Metodologi penelitian hukum yang digunakan dalam penelitian ini yaitu pendekatan peraturan perundang-undangan dan pendekatan analisis. Hasil penelitian menunjukan bahwa Badan Bank Tanah dibentuk untuk melengkapi kelembagaan pertanahan di Indonesia, sebab selama ini Kementerian Agraria dan Tata Ruang/ Badan Pertanahan Nasional hanya berkedudukan sebagai land regulator. Padahal disisi lain negara memerlukan Badan Bank Tanah yang juga berfungsi sebagai land manager yang dapat menata dan mengelola keseluruhan aset yang dimilikinya untuk kepentingan masyarakat dengan tetap menerapkan konsep ekonomi berkeadilan dalam wujud kegiatan pendistribusian tanah. Dimana kegiatan tersebut harus bersifat proposional yang memiliki keberpihakan kepada kelompok yang lemah posisinya, baik secara ekonomi, politik dan sosial yang dalam hal ini subjek sasaran dari kegiatan tersebut lebih mengedepankan pemerataan kepada petani miskin dan petani penggarap yang tidak memiliki tanah sehingga tujuan pemerintah dalam pembangunan ekonomi yang berkelanjutan melalui Badan Bank Tanah dapat tercapai. \u0000Kata Kunci : Dikotomi, Bank Tanah, Sui Generis. \u0000ABSTRACT \u0000This study aims to determine the position, duties and functions of the Land Banking Agency as a special agency (sui generis) that manages land where its wealth is separated from state assets which has the function of carrying out planning, acquisition, procurement, management, utilization and distribution of land. The legal research methodology used in this research is the statutory regulation approach and the analytical approach. The results showed that the Land Banking Agency was formed to complement land institutions in Indonesia, because so far the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency only served as a land regulator. Whereas on the other side, the state needs a Land Banking Agency which also functions as a land manager who can organize and manage all of its assets for the benefit of the community while still applying the concept of an equitable economy as in the land distribution activities. Kabupaten Bantul sebagai salah satu daerah yang melaksanakan kegiatan PTSL memiliki problematika permasalahan yang unik dibandingkan daerah lainnya. Permasalahan tersebut adalah adanya tumpang tindih bidang lahan antara masyarakat dengan Kasultanan Yogyakarta. Permasalahan tersebut timbul karena adanya pluralisme hukum pertanahan di Daerah Istimewa Yogyakarta (DIY). Tulisan ini bertujuan untuk mengetahui pola penyelesaian terbaik dari permasalahan tumpang tindih bidang lahan antara masyarakat dengan Kasultanan Yogyakarta. Tulisan ini menggunakan metode penelitian normatif-empiris dengan pendekatan perundang-undangan, historis, dan sosiologis. Kesimpulan dari tulisan ini adalah terdapat alternatif-alternatif pola penyelesaian berkaitan dengan permasalahan tumpang tindih bidang lahan antara masyarakat dengan Kasultanan Yogyakarta. Pertama, terhadap bidang tanah dimana masyarakat dapat membuktikan secara kuat kepemilikan bidang tanah tersebut, pelaksanaan PTSL dapat dilanjutkan kepada masyarakat. Kedua, terhadap bidang tanah dimana masyarakat tidak dapat membuktikan kepemilikan bidang tanah tersebut, bidang tanah tersebut menjadi milik Kasultanan dan didaftarkan menjadi sultan ground. Ketiga, masyarakat masih dapat melakukan pengelolaan dan pemanfaatan tanah yang telah didaftarkan menjadi sultan ground dengan melakukan permohononan pengelolaan dan pemanfaatan sultan ground (serat kekancingan). kata kunci: pendaftaran tanah, sultan ground, hukum agraria\u0000ABSTRACTThe Implementation of Complete Systematic Land Registration (PTSL) was initiated by the government to accelerate land registration in order to realize the target of 126 (one hundred and twenty six) million certified lands in Indonesia. Compared to other regions that implement PTSL, Bantul Regency has a unique problem. The problem is the overlapping of land parcels between the Bantul Regency’s residents and the Yogyakarta Sultanate. This problem arises because of the pluralism of land law in the Special Region of Yogyakarta (DIY). This paper aims to find out the best pattern for solving the problem of overlapping land parcels between the residents and the Yogyakarta Sultanate. This paper uses a normative-empirical research method with a statutory, historical, and sociological approach. The conclusion of this paper is that there are alternative settlement patterns to cope with this problem. First, for parcels of land where the resident can strongly prove ownership of the land parcels, the implementation of PTSL can be continued to the resident. Sistem tinggi yang mempunyai georeferensi pada sistem koordinat horizontal dan vertikal tertentu dapat menentukan lokasi properti dan hubungan geometrik model kadaster 3D. Salah satu solusi alternatif penentuan sistem koordinat vertikal adalah menggunakan tinggi ortometrik yang diikatkan pada sistem tinggi nasional. Seiring dengan perkembangan kadaster 3D dalam beberapa dekade terakhir, berkembang juga teknologi termasuk akuisisi data kadaster 3D, validasi data, dan visualisasi data untuk memenuhi kebutuhan dasar kadaster 3D. Pengukuran objek kadaster 3D secara teliti, baik secara horizontal dan vertikal didukung oleh teknologi pengukuran yang berkembang sangat pesat, seperti GNSS CORS dan laser scanner. Tujuan penyusunan makalah ini adalah menyediakan data kadaster 3D dalam membangun sistem kadaster digital, validasi, dan pemodelan kadaster 3D. Kadaster 3D direpresentasikan menggunakan sistem tinggi ortometrik yang dihasilkan oleh teknologi GNSS CORS dalam tinggi elipsoid. Objek kadaster penelitian adalah Rusunawa Gemawang 2 dan Apartemen Student Park yang mewakili objek rumah susun. Proses georeferensi Rusunawa Gemawang 2 menghasilkan RMSE georeferensi minimum 0,008 m dan maksimum 0,017 m, sementara Apartement Student Park menghasilkan RMSE minimum 0,007 m dan maksimum 0,020 m. Model kadaster 3D divisualisasikan dalam bentuk ruang di tiap-tiap level dan memberikan gambaran geometrik 3D. Konversi tinggi dari tinggi elipsoid menjadi ortometrik  merupakan salah satu tantangan dalam representasi kadaster 3D di Indonesia. \u0000ABSTRACT \u0000 The representation of the 3D cadastral system requires a technical framework in terms of positional precision and technical requirements. Height systems that have georeference in certain horizontal and vertical coordinate systems can determine the location of properties and geometric relationships cadastre model. One alternative solution for determining the vertical coordinate system is to use an orthometric height tied to the national height system. Along with the development of the 3D cadastre in the last few decades, technology has also evolved including 3D cadastral data acquisition, data validation, and data visualization to meet the basic needs of the 3D cadastre. The meticulous measurement of 3D cadastral objects, both horizontally and vertically, is supported by rapidly developing measurement technologies, such as GNSS CORS and laser scanners. The purpose of this paper is to provide 3D cadastral data in building a digital cadastral system, validation, and 3D cadastral modeling. The 3D cadastre is represented using the orthometric height system generated by GNSS CORS technology using the elipsoid height. Pengaturan ini diejawantahkan pula dalam ikhwal pembangunan infrastruktur untuk kepentingan umum di Ibu Kota Nusantara (IKN) melalui Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara (UU3 /2022). Permasalahan hukum kemudian timbul ketika frasa kepentingan umum yang diatur di dalamnya tidak dijabarkan secara komprehensif dan berimplikasi pada tidak terunifikasinya penafsiran hukum pertanahan dalam pelaksanaannya. Penelitian ini bertujuan untuk memberikan gambaran dan usulan langkah penjaminan kepastian hukum atas frasa kepentingan umum dalam tahapan perolehan tanah di IKN. Metode yang digunakan dalam penelitian ini adalah metode penelitian normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Penelitian ini pada dasarnya menghasilkan dua kesimpulan yakni (1) pengaturan norma hukum dari frasa kepentingan umum dalam tahapan perolehan tanah oleh Otorita IKN yang mengacu pada ketentuan di luar UU 3/2022 memiliki kecenderungan subjektif (2) diperlukan langkah teknis dan langkah substantif untuk memberikan jaminan kepastian hukum atas frasa kepentingan umum dalam tahapan perolehan tanah oleh Otorita IKN.\u0000ABSTRACT\u0000One of the goals of the state contained in the fourth paragraph of the Preamble to the 1945 Constitution of the Republic of Indonesia is to promote public welfare and one of them is through the act of controlling the state as referred to in Article 33 paragraph (3) of the Constitution of the Republic of Indonesia. Indonesia in 1945 which was later revealed in the land sector, namely through state control of land rights in carrying out development activities for the public interest. This is also applied in the construction of various infrastructures for the public interest in the Nusantara Capital City Authority (IKN). Oleh karena itu, negara bertanggung jawab untuk menyediakan kemudahan perolehan rumah bagi masyarakat melalui penyelenggaraan perumahan dan kawasan permukiman, baik itu rumah tapak maupun rumah susun. Tidak hanya untuk Warga Negara Indonesia (“WNI”), Pemerintah juga harus menjamin aspek keamanan dan kenyamanan orang asing yang berkedudukan di Indonesia, salah satunya pada aspek properti sebagai hunian bagi orang asing. Untuk maksud di atas, Pemerintah perlu dan penting memerhatikan aspek lainnya, yakni asas, norma dan ketentuan yang membatasi atau bahkan mendasari aspek kepemilikan properti di Indonesia. Dalam karya ilmiah ini, yang hendak Penulis capai adalah apakah pelonggaran kepemilikan properti bagi orang asing di Indonesia telah mengganggu keseimbangan kepentingan antara pemangku kepentingan yang ada, yakni orang asing sebagai target yang dituju maupun dengan WNI itu sendiri. Pelonggaran kepemilikan properti bagi orang asing di Indonesia, menurut hemat Penulis, menimbulkan pro dan kontra bukan hanya dari praktisi dan akademisi, tetapi juga oleh pejabat instansi yang berwenang memberikan hak dimaksud. Oleh karena itu, karya ilmiah ini menggunakan metode yuridis normatif dengan mengambil suatu kesimpulan khusus dari suatu keadaan tertentu (deduksi), untuk mengetahui dengan terang mengenai masalah yang dihadapi oleh pengembang dalam melaksanakan usaha penyediaan perumahan dan kawasan permukiman bagi masyarakat. \u0000Kata Kunci: properti, tempat tinggal, orang asing \u0000  \u0000ABSTRACT \u0000The implementation of housing and settlement areas is one of the obligations of the state to ensure the provision of adequate residence for the community, as well as the provision of a healthy, safe, harmonious and sustainable environment. The priorities among the SWOT components were carefully evaluated using a quantitative AHP-based SWOT analysis. SWOT aspects are used in this study, and a pairwise comparison technique and Focus Group Discussion (FGD). This study uses SWOT elements and Focus Group Discussion (FGD) pairwise comparison technique. The results of the comparison matrix show that the internal factor with the highest strength score is that agrarian reform can provide solutions to land problems, and the weakness is the absence or lack of assistance regarding agrarian reform activities. \u0000In contrast, the external factors with the highest opportunities and threats are the budget allocation for agrarian reform activities and the lack of public enthusiasm for implementing agrarian reform. So, that to overcome this, several strategies are carried out, namely conducting pre-surveys related to potential locations that are used as objects with approaches and counseling to the community to create public understanding of agrarian reform. In addition, carry out long-term planning and analyze potential data and problems faced during the program. \u0000Keywords: Agrarian Reform, Strategy, A’WOT (AHP and SWOT) \u0000  \u0000ABSTRAK \u0000Memahami tujuan reforma agraria dalam mensukseskan kegiatan reforma agraria dan strategi pelaksanaan reforma agraria sehingga tercipta kesepahaman antara Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional dan stakeholders terkait dengan masyarakat yang akan menjadi objek reforma agrarian adalah tujuan dari penelitian ini. Analisis SWOT berbasis AHP kuantitatif digunakan dalam penelitian ini untuk mengevaluasi secara sistematis prioritas di antara komponen-komponen SWOT. Penelitian ini menggunakan metode Teknik perbandingan berpasangan dari elemen SWOT dan Focus Group Discussion (FGD). Hasil matriks perbandingan menunjukkan bahwa pada faktor internal dengan skor kekuatan tertinggi adalah reforma agraria mampu memberikan solusi permasalahan pertanahan dan kelemahannya adalah belum adanya atau minimnya pendampingan mengenai kegiatan reforma agraria. Sedangkan pada faktor eksternal pada peluang dan ancaman yang paling tinggi adalah adanya alokasi anggaran untuk kegiatan reforma agraria dan kurangnya antusiasme masyarakat dalam melaksanakan reforma agrarian sehingga untuk mengatasinya dengan beberapa strategi yaitu melakukan pra survei terkait potensi lokasi yang dijadikan objek dengan pendekatan dan penyuluhan kepada masyarakat sehingga tercipta pemahaman masyarakat mengenai reforma agraria. Penyediaan ruang untuk pembangunan infrastruktur dilakukan melalui kegiatan konsolidasi tanah. Kegiatan konsolidasi tanah tidak lepas dari proses penilaian tanah pada objek konsolidasi tanah, sehingga informasi nilai tanah menjadi faktor penting yang harus diketahui sebelum pelaksanaan konsolidasi tanah. Ketersediaan informasi nilai tanah yang pada umumnya berbasis zona memiliki berbagai kekurangan dan tidak cocok digunakan dalam terminologi konsolidasi tanah. Oleh karena itu, diperlukan pembuatan model prediksi nilai tanah berbasis bidang di area potensi konsolidasi tanah. Pembuatan model prediksi nilai tanah berbasis bidang dilakukan menggunakan metode penilaian massal dengan pendekatan harga pasar untuk menentukan nilai tanah pada titik sample penilaian, metode network analysist untuk mencari jarak terdekat fasilitas umum ke lokasi bidang tanah, dan geographically weighted regression (GWR) untuk melakukan prediksi nilai di setiap bidang tanah. Data utama yang digunakan dalam penelitian ini berasal dari kegiatan survei nilai tanah di Kota Bontang Tahun 2021 dan Rencana Tata Ruang Wilayah Kota Bontang Tahun 2019. Hasil pemodelan nilai tanah berbasis bidang menunjukkan bahwa pembuatan informasi nilai tanah berbasis bidang mampu menjawab kelemahan yang sering ditemukan pada informasi nilai tanah berbasis zona. Berdasarkan hasil permodelan, rata-rata koefisien determinasi (R2) sebesar 0,73 (mendekati nilai akurat). Berdasarkan model tersebut sumbangan tanah untuk pembangunan (STUP) paling ideal adalah sebesar 48 m2 atau iuran sebesar 48 dikalikan dengan nilai tanah pada masing-masing bidang.Kata kunci : konsolidasi tanah, nilai tanah berbasis bidang, geographically weighted regression (GWR).\u0000ABSTRACTThe construction of drainage network infrastructure is a solution for flood disasters that often occur in Bontang City. Provision of space for infrastructure development is carried out through land consolidation activities. Land consolidation activities cannot be separated from the land appraisal process on the land consolidation object, so that land value information is an important factor that must be known before the implementation of land consolidation. Availability of land value information which is generally based on zone, has various shortcomings and is not suitable for use in land consolidation terminology. Therefore, it is necessary to make a prediction model of land value based on parcel in the potential area of land consolidation. The land value based on parcel prediction model is made using the mass valuation method with a market price approach to determine land value at the sample point, the network analysis method to find the closest distance of public facilities to the parcel location and geographically weighted regression (GWR) to predict land value in each land parcel. Tujuan dari kajian ini adalah untuk menelaah bentuk penyediaan tanah dari Bank Tanah untuk penyelenggaraan Reforma Agraria dan untuk menjelaskan konsep pengelolaan tanah oleh Bank Tanah yang akan didistribusikan untuk Reforma Agraria. Metode penelitian yang digunakan dalam kajian kebijakan ini adalah metode kualitatif deskriptif. Data yang dikumpulkan berupa data kualitatif berupa peraturan terkait tentang Badan Bank Tanah yang dikaitkan dengan berbagai peraturan yang melatarbelakangi lahirnya tanah negara. Selanjutnya data tersebut dianalisis secara empiris berdasarkan ketentuan yang berlaku dan hasilnya dalam bentuk deskripsi. Hasil kajian kebijakan adalah tanah negara dapat diperoleh untuk aset Bank Tanah melalui penetapan pemerintah. Pendistribusian aset tanah untuk Reforma Agraria dapat dilakukan secara langsung untuk program redistribusi tanah berdasarkan kriteria dari Badan Pelaksana.  Perolehan tanah negara yang diatasnya telah ada penguasaan masyarakat tidak perlu diadakan akuisisi (perolehan tanah) sehingga dapat langsung digunakan untuk Reforma Agraria. Pengelolaan aset tanah oleh Bank Tanah dilakukan dalam rangka menyiapkan tanah atau memberikan nilai tambah atas tanah yang akan didistribusikan atau dimanfaatkan melalui mekanisme kerjasama dengan pihak lain. Tanah yang dikelola kemudian didistribusikan untuk Reforma Agraria dalam format kerjasama. Aset tanah yang akan didistribusikan tersebut tidak boleh dimanfaatkan oleh pihak lain dengan memberikan hak di atas tanah hak pengelolaan serta tidak boleh dalam jangka waktu lama. Keputusan MK  Nomor 91/PUU-XVIII/2020 menyatakan bahwa UU Cipta Kerja inkonstitusional bersyarat. They claimed back the access to the customary land of Nangahale which, before the colonial era, was the residence of their ancestors. They put up a certain amount of resistance against the plantation company which, nota bene, is owned by the Catholic church, the Diocese of Maumere. This study elaborates the strategy of resistance of the Soge local residents. The methods used were participant observation and semi-structured interviews conducted from August to October 2021. The data collected were in the form of conversations and observation on the daily activities of the local residents as well as reviews on historical literature in newspapers, books, magazines, journals, and the internet. The conversation and observation data were analyzed according to the context that occurred in the field in order to reveal the forms of resistance. This study was conducted using a qualitative approach with a from the theoretical perspective of grassroots innova­tion. The primary data were obtained from observation during one-month field study and in-depth interviews with a number of key informants, such as village heads, traditional stakeholders, farmers, representatives of women's groups, and youth involved in the grassroots innovation process. The results showed that the growth of grassroots innovation in natural resource management in Warung­banten Village cannot be separated from three main factors, namely innovator aspect attached to the role of the village head as the initiator; socio-cultural and environmental aspect that allows the spirit of mu­tual cooperation and involvement of the parties; and market or benefit aspect attached to commercial and non-commercial values of the innovation carried out.
