This step sets the course, establishes goals, and defines the parameters for the subsequent spatial arrangement planning. Currently, the expedited development of Detailed Spatial Planning in Indonesia is closely tied to the function and role of an area, which is influenced by numerous factors that require careful consideration. This study aims to compare population projections using conventional projection methods with projections that take into account the functions and roles of the region. This study uses population projection analysis, population development scenarios, and spatial availability analysis to assess the differences in spatial projections that can accommodate population growth. The calculations unveiled a significant disparity between population-based projections and projections that consider the functions and roles of a city/area. This input is crucial for assessing spatial needs and the necessary infrastructure and supporting facilities that will be incorporated in the formulation of the structure and spatial patterns of Detailed Spatial Planning. Starting in 2017, it is expected that by the end of 2024, all land parcels will be registered, and a reliable land information system will be established for public services. One of the key components in realizing a reliable land information system is the development of a valid and reliable cadastral map. This study aims to assess the validity and reliability of the cadastral maps created under the PTSL program in Kalisari village and Tlogopandogan village of Demak Regency. The research method employed in this study is a descriptive method based on a quantitative approach. The study is conducted in two PTSL villages, namely Kalisari and Tlogopandogan. PTSL implementation in Kalisari started in 2018, before the issuance of the Complete Systematic Land Registration regulation for the Regency/City in 2019. On the other hand, PTSL implementation in Tlogopandogan commenced in 2020. The validity of cadastral map content was analyzed using Pearson's correlation technique. The reliability of the map was tested using the Cronbach's alpha technique. In general, the findings revealed that the level of validity and reliability of the cadastral map in Kalisari village was assessed as low or less reliable, while the cadastral map in Tlogopandogan village received a high rating in terms of validity and reliability. This study draws on three disasters that occurred in Indonesia as case studies: the tsunami in Aceh in 2004, the Sidoarjo mudflow in 2006, and the tidal flood and permanent inundation in Kabupaten Demak, reported in 1997. Using literature review approach, we compare the government responses in these examples and evaluate how they affected tenure security in each case, and presented it qualitatively. We discovered that there were different responses in terms of the declaration of a national disaster, Central Government support, the presence of a responsible agency, and how the government threatened it as a 'pure natural disaster' or a 'human-induced disaster.' We conclude that the Central Government plays an important role in ensuring tenure security during a disaster in terms of supporting laws and regulations, but the Local Government is also critical in the implementation process in land right reconstruction. However, this recognition is counterproductive because it further distances adat communities from their rights, especially tenure rights based on adat law. The diverse and minimal understanding of adat law by executives and law enforcement officials compound this condition. Sometimes, adat communities must face the law because they are suspected of committing criminal acts violating it. Therefore, this research aimed to examine the recognition of adat communities’ tenure rights in the courtroom. This research is normative legal research using a case approach—four court decisions as the primary data. The results of this study indicated that in deciding cases, there are times when judges recognize how adat communities control and utilize natural resources according to their adat law. However, there are times when judges override the narrative of adat law that adat communities claim. This study examined the impact of land access on total farmer's household expenditure. The Agrarian reform policy assumed open and expand access to land for groups of landless or near landless farmer households. Through state-led and market-led approaches, this research provided a categorization of access to land in two ways, which are access opening and access expansion variables with each sample coverage. Using the two periods difference-in-difference (DID) method, this study analyzed the impact of opening and expanding access to the total expenditure of farmer households using IFLS 2007 and 2014 data. The results showed that there is a significant difference in the total expenditures of farmer households due to the opening and expansion of access referring to the land distribution scheme (state-led approach), and there is no significant difference through the market-led approach. Hence, to fulfill non-food needs, agricultural food land is converted into non-agricultural. It affected the carrying capacity of food agriculture. This paper aimed to analyze changes in the carrying capacity of food agriculture and the factors that influence the carrying capacity of food agriculture in the Kulon Progo Regency. This study used a descriptive-quantitative approach with spatial-temporal analysis techniques on secondary data, including population, rice field area, and rice field productivity for 2011, 2015, and 2019. The results showed that in 2011 Kulon Progo Regency could not be self-sufficient in food. However, in 2015, the research area had a great carrying capacity for food agriculture and continues to increase. This increase was influenced by the addition of rice fields and increased productivity. On the other hand, the reduction of rice fields decreased the productivity of rice fields, and the increase in the population led to a decrease in the carrying capacity of food agriculture in the Nanggulan, Kalibawang, and Samigaluh Districts. The rice field area and the productivity of rice fields affect food availability, while the population affects food needs. This study aims to analyze the agrarian dynamics of rice farmers from a historical perspective, focusing on studying how the agrarian change affected the rice production mode in the present situation. The historiography approach used to produce critical analysis was complemented by tracing literature studies, especially in West Java, one of the main rice producers in Indonesia. The results showed that the structure of land tenure and ownership in rice farming had undergone a fundamental change. The dynamics that appear in rice can be seen at the level of agricultural technology intervention and local and national policies, which have experienced changes due to pressure from the agricultural production input sub-system. Metodologi penelitian hukum yang digunakan dalam penelitian ini yaitu pendekatan peraturan perundang-undangan dan pendekatan analisis. Hasil penelitian menunjukan bahwa Badan Bank Tanah dibentuk untuk melengkapi kelembagaan pertanahan di Indonesia, sebab selama ini Kementerian Agraria dan Tata Ruang/ Badan Pertanahan Nasional hanya berkedudukan sebagai land regulator. Padahal disisi lain negara memerlukan Badan Bank Tanah yang juga berfungsi sebagai land manager yang dapat menata dan mengelola keseluruhan aset yang dimilikinya untuk kepentingan masyarakat dengan tetap menerapkan konsep ekonomi berkeadilan dalam wujud kegiatan pendistribusian tanah. Dimana kegiatan tersebut harus bersifat proposional yang memiliki keberpihakan kepada kelompok yang lemah posisinya, baik secara ekonomi, politik dan sosial yang dalam hal ini subjek sasaran dari kegiatan tersebut lebih mengedepankan pemerataan kepada petani miskin dan petani penggarap yang tidak memiliki tanah sehingga tujuan pemerintah dalam pembangunan ekonomi yang berkelanjutan melalui Badan Bank Tanah dapat tercapai. \u0000Kata Kunci : Dikotomi, Bank Tanah, Sui Generis. \u0000ABSTRACT \u0000This study aims to determine the position, duties and functions of the Land Banking Agency as a special agency (sui generis) that manages land where its wealth is separated from state assets which has the function of carrying out planning, acquisition, procurement, management, utilization and distribution of land. The legal research methodology used in this research is the statutory regulation approach and the analytical approach. The results showed that the Land Banking Agency was formed to complement land institutions in Indonesia, because so far the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency only served as a land regulator. Whereas on the other side, the state needs a Land Banking Agency which also functions as a land manager who can organize and manage all of its assets for the benefit of the community while still applying the concept of an equitable economy as in the land distribution activities. Kabupaten Bantul sebagai salah satu daerah yang melaksanakan kegiatan PTSL memiliki problematika permasalahan yang unik dibandingkan daerah lainnya. Permasalahan tersebut adalah adanya tumpang tindih bidang lahan antara masyarakat dengan Kasultanan Yogyakarta. Permasalahan tersebut timbul karena adanya pluralisme hukum pertanahan di Daerah Istimewa Yogyakarta (DIY). Tulisan ini bertujuan untuk mengetahui pola penyelesaian terbaik dari permasalahan tumpang tindih bidang lahan antara masyarakat dengan Kasultanan Yogyakarta. Tulisan ini menggunakan metode penelitian normatif-empiris dengan pendekatan perundang-undangan, historis, dan sosiologis. Kesimpulan dari tulisan ini adalah terdapat alternatif-alternatif pola penyelesaian berkaitan dengan permasalahan tumpang tindih bidang lahan antara masyarakat dengan Kasultanan Yogyakarta. Pertama, terhadap bidang tanah dimana masyarakat dapat membuktikan secara kuat kepemilikan bidang tanah tersebut, pelaksanaan PTSL dapat dilanjutkan kepada masyarakat. Kedua, terhadap bidang tanah dimana masyarakat tidak dapat membuktikan kepemilikan bidang tanah tersebut, bidang tanah tersebut menjadi milik Kasultanan dan didaftarkan menjadi sultan ground. Ketiga, masyarakat masih dapat melakukan pengelolaan dan pemanfaatan tanah yang telah didaftarkan menjadi sultan ground dengan melakukan permohononan pengelolaan dan pemanfaatan sultan ground (serat kekancingan). kata kunci: pendaftaran tanah, sultan ground, hukum agraria\u0000ABSTRACTThe Implementation of Complete Systematic Land Registration (PTSL) was initiated by the government to accelerate land registration in order to realize the target of 126 (one hundred and twenty six) million certified lands in Indonesia. Compared to other regions that implement PTSL, Bantul Regency has a unique problem. The problem is the overlapping of land parcels between the Bantul Regency’s residents and the Yogyakarta Sultanate. This problem arises because of the pluralism of land law in the Special Region of Yogyakarta (DIY). This paper aims to find out the best pattern for solving the problem of overlapping land parcels between the residents and the Yogyakarta Sultanate. This paper uses a normative-empirical research method with a statutory, historical, and sociological approach. The conclusion of this paper is that there are alternative settlement patterns to cope with this problem. First, for parcels of land where the resident can strongly prove ownership of the land parcels, the implementation of PTSL can be continued to the resident. Second, for plots of land where the resident cannot prove ownership of the plots of land, the land parcels become the property of the Sultanate and then registered as sultan grounds. Pengaturan ini diejawantahkan pula dalam ikhwal pembangunan infrastruktur untuk kepentingan umum di Ibu Kota Nusantara (IKN) melalui Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara (UU3 /2022). Permasalahan hukum kemudian timbul ketika frasa kepentingan umum yang diatur di dalamnya tidak dijabarkan secara komprehensif dan berimplikasi pada tidak terunifikasinya penafsiran hukum pertanahan dalam pelaksanaannya. Penelitian ini bertujuan untuk memberikan gambaran dan usulan langkah penjaminan kepastian hukum atas frasa kepentingan umum dalam tahapan perolehan tanah di IKN. Metode yang digunakan dalam penelitian ini adalah metode penelitian normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Penelitian ini pada dasarnya menghasilkan dua kesimpulan yakni (1) pengaturan norma hukum dari frasa kepentingan umum dalam tahapan perolehan tanah oleh Otorita IKN yang mengacu pada ketentuan di luar UU 3/2022 memiliki kecenderungan subjektif (2) diperlukan langkah teknis dan langkah substantif untuk memberikan jaminan kepastian hukum atas frasa kepentingan umum dalam tahapan perolehan tanah oleh Otorita IKN.\u0000ABSTRACT\u0000One of the goals of the state contained in the fourth paragraph of the Preamble to the 1945 Constitution of the Republic of Indonesia is to promote public welfare and one of them is through the act of controlling the state as referred to in Article 33 paragraph (3) of the Constitution of the Republic of Indonesia. Indonesia in 1945 which was later revealed in the land sector, namely through state control of land rights in carrying out development activities for the public interest.
