This study was based on the speculative hypothesis that existing partnerships frequently harm sugarcane farmers. The goal of this study is to examine a type of partnership that occurs in sugar cane farming in Indonesia using a new method based on sharia economic law known as the mukharabah bil mudharabah contract. The research method employed in this study is normative-juridical, including statutory and conceptual methods. This research yielded findings in the form of a new concept that depicts the characteristics of sugarcane farmer partnerships based on the mukharabah bil mudharabah contract and provides policy input for the government regarding sugarcane farmer partnerships with financing institutions based on the mukharabah bil mudharabah contract. In relation to this, the researchers proposed the concept of a \"mukharabah bil mudharabah\" contract to replace the partnership concept that has been implemented thus far in the hope that it will not be detrimental to sugarcane farmers. \u0000Adanya ketidakseimbangan pada kerja sama kemitraan di antara pabrik gula dan petani tebu yang dilakukan dengan sistem sewa lahan pertanian mempengaruhi produktivitas gula nasional. Penelitian ini dilakukan dengan dasar hipotesa sementara bahwa kemitraan yang ada saat ini sering kali merugikan petani tebu. Objek penelitian ini adalah bentuk kemitraan yang terjadi pada pertanian tebu di Indonesia dengan metode baru berdasarkan konsep hukum ekonomi syariah yang dikenal dengan nama akad mukharabah bil mudharabah. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Penelitian ini menghasilkan temuan berupa konsep baru yang menunjukkan karakteristik mengenai kemitraan petani tebu berdasar akad mukharabah bil mudharabah, dan masukan kebijakan bagi pemerintah terkait kemitraan petani tebu dengan lembaga pembiayaan dengan berdasar konsep akad mukharabah bil mudharabah. The study aims to examine and analyze the justifiability of the current restrictions imposed by Russia under international law and whether they align with the established criteria. According to General Comment No. 34, freedom of opinion should not be subject to limitations during an emergency, whereas freedom of expression may be restricted under specific conditions outlined in the Siracusa principles. These conditions encompass the requirement for restrictions to be based on clear and accessible laws, serving legitimate purposes, and implementing measures that are proportionate to protect the relevant interests. Through normative legal research methods utilizing statutory, case, and factual analysis, along with a conceptual/analytical approach, this paper concludes that freedom of opinion and expression are safeguarded and their limitations are determined as outlined in the ICCPR. As a result, Russia's actions in curbing freedom of expression do not align with the principles of international law. \u0000Penulisan ini memiliki tujuan untuk mengetahui bagaimana pengaturan kebebasan berpendapat dan berekspresi berdasarkan hukum international serta bagaimana pengaturannya dalam hukum nasional Rusia di tengah perang yang terjadi antara Rusia dan Ukraina. Tulisan ini berupaya mengidentifikasi dan menganalisis ketepatan pembatasan hak berpendapat di Rusia menurut hukum internasional. General Comment Nomor 34 menyatakan bahwa kebebasan berpendapat adalah salah satu elemen, yang tidak akan pernah bisa dibatasi walau dalam keadaan darurat sekalipun. Hal ini kemudian berbeda dengan kebebasan berekspresi yang dapat di batasi apabila memenuhi secara komulatif syarat dari prinsip-prinsip siracusa, yaitu: Pertama, pembatasan wajib berdasarkan hukum yang dapat diakses dan tidak kabur. Kedua, pembatasan wajib memiliki tujuan yang sah. Ketiga, pemerintah wajib menetapkan pembatasan dimana merupakan limitasi yang serendah mungkin untuk melindungi kepentingan yang ada. Metode penelitian hukum normatif digunakan dalam penyusunan penulisan ini, dengan menggunakan pendekatan perundang-undangan, kasus, dan fakta, serta pendekatan konseptual/analitis. Tulisan ini menemukan bahwa kebebasan berpendapat dan berekspresi telah dilindungi dan ditentukan batasan-batasannya dalam ICCPR. This was normative legal research using statutory approach and conceptual approach. The study indicated that there is a conflict of norm in the authority to manage the coastal areas in Bali, which according to the Article 25 point 1 c and d of the Perda Desa Adat, it can be seen that Adat Village has the authority to manage the coastal areas, which includes Tahura Ngurah Rai, however, according to Article 1 point 10 of the Regulation of the Minister of Environment and Forestry No: P.10/Menhut-II/2009, the authority to manage the forest park is delegated to the UPTD Tahura Ngurah Rai, which was formed and is under the Bali Provincial Environment and Forestry Services as the holder of autonomous forest management rights in Bali. The issues raised in this study are about mechanisms and procedures for land management and the implementation of land management in traditional villages for the tourism industry. This research is an empirical research with an emphasis on field data as primary data. This study found that the implementation of land management in the Kerobokan Traditional Village for tourism industry activities was carried out by leasing a contract based on an agreement through the relevant Paruman Desa Adat/Banjar Adat. The Kerobokan Traditional Village also has a Perarem Pangele which regulates administrative provisions that must be met by krama tamiu (in this case including investors). The authority to manage this land is strengthened by the Regional Regulation of the Province of Bali Number 4 of 2019 concerning Traditional Villages in Article 1 number 8 which provides autonomy for Traditional Villages to manage their own households. \u0000Penelitian ini bertujuan untuk menemukan dan mengkaji terkait implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata. Permasalahan yang diangkat dalam penelitian ini adalah tentang mekanisme dan prosedur pengelolaan tanah serta implementasi pengelolaan tanah di Desa Adat untuk industri pariwisata. Penelitian ini merupakan penelitian empirik dengan menekankan pada data lapangan sebagai data primer. Penelitian ini menemukan bahwa implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata dilakukan dengan sewa kontrak berdasarkan kesepakatan melalui Paruman Desa Adat/Banjar Adat yang bersangkutan. Desa Adat Kerobokan juga memiliki Perarem Pangele yang mengatur tentang ketentuan administrasi yang harus dipenuhi oleh para krama tamiu (dalam hal ini termasuk investor). This is doctrinal legal research with legal, conceptual, and philosophical approaches. This method seeks to discuss the arrangement of Village-Owned Enterprises in Indonesia and the importance of institutional strengthening of Village-Owned Enterprises as socio-economic institutions with legal status in realizing the Sustainable Development Goals in Villages. The institutional arrangement and strengthening of Village-Owned Enterprises, apart from legal and economic aspects, also require social capital support. Rural local customs in the form of local wisdom and customary law norms that are still relevant can be social capital for the institutional strengthening of Village-Owned Enterprises. The latest behavior of social media users shows considerable virtual openness. The social media users upload screenshots of their personal chat to their social media accounts and even send them to gossip accounts in social media. In this study, there are three issues discussed namely privacy rights in personal chats uploaded on social media, potential crime of uploading personal chats, and state legal responses to the spread of personal chat screenshot on social media. The right to privacy is basically giving the freedom to publish or not publish personal chat on social media. There are at least two privacies protected in personal chat namely the sender and recipient of the message, but they are not limited to people or things discussed in the personal chat. Uploading personal chat screenshots on social media has the potential to cause doxing (theft of personal data) and cyberbullying. Countries respond to these conditions with legal provisions in their respective countries. The method used in this study is a normative juridical legal research type, with a statutory approach or statute approach to analyze legal issues. This research finds that the principle of International Trade adopted by the Indonesian state/Government is essentially aimed at protecting domestic products to maintain a healthy trade climate. International Trade is regulated by General Agreement on Tariffs and Trade, General Agreement on Trade in Services, The Agreement on Trade-Related Aspects of Intellectual Property Rights and Dispute Resolution of the World Trade Organization. Furthermore, in regards to the imposition of security measures on the import of fabric products in Indonesia, it is regulated in the Minister of Finance Regulations and its amendments. However, the Ministerial Regulation felt to be contradictory to the Minister of Trade’s Regulation. This article uses normative legal research with statute, analytical, and conceptual approaches. The results showed that the regulation of traditional drinks as intangible cultural heritage, specifically traditional knowledge, is regulated in several laws and regulations such as the Convention for the Safeguarding of the Intangible Cultural Heritage, Law No. 5 of 2017 on Advancement of Culture, Bali Regional Regulation Number 4 of 2020 on Strengthening and Promotion of Balinese Culture as well as Bali Governor Regulation Number 1 of 2020 on the Management of Balinese Fermented and/or Distilled Drink. Although IHC is for preservation, however, it can be interpreted that Law No. 5 of 2017 on Advancement of Culture is more than just preservation as it already regulates in general the commercialization of the object of cultural advancement. This study uses normative research methods with the problem of voidness in norms with statutory, conceptual, and analytical approaches. The sources of legal materials used consist of primary legal materials that come from laws and regulations related to legal issues, secondary legal materials obtained from journals, expert views and the results of previous research as well as tertiary legal materials obtained from legal dictionaries and language dictionaries which are described qualitatively. The results of the research show that the substance that can be applied to a Notary’s statement is a statement that explains the facts about events that actually happened and not as a guarantee for something. A notary statement with cover note label is a term used in practice that has been going on continuously. The cover note labeling describes the condition of the notary's statement containing the substance of protecting, guaranteeing and promising. This substance has the potential to cause legal problems for notaries and consequences for civil law liability, administrative law, and criminal law. \u0000Tujuan penulisan ini yaitu untuk mengetahui substansi yang dapat diterapkan pada surat keterangan notaris dan penyebab surat keterangan notaris yang dilabeling Cover Note menimbulkan permasalahan hukum. Penelitian ini menggunakan metode penelitian normatif dengan adanya permasalahan kekosongan norma dengan jenis pendekatan perundang-undangan, konseptual dan pendekatan analisis. Sumber bahan hukum yang digunakan terdiri dari bahan hukum primer yakni peraturan perundang-undangan yang berkaitan dengan isu hukum, bahan hukum sekunder yang didapatkan dari jurnal, pandangan ahli maupun hasil penelitian terdahulu dan bahan hukum tersier dididapatkan dari kamus hukum maupun kamus bahasa yang diuraikan secara kualitatif. Hasil penelitian menunjukkan bahwa substansi yang dapat diterapkan pada surat keterangan adalah pernyataan yang menerangkan fakta terhadap peristiwa yang benar terjadi menyangkut kewajiban dan kewenangannya, serta bukan sebagai jaminan/penanggungan terhadap sesuatu. Surat keterangan notaris yang dilabeling covernote merupakan istilah dalam praktek yang telah berlangsung terus menerus. Labeling covernote tersebut menggambarkan keadaan surat keterangan notaris mengandung substansi melindungi, menjamin dan menjanjikan. This research method uses normative legal research. The approach used is the statutory approach, the concept approach and the facts approach. The sources of legal materials in this study are primary, secondary and tertiary legal materials. The result of this research is that land consolidation arrangements in Bali must still refer to the Bali RTRWP Regional Regulation and the Regulation of the Head of the National Land Agency Number 4 of 1991 concerning Land Consolidation. In relation to the transformation of Tri Hita Karana, the regulation of land consolidation in the BPN regulation must pay attention to the philosophical values ??adopted by the community in each region. Thus, land consolidation in Bali is inspired by Tri Hita Karana. \u0000Tujuan penelitian ini adalah untuk menelusuri pelaksanaan konsolidasi tanah di Bali dan menelusuri secara mendalam tentang transformasi Tri Hita Karana dalam pelaksanaan konsolidasi tanah di Bali. Metode penelitian ini menggunakan jenis penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan konsep dan pendekatan fakta. Adapun sumber bahan hukum dalam penelitian ini adalah bahan hukum primer, sekunder dan tersier. Hasil penelitian ini adalah pelaksanaan konsolidasi tanah di Bali harus tetap mengacu pada Perda RTRWP Bali dan Peraturan Kepala Badan Pertanahan Nasional Nomor 12 Tahun 2019 tentang Konsolidasi Tanah. Terkait dengan transformasi Tri Hita Karana, maka pelaksanaan konsolidasi tanah dalam peraturan BPN tersebut wajib memperhatikan nilai falsafah yang dianut oleh masyarakat di masing-masing daerah.
