CLP","authors":"Baud Heru Setyo","doi":"10.20884/1.jih.2019.5.1.102","DOIUrl":"https://doi.org/10.20884/1.jih.2019.5.1.102","url":null,"abstract":"Referring to Law no. 16 of 2004 which replaces Law no. 5 of 1991 on the Prosecutor's Office R.I., the Attorney as one of the law enforcement agencies are required to play a more role in upholding the rule of law, protection of public interest, human rights enforcement, and eradication of Corruption, Collusion and Nepotism (KKN). In the new Law of the Prosecutor's Office, the Public Prosecution Service as a state institution exercising state power in the prosecution field must perform its functions, duties and authority independently, irrespective of the influence of the power of government and the influence of other powers (Article 2 paragraph 2 of Law No. 16 Year 2004). In carrying out its duties and authority, the AGO is led by the Attorney General who oversees six Junior Attorneys and 31 High Chief Prosecutors in each province. UU no. Law No. 16 of 2004 on the Attorney of the Republic of Indonesia also suggests that the AGO is in a central position with a strategic role in strengthening the nation's resilience. Because the AGO is in the axis and a filter between the investigation process and the examination process in the court as well as the executor of court decisions and decisions. Thus, the Prosecutor's Office is the controller of the case proceedings (Dominus Litis), since only the Attorney-General's office can determine whether a case may be brought to the Court or not based on valid evidence according to the Criminal Procedure Code. The Cilacap District Attorney Obstacles faced in seeking diversion for child criminal cases with the first obstacle is that most of the criminal acts committed by the threat are more than 7 years imprisonment so that they can not be diversi- fied in accordance with Law Number 11 Year 2012 on Child Criminal Justice System, the second obstacle is the Cilacap State Attorney has 15 (fifteen) prosecutors and only 2 (two) prosecutors have the Decree from the Attorney General and have attended the training as a condition to be prescribed as the Child Procurator and have the right hear the children's case. Of course, with the number of 2 (two) public prosecutors is very less considering the high number of children's case volume in Cilacap District Court, so that prosecutors who do not have a decree are appointed to hear cases of children, the community's assessment that there is no firmness in law enforcement when resolved through diversion. Its function and role to guard and secure national strategic projects. This research is aimed at knowing and analyzing the effectiveness of the role of the Government Guards and Safeguards and Regional Development (TP4D) in preventing corruption in the Cilacap Regency. In addition, it is also to find out and analyze the constraints of the Government Guard and Regional Development Guards and Team (TP4D) in preventing corruption in Cilacap Regency. The study used a sociological juridical approach, with secondary data sources and quantitative analysis. The results showed that, the role of the Government Guards and Regional Development Guards in preventing corruption in Cilacap Regency could be said to be quite effective, namely the Government Guards and Regional Safeguards and TP4D passively guarding, securing and supporting the success of the administration and development, namely Government Guards and Safeguards and Regional Development (TP4D) only when requested. Not all aspects of regional development are escorted by the Cilacap District Attorney and Regional Development Guards and Safety Team (TP4D), because there are other supervisory organizations such as user accounts, APIP and the internal organization of regional government. The Cilacap District Attorney Office basically acts as an effort to prevent corruption, so the Attorney General's Office will take firm action even proposing that it be stopped in the cultivator through a mechanism that is determined, if there is a procedural error we will take further action, because this is public money, and must be carried out correctly. The Cilacap District Attorney's Office escorted the Cilacap Regional Hospital renovation building construction project to the end and decreased corruption corruption cases in Cilacap Regency. This is because midwives have obligations as stipulated in the Regulation of the Minister of Health No. 28 of 2017 on Article 28, namely that midwives have the obligation to systematically record documentation. Registration of midwifery care must be recorded in accordance with midwifery service standards in accordance with Kepmenkes No. 369 of 2007 concerning Midwife Professional Standards. Therefore, this study examines the implementation of midwifery care documentation on BPM and patient legal protection at BPM in Cilacap Regency. This research uses sociological juridical approach, with analytic descriptive type, and using primary data through interview and docuent study with Head of Health Service and Community Resource of Cilacap District Health Office, Head of IBI Branch of Cilacap District, each Head of Branch of Cilacap District, Practice of Midwife in Cilacap District. The results showed that the implementation of documentation on BPM was not in accordance with the Decree of the Ministry of Health 369 of 2007 because there were still midwives using the narrative model recording technique to record everything that was examined by the midwife without mentioning the patient's progress notes. Constraints to the implementation of midwifery care documentation on patient legal protection at BPM in Cilacap Regency are documentation of non-systematic documentation due to lack of awareness of midwives in carrying out systematic documentation, and monev conducted not periodically only when SIPB is extended. The problem occurs because the doctor IGD in conditions like this should serve patients in the shortest – in short with the doctor in the service of the response time of the IGD is less than 5 (five) minutes, in order to save lives and more disability prevention further, while the doctor IGD that is in the RS are currently limited in number. The purpose of research to analyse the implementation of the responsibility of the doctor in dealing with patients at IGD hospital. This type of research is descriptive, the juridical sociological approach is the method. The primary data source as the primary data collected from the field, and secondary data as supporting data. The data obtained were analyzed using qualitative methods, with the constant comparison analysis models and techniques of analysis done with the method of Theoretical Interpretation. Aspects of the implementation of the responsibility of the doctor IGD-positive, however there are doctor IGD substitute that does not have SIP for lack of doctor IGD especially when holiday Lebaran.
