital expenditure system. At present, DND capital funds are mostly subject to accrual accounting. Capital costs are charged against the defence budget as annual amortization expenses over equipment lifecycles. While this enables multiple capital projects to go ahead simultaneously, not all of the money covering capital costs is treated this way. Traditional A-Base Vote 5 expenses are still charged to the budget the year the expenditure is made — and the DND consistently underspends the Vote 5 funds available by as much as 28 percent. Since 2007/8, an estimated $6.42 billion wasn’t used as intended. While some of this can be carried forward, there are limits. Leftover funds exceeding them are returned to the Treasury and are thereby lost. It’s up to the DND to make up losses out of future funding. Just as bad, the accrual method doesn’t fully account for inflation, so when schedules slip, project purchasing power diminishes by hundreds of millions of dollars. Ambitious initiatives like the Joint Support Ship and (likely) the Canadian Surface Combatant end up taking hits to reflect harsh budgetary realities; the capabilities of Canada’s soldiers suffer. We believe procurement contracts (traditional procurement), public service delegations (including concessions) and public private partnerships, currently represents today significant amounts of money as it is believed to account for nearly 15% of the GDP in France. Whilst the public pro- curement system must strive to achieve the best possible performance in terms of cost and service, its inefficiency is highlighted on a regular basis. In (actual) fact, subs- tantial gains could be achieved through a more efficient management of the system. The present Note examines potential avenues of action, in the framework of the regulatory changes currently under way at European level, with the aim of increasing the efficiency of the public procure- ment system.<br><br>The contracts upon which the public procurement system is based are subject to certain asymmetries of information (in that the company is more familiar with its costs and the economic environment than the public party) and contrac- tual incompleteness (since it is impossible to foresee every possible event that might arise during the execution of the contract). This being the case, the economic analy- sis recommends that competitive forces be used where- ver possible when it comes to selecting partners and that incentive mechanisms be put in place to establish a real commitment of the parties concerned.<br><br>New European Directives regarding procurement contracts and concessions, approved in 2014 and expected to be transposed by 2016, will give public authorities greater flexibility to negotiate with companies at both the selection this change to be a positive and economically justified one. It is, however, crucial that it be supported by specific terms governing its management that are not currently outlined in the Directives. Our recommendations are based on three key avenues, namely transparency, competition and expertise.<br><br>The negotiation procedure must be supported by transpa- rent information both prior to and following negotiation. During the execution stage, it must be possible for amend- ments to contracts to be contested without debilitating the process by facilitating an increase in the number of futile appeals. We also put forward a number of recom- mendations designed to encourage greater transparency where public procurement is concerned.<br><br>For the purposes of intensifying competition at the tendering stage it would be useful to limit the number of elec- tronic information platforms and to merge them towards a high-performance standardised model. One of the main motives for the support of PCP schemes was to use public needs as a driver for innovation. This concept was also introduced as a response to the need to reinforce the innovation capabilities of the European Union while improving the quality and efficiency of public services. But what is meant by PCP? Is it a demand‐ or a supply‐side instrument in relation to innovation? This is the research question addressed in this paper, the goal being motivated by the lack of academic discussion in this direction. The paper is based on three cases, one from the Netherlands, one from the United Kingdom and one from Australia. These cases provide evidence that PCP is a matter of research and development (R&D) funding of a targeted kind, geared toward very specific goals and in a focused way. This leads the authors to conclude that PCP is a supply‐side policy instrument in relation to innovation. It is preliminary in that the study draws on a limited range of data and does not benefit from a sufficient passage of time to evaluate the Government of Canada’s practice in applying the measures or the behavioral responses of firms or Canada’s trading partners. Based on first principles analysis, the option of debarment imposes a cost not only on the firms that are debarred, but also on many innocent parties, including society at large. The costs are greater the less substitutable the products of the debarred firm are for their competitors’ products. The reshuffling of markets triggered by debarment would generate additional “dead weight” costs equivalent to red tape (the nuisance administrative expenditures associated with re-contracting). It estimates the valuation of bidders in Highway Authority auctions in India using the non linear parametic methods by Athey, Levin and Seira. It finds that the auctions are dominated by the larger national level firms and that they are able to secure the contracts at a price much smaller than their valuations.
