The Wonogiri Regency Government shows proud results with the ISO 9001: 2015 rating, this has an impact on the investment rates that are being applied by the region for anyone who wants to contribute to investing in Wonogiri. Pro investment policies that have been proven by the district government need to be accompanied by improved regulations that do not hamper the rate of investors investing in Wonogiri. Regulations that are more easily supported by the OSS (Online Single Submissions) system, should make it easier for businesses to try in Wonogiri. This is important in order to increase employment opportunities and Regional Original Revenues which affect development, both physical and non-physical aspects. Adequate infrastructure development can increase economic growth that can increase investors entering Wonogiri. This study uses normative juridical with the consideration that the starting point of research analysis of laws and regulations that open opportunities for mal administration. The plan, prepared by the government, will add locations for the designation of industrial estates, which in total number 14 sub-districts. Pengaturan pertanggungjawaban pidana terhadap korporasi hanya dikenal dalam peraturan perundang-undangan di luar KUHP. Namun, peraturan tersebut menimbulkan ketidakkonsistenan dalam regulasi pertanggungjawaban pidana korporasi seperti dalam Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Korupsi (UU Tipikor) )dan Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang (UU PPTPPU) yang mengakibatkan ketidakseragaman dalam pertanggungjawaban pidana terhadap korporasi. Tujuan penelitian ini untuk menganalisis dan mendeskripsikan penyebab dan dampak inkonsistensi pengaturan pertanggungjawaban pidana korporasi dalam UU Tipikor dan UU PPTPPU. Pendekatan yang digunakan untuk mengkaji permasalahan ini yaitu pendekatan perundang-undangan. Penelitian ini menunjukan adanya inkonsistensi pengaturan pertanggungjawaban pidana terhadap korporasi dalam UU Tipikor dan UU PPTPPU, karena di dalam KUHP masih tidak mengenal korporasi sebagai subjek hukum pidana sehingga dampaknya adanya disparitas putusan hakim dalam menjatuhkan putusan terhadap korporasi yang melakukan tindak pidana. The Criminal Code does not recognize corporations as a legal subject because the Criminal Code still adheres to the principle of \"university delinquent non-potest\". Criminal liability arrangements for corporations are only known in-laws and regulations outside the Criminal Code. However, these regulations cause inconsistencies in the regulation of corporate criminal liability as in Law Number 20 of 2001 concerning Corruption Eradication (Corruption Law) and Law Number 8 of 2010 concerning Prevention and Eradication of Money Laundering (PPTPPU Law) which results in non-uniformity in criminal liability towards the corporation. This study aims to analyze and describe the causes and effects of inconsistencies in the regulation of corporate criminal responsibility in the Corruption Law and the PPTPPU Law. The approach used to study this problem is the statutory approach. This study shows that there are inconsistencies in the regulation of criminal liability towards corporations in the Corruption Law and the PPTPPU Law. The character of economic crime is increasingly complex, which affects the regulation of corporate criminal responsibility, including politics and the background of the birth of laws in the economic field. BAZNAS, as the zakat management authority under the government, must implement good governance based on Islamic Sharia principles, trustworthiness, benefit, justice, legal certainty, integrated and accountability as a mandate from the zakat regulation. Sharia compliance is the main aspect in the management of zakat which consists the rules and the principles of sharia are essentially listed in the Qur’an, Hadith and developed in zakat fiqh related to principles of collecting and management of zakat, such as subject dan object of zakat, nisab and haul and the utilization and empowerment of zakat property. This study discusses the regulatory aspects of sharia compliance in the management of zakat, sharia principle in the operation of zakat, the stakeholders, indicators, reporting and auditing systems, and the benefits of implementing sharia compliance in zakat management. The research field was conducted in six ProvinceS in Indonesia (Aceh, West Nusa Tenggara, East Kalimantan Province, East Nusa Tenggara, North Sulawesi, Gorontalo). The implementation of sharia compliance in zakat institutions began to be effective in 2018 after the Decree of the Ministry of Religious Affairs Number 733 in 2018 concerning sharia audit guidelines for zakat management reports. The implementation of sharia compliance has a positive correlation with the implementation of good governance in the management of zakat institutions because it is associated with increased accountability and responsibility of zakat institutions. Tindak terorisme ini muncul, karena selain kurang tegas , adil dan bermanfaatnya materi pengaturan hukum tentang pencegahan tindak terorisme, juga disebabkan oleh kurang diberdayakannya potensi masyarakat adat dalam mencegah tindak terorisme. Hasil penelitian menunjukkan bahwa: 1) Pencegahan tindak pidana terorisme berdasarkan adat Dalihan na Tolu di Tapanuli Selatan dilakukan dengan aturan yang tercantum dalam: Filosofi adat adat Dalihan na Tolu, Sipaingot, Tutur dan Uhum dohot Patik 2) Jenis sanksi yang dikenakan kepada teroris: Sappal Dila, Dibondarkon, Dipaorot sian Marga, Dipaulak Salipi Natartar, dan Uhum Hatoban. Various criminal acts of terrorism continue to occur in Indonesia; even the numbers increase from year to year. These various acts of terrorism have arisen because, in addition to being less assertive, the legal provisions concerning the prevention of terrorist acts. Besides, the lack of involvement of indigenous peoples in preventing acts of terrorism as regulated in Article 43B paragraph (4) of Law Number 5 the Year 2018. This study aims to determine the role of Dalihan na Tolu adat in the prevention of criminal acts of terrorism. The research method used is empirical legal research methods. Prevention of criminal acts of terrorism carried out through the rules stated in philosophy , Sipaingot , Tutur , and Uhum dohot Poda . Then the traditional leaders' strategy in preventing the crime of terrorism is done by Providing examples of exemplary, Providing duties in maintaining security and order, Involving the community in every customary activity, and presenting children in customary activities. Mereka jangan dibiarkan dengan berbagai kebutuhan fisik, emosional, psikologis, spiritual dan material nya, dan apa yang disebut 'kebutuhan keadilan' ini harus diatasi jika mereka ingin merasa bahwa keadilan telah diupayakan.. Penelitian ini bertujuan untuk  memahami kembali konsep  restorative justice  atau keadilan restoratif sebagai upaya sistem peradilan pidana dalam menggapai keadilan. Penelitian ini merupakan penelitian hukum dengan menggunakan pendekatan konseptual, sejarah serta peraturan perundang-undangan. Dari penelitian ini dapat diketahui bahwa keadilan restoratifyang mengacu pada cara menanggapi kejahatan, atau jenis kesalahan lainnya, ketidakadilan atau konflik, yang berfokus terutama pada perbaikan kerusakan yang disebabkan oleh tindakan yang salah dan memulihkan sejauh mungkin, kesejahteraan semua pihak yang terlibat. Ini mencerminkan teori keadilan yang lebih relasional karena menekankan pemulihan rasa hormat, kesetaraan, dan martabat terhadap hubungan yang dipengaruhi oleh kesalahan. Understanding the concept of restorative justice as an effort of the criminal justice system in achieving justice is important. This is due to the fact that the conventional criminal justice system focuses mostly on the application of the law, evaluating errors and providing penalties. In contrast, restorative justice is an approach to crime that focuses on efforts to repair the damage done by involving those who have been affected. Understanding crime is not only a violation of the law that requires public condemnation, but also as an injury to the people involved and relationships that need healing. They should not be left with various physical, emotional, psychological, spiritual and material needs, and so-called 'justice needs' must be addressed if they want to feel that justice has been pursued. This research aims to re-understand the concept of restorative justice or restorative justice as an effort of the criminal justice system in achieving justice. This research is a legal study using a conceptual, historical and statutory approach. The purpose of this study is to find out the background of the birth of criminal law policies regarding electronic transactions and to find out the formulation of criminal acts regarding electronic transactions in Law Number 19 of 2019 concerning Information and Electronic Transactions. The results of this study indicate that the background of the birth of the criminal law policy in the field of electronic transactions is the development of crime through electronic systems in society. Although crime through an electronic system is virtual, it can be categorized as a real legal act or action. Juridically, legal actions in this cyber space are regulated in the ITE Law. The organization does not only consist of public and private organizations, but also mixed organizations (hybrid organizations). And it’s influence to the organizations of State-Owned Enterprises (SOEs) as stated in the legal considerations of Constitutional Court (MK) Decision Nr. 48 and 62 / PUU-XI /2013 that exclaims that SOEs are private legal entities that carry out public duties. Referring to this matter, (a) elements of hybridity in SOEs, (b) benefits and risks in the form of hybrid SOE organizations, (c) the concept of hybridity in increasing the achievements of SOE objectives. By using an analytical approach and legislation results that based on the characteristics of BUMNs are categorized as hybrid organizations. As a hybrid organization has benefits and risks as a result of the influence of the public and private elements. The greatness of the benefits and risks of hybrid organizations is inversely proportional to the size comparison of public and private elements. The hybrid concept at Perum (Public Company) which aims for public benefit is a balanced public element with a private element. Whereas for Persero (State Company) that has commercial aims, the private element must be more dominant to create flexibility that drives the development of the Company. Salah satu upaya preventif yang dilakukan adalah dengan memberikan larangan mantan terpidana mencalonkan diri dalam kontes pemilihan umum yang tujuannya untuk mencari pemimpin yang berkualitas. Namun pasca putusan MK Nomor 71/PUU-XIV/2016 mennggambarkan penurunan atau pelemahan pencegahan korupsi di Indonesia. Penulisan ini bertujuan untuk menemkan dasar akademis pentingnya pencegahan korupsi melalui pembatasan sesorang mencalonkan diri dalam jabatan publik. Diperoleh kesimpulan dari penelitian ini yaitu Putusan MK tersebut membuka peluang bagi mantan terpidana korupsi untuk mencalonkan diri. Sehingga sanksi pencabutan hak politik bagi terpidana korupsi yang menjalani sanksi penjara di bawah lima tahun perlu diprioritaskan untuk dijatuhkan. Sinergitas antara dua mekanisme tersebut, diperlukan guna mewujudkan cita-cita pemerintahan yang baik dan bersih, yang berkeadilan sosial. Corruption crimes occurred due to the misuse of power carried out by public officials, among them the regional head of anti-corruption efforts are carried out with preventive and repressive. One of the preventive efforts undertaken is to provide a former criminal ban to run for a general election contest whose goal is to find a qualified leader. However, after the decision of MK No. 71/PUU-XIV/2016, he described the decline or weakening of corruption prevention in Indonesia. This writing aims to accompany the academic basis of the importance of the prevention of corruption through the restriction of a person running in public office. Thus, the sanction of political Rights for criminal corruption under five years of imprisonment must be prioritized to be dropped. Persoalan ini disebabkan pengaturan kewenangan Wakil Presiden dalam UUD NRI Tahun 1945 tidak jelas. Penelitian ini bertujuan untuk menganalisis implikasi yuridis dari kekaburan kewenangan Wakil Presiden serta memberikan rekomendasi ke depan bagaimana seyogyanya kewenangan Presiden dan Wakil Presiden dapat diatur dan dilaksanakan secara proporsional. Penelitian ini merupakan penelitian hukum normatif dengan bahan hukum primer berupa UUD NRI 1945 dan bahan hukum sekunder berupa buku dan artikel jurnal berkaitan dengan kewenangan Wakil Presiden. Dari penelitian ini dapat disimpulkan bahwa pengoptimalan kewenangan Wakil Presiden dapat dilakukan dengan mengaturnya di dalam Undang-Undang Lembaga Kepresidenan yang diharapkan dapat membagi secara proporsional kewenangan Presiden dan Wakil Presiden. Oleh karena itu, diharapkan supaya pengaturan Kewenangan Wakil Presiden diatur secara pasti dalam aturan hukum supaya tidak tergantung pada praktik ketatanegaraan serta faktor non hukum, yaitu faktor politik. Mengingat pentingnya fungsi Wakil Presiden dalam sistem ketatanegaraan Republik Indonesia maka alangkah baiknya, Undang-Undang Lembaga Kepresidenan yang mengatur mengenai pembagian wewenang antar Presiden dan Wakil Presiden segera dibentuk. The power relations between the President and Vice President in the Indonesian constitutional system so far can be agreed to always overcome the ups and downs. The 1945 Constitution of the Republic of Indonesia is unclear. This study aims to analyze the juridical implications of the obscurity of the Vice President’s authority and give approval to the front regarding the authority of the President and Vice President to be able to regulate and implement proportionality. This research is a normative legal research with primary legal material in the form of the 1945 Constitution of the Republic of Indonesia and secondary legal material containing books and journal articles about the authority of the president’s representative. From this research it can be concluded that optimizing the authority of the Vice President can be done with a license in the Law on Presidential Institutions which is expected to allocate proportional authority to the powers of the President and Vice President. Therefore, it is hoped that the Vice President’s licensing can be regulated in regulating legislation not dependent on state administration and non-legal factors, namely political factors.
