Powers tentang hukum kewarisan Islam dan implementasinya di dunia muslim. Sebagai studi kasus, penulis mengangkat topik materi hukum kewarisan Islam yang terhimpun dalam Kompilasi Hukum Islam (KHI). Salah satu tesis yang dihasilkan Powers dari studinya mengatakan bahwa masyarakat muslim saat ini sebenarnya tidak memiliki pembacaan dan pemahaman yang tepat atas beberapa ayat al-Qur’an dan hadis atau sistem waris yang diterima oleh Nabi Muhammad. Apa yang dikonsepsikan dan dilakukan oleh masyarakat muslim berkaitan dengan kewarisan pada dasarnya merupakan buah dari dialektika antara aturan kewarisan dalam al-Qur’an dan hadis dengan realitas sejarah itu sendiri yang disebut farā’iḍ. Demikian halnya dengan KHI, materi-materi hukum yang termaktub dalam pasal per pasalnya jamak yang tidak sejalan dengan realitas redaksional teks al-Qur’an maupun hadis. Materi-materi hukum dalam KHI jamak didasarkan pada farā’iḍ, yang sudah barang tentu syarat dengan dinamika kesejarahan. The type of research used is a type of normative legal research, the approach in this study is the law approach, case approach, and historical approach, the sources of legal material used are primary, secondary and tertiary legal materials. Legal material collection techniques used with document study techniques and legal materials are evaluated, interpreted, argued and discussed descriptively. The results of the study show (1) the responsibility of the Ukraina for Malaysia Air Lines MH17 Aircraft Shooting that the State of Ukraina must be responsible for providing safety and security services for the sovereignty of the air space over its territory by Malaysia Air Lines MH17 in the form of flight navigation services, (2) The Malaysia Airlines airline must be limited to 100,000 SDR for each passenger and Malaysia Airlines. The airline cannot be subject to unlimited liability or exceed 100,000 SDR. Every country is expected to always supervise the airspace which is the sovereignty of the airspace above which becomes the international civil aviation route and to coordinate well with the ICAO (International Civil Aviation Organozation) to maintain the security of international civil aviation. This research is an empirical law study, by conducting interviews, direct observation, and literature study. The problem of forest occupation in the area of Alas Purwo National Park is a long-standing problem that can not be solved sooner which can lead to reduced protected areas and disrupt natural ecosystems that already exist around the site of the forest occupation. The existence of citizens who have been found guilty by the court violated Article 78 paragraph (2) jo. Article 50 paragraph 3 sub-paragraph of Law Number 41 of 1999 on Forestry jo. Article 55 paragraph (1) of the Criminal Code (KUHP) related to illegal criminal acts of forest occupation but until this day they still occupy the jungle zone of Alas Purwo National Park area also can disrupt the duties of the forestry police in its efforts to secure the forest. From the collected data, in the Regency of Magelang, the presence of foreign investors in tourism is still very little, while such potential is wide open for development. For this reason, this research is entitled \"The Policy of the Regional Government of Magelang Regency towards Foreign Investment in Tourism\". This study aims to find out how the Regional Government Policy of Magelang Regency in regulating foreign investment in the tourism sector as well as knowing its implementation and also the driving factors and obstacles in the implementation of foreign investment cooperation in tourism.This study is a normative juridical study that uses primary data, secondary data and tertiary data. Data collection is done using library research techniques, observation, interviews and online data search.Based on the results of this study indicate that the Regional Government Policy of Magelang Regency to increase foreign investment, especially in the tourism sector, is still very lacking because there are few foreign investors who invest in Magelang Regency. Based on the driving factors and constraints that exist, the prospect of foreign investment manifested by Magelang Regency Tourism towards the labor sector is very promising because it can open opportunities for employment opportunities for the people of Magelang Regency, and improve the economy in Magelang Regency. Hal ini sangat berpengaruh bagi kehidupan masyarakat pesisir.Penelitian bertujuan untuk mengetahui potensi lahan reklamasi pantai di Indonesia yang berkelanjutan dan merekonstruksi kebijakan reklamasi pantai yang berkeadilan. Penelitian ini secara garis besar dapat dikelompokkan kedalam ranah pendekatan Social Legal. Di dalam hal ini terdapat dua aspek penelitian, yaitu aspek legal research, yakni obyek penelitian tetap ada yang berupa hukum dalam arti “norm” dan socio research, yaitu digunakannya metode dan teori teori ilmu sosial tentang hukum.Hasil penelitian bahwa potensi lahan reklamasi pantai sebagian besar adalah untuk pengembangan usaha dan kawasan wisata untuk kesejahteraan masyarakat sekitar. Rekonstruksi kebijakan reklamasi pantai yang berkeadilan sosial di Indonesia dilakukan dengan merekonstruksi nilai kebijakan berupa pembuatan kebijakan yang melibatkan masyarakat secara genuine dan merekonstruksi hukum kebijakan peraturan perundang-undangan yang masih berlaku. The potential of coastal reclamation land in Indonesia is done by multiplying natural resources and human resources for coastal management for the welfare of the surrounding community. Since the enactment of Law Number 32 Year 2014 concerning Regional Government, the authority of the sea and the coast has become the authority of the Provincial Government, so that the authority and supervision of the regional government is reduced. This is very influential for the lives of coastal communities. The aim of the study was to determine the potential of coastal reclamation land in Indonesia that is sustainable and to reconstruct a fair coastal reclamation policy. This research can broadly be grouped into the realm of the Social Legal approach. In this case there are two aspects of research, namely the legal research aspect, namely the object of research that still exists in the form of law in the sense of “norm” and social research, namely the use of methods and theories of social science theory about law. Based on the results of the study that the potential of coastal reclamation land is mostly for business development and tourist areas for the welfare of the surrounding community. Dari keempat bidang tersebut, penggunaanya diprioritaskan untuk kegiatan pembangunan dan pemberdayaan. Penelitian ini bertujuan untuk menganalisis penggunaan dana desa untuk pemberdayaan masyarakat dengan mengambil studi kasus di Kecamatan Borobudur, Magelang, Jawa Tengah. Metode yang digunakan adalah metode penelitian yuridis-normatif. Hasil penelitian ini menunjukkan bahwa paradigma Undang-undang yang dianut oleh pemerintah desa dalam memahami ketentuan tentang penggunaan dana desa untuk kegiatan pemberdayaan masyarakat telah melahirkan jenis-jenis kegiatan pemberdayaan yang limitatif pada kegiatan pelatihan, kegiatan keagamaan, bantuan keuanga dan penyertaan modal. Apabila pemberdayaan difahami sebagai strategi pembangunan maka jenis-jenis kegiatan pemberdayaan akan lebih variatif dan dapat menjangkau berbagai kegiatan yang selama ini dimasukan dalam bidang pembangunan. Chamber mengidentifikasi 4 prasarat kegiatan pemberdayaan, yaitu people centered, participatory, empowerment and sustainable. Apabila pendekatan chamber ini dipergunakan maka penggunaan dana desa akan lebih membawa dampak yang lebih besar. Dana desa tidak hanya akan difahami sebagai bantuan/hibah dari pemerintah pusat namun lebih pada stimulant pembangunan yang menuntut adanya partisipasi maupun swadaya dari masyarakat.The use of village funds is generally used for the Implementation of Village Government, Implementation of Village Development, Community Development and for the Empowerment of Village Communities. From these four pillars, the use is prioritized for development and empowerment activities. This research intended to analyses the use of village funds to conduct community development, by taking case in the Borobudur Subdistrict, Magelang, Central Java. The result of this study indicates that the paradigm of the law adopted by the village government in understanding the provisions on the use of village funds for community empowerment activities has given birth to limited types of empowerment activities in training activities, religious activities, financial assistance and equity participation. If empowerment is understood as a development strategy, then the types of empowerment activities will be more varied and can reach various activities that have been included in the field of development. Chamber identifies 4 principles of empowerment activities, namely people centred, participatory, empowerment and sustainable. If this chamber approach is used then the use of village funds will have a greater impact. Penelitian ini menggunakan pendekatan yuridis normatif. Hasil kajian menunjukkan bahwa Politik hukum perlindungan terhadap pekerja migran perempuan, dapat ditelusuri berdasarkan beberapa regulasi terkait, mulai dari tatanan ideal, konstitusional, legislasi dan implementasi. Undang-undang perlindungan pekerja migran dianggap belum mampu melindungi pekerja migran perempuan Indonesia, tidak ada peraturan khusus terkait perlindungan pekerja migran perempuan dan belum konsisten untuk mengimplementasi berbagai konvensi yang telah diratifikasi terkait perlindungan pekerja migran terutama perempuan, sehingga perlu ditetapkan peraturan khusus terkait perlindungan pekerja migran Indonesia dalam rangka mewujudkan instrumen hukum perlindungan pekerja migran yang responsif terhadap kebutuhan pekerja migran perempuan Indonesia. Teori hukum feminis mendesak, pemerintah untuk menciptakan regulasi, terutama terkait perlindungan pekerja migran perempuan yang menempatkan perempuan pada posisi yang istimewa. This research aims to analyze how is the politics of law of the protection of female migrant workers is based on the feminist legal theory in Indonesia. This research uses a normative juridical approach. The results of the study indicate that the politcs of law of the protection of female migrant workers can be traced based on several related regulations, ranging from ideal, constitutional, legislative and implementation arrangements. The law on the protection of migrant workers is deemed unable to protect Indonesian female migrant workers, there are no specific regulations relating to the protection of female migrant workers and has not been consistent in implementing ratified conventions related to the protection of migrant workers, especially women, so special regulations need to be stipulated regarding migrant workers protection Indonesia in order to realize a legal instrument for the protection of migrant workers who is responsive to the needs of Indonesian women migrant workers. Pelakunya ternyata tidak hanya dilakukan oleh tahanan laki-laki saja namun ditemui juga bahwa aparat petugas kepolisian turut menjadi pelakunya. Oleh karena itu timbul beberapa permasalahan diantaranya adalah faktor apa saja yang menjadi penyebab terjadinya kekerasan seksual terhadap tahanan perempuan di dalam kantor kepolisian dan upaya hukum apa saja yang dapat dilakukan sebagai wujud perlindungan hukum terhadap tahanan perempuan khususnya yang menjadi korban kekerasan seksual di dalam tahanan kantor kepolisian. Dari hasil penelitian yang dilakukan penulis, kasus kekerasan seksual ini disebabkan oleh adanya faktor internal dan eksternal. Faktor internal diantaranya seperti faktor kejiwaan, kebutuhan biologis dan moral dari para si pelaku itu sendiri sedangkan faktor eksternalnya adalah adanya kesempatan yang didapat oleh pelaku seperti kelalaian/lemahnya penjagaan yang dilakukan oleh aparat petugas kepolisian dan faktor letak ruang sel tahanan laki-laki dan perempuan yang berada pada posisi berdekatan. Untuk mencegah dan menanggulangi kekerasan seksual tersebut, maka diperlukan adanya suatu upaya-upaya yang harus dilakukan oleh pihak pemerintah dan lembaga kepolisian yaitu dengan memperbaiki sarana dan prasarana penahanan di kantor kepolisian dan memperketat pengawasan atau penjagaan tahanan.Cases of sexual violence against female detainees are still common in several police stations such as at the Wajo City Police Station, Poso City Police Station and Jayapura City Police Station. The crimes are not committed by male detainees only but also by the police officers. Hence arise some problems what are the factors that become the cause of sexual violence against female detainees in police stations and what kind of remedy that can be taken as a form of legal protection towards female detainees particularly the victims of sexual violence at the police station. From the results of research by the author, cases of sexual violence against female detainees are caused by internal and external factors. Internal factors such as psychological factors, biological needs and moral of the offender itself, while external factors are the opportunities gained by actors such as omission or lack of security of the police officers and the location between male and female cell at the adjacent position. To prevent and combat sexual violence against female detainees, it is necessary to have an effort that must be undertaken by the government and police agencies such as improving the facilities and infrastructure of the detention center at the police station and tighten the supervision or security of detainess. Namun dalam perjalanannya, terdapat hakim konstitusi yang terjerat korupsi. Riset ini bertujuan untuk melihat kewenangan yang dimiliki oleh MK, lalu dicarikan solusi untuk menjaga agar kedepannya lebih akuntabel dan terpercaya. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menyimpulkan sebagai berikut. Pertama, MK memiliki kewenangan yang sangat besar, yang diantara kewenangan tersebut menjadikan lembaga ini sebagai pengawas lembaga legislatif, serta wasit bagi lembaga lain yang sedang bersengketa kewenangan. Kedua, MK harus menerapkan standar akuntabilitas yang tinggi untuk menghindari terjadinya korupsi, serta membangun sistem guna menjaga perilaku hakim, baik pada saat hakim sedang berada di lingkungan pengadilan, maupun di luar lingkungan pengadilan, guna meningkatkan kepercayaan masyarakat.The Constitutional Court continues to strive to be an accountable and trustworthy judiciary. However, on its way, there were constitutional justices who were caught in corruption. This research aims to examine the authority possessed by the Constitutional Court, so keys to the more accountable and trustworthy Constitutional Court in the future can be well identified. This study uses a normative juridical method. The results of the study are concluded as follows. First, the Constitutional Court has considerable authorities, which enable this institution to be a supervisor of the legislature and the referee for other institutions who are in dispute over authority.
