Harta bersama diatur dalam Pasal 35 dan Pasal 36 Undang-Undang Nomor 1 Tahun 1974. Namun akibat putusnya perkawinan karena perceraian sebagaimana diatur dalam Pasal 37 Undang-Undang Perkawinan, merujuk pada peraturan atau hukum agama, hukum adat, atau hukum-hukumnya yang lain. Meskipun pembagian harta bersama setelah terjadinya perceraian telah diatur berdasarkan ketentuan di atas, namun masih terjadi kesulitan dalam pelaksanannya. Sehingga menimbulkan sengketa antar kedua belah pihak. Hal ini dikarenakan keserakahan dan keegoisan dari para pihak yang ingin menguasai harta lebih banyak. Seperti dalam putusan nomor 1470 K/PDT/2018, mantan suami menguasai harta bersama tersebut dan tidak membaginya kepada mantan isteri. Dari keadaan inilah timbul ketidakpuasan maupun ketidakadilan yang pada akhirnya menimbulkan perselisihan di antara mantan suami isteri tersebut. Kata Kunci : Harta Bersama, Perkawinan, Perceraian, Pembagian Harta Bersama Setelah Perceraian AbstractThis study discusses the consequences of divorce on joint assets owned. Joint assets are regulated in Article 35 and Article 36 of Law Number 1 of 1974. However, due to the dissolution of a marriage due to divorce as regulated in Article 37 of the Marriage Law, it refers to religious regulations or laws, customary law, or other laws. Although the distribution of joint assets after the divorce has been regulated based on the above provisions, there are still difficulties in its implementation. This creates a dispute between the two parties. This is due to the greed and selfishness of the parties who want to control more property. As in decision number 1470 K/PDT/2018, the ex-husband controls the joint property and does not share it with the ex-wife. Notaris wajib membacakan akta dalam pembuatan akta partij, seperti akta sewa menyewa terutama dalam hal ada penghadap yang buta huruf karena mereka tidak dapat membaca sendiri isi akta tersebut. Kelalaian notaris yang tidak membacakan akta dapat membuat adanya kekhilafan dalam diri penghadap dan isi akta tersebut tidak sesuai dengan kehendak para penghadap. Jurnal ini menganalisis bagaimana implikasi hukum dari tidak dibacakannya notaris dihadapan penghadap buta huruf dan tanggung jawab notaris apabila aktanya dibatalkan oleh putusan pengadilan. Penelitian ini adalah penelitian yuridis normatif. Menggunakan data sekunder melalui studi kepustakaan, penelitian ini menggunakan pendekatan kualititatif. Penelitian ini menunjukkan bahwa implikasi dari tidak dibacakannya akta dihadapan penghadap yang buta huruf adalah akta notaris tidak lagi menjadi akta otentik dan tergradasi hanya seperti akta di bawah tangan. Akta tersebut juga dapat dinyatakan batal oleh putusan pengadilan. Notaris dapat dimintakan tanggung jawab perdata, administratif dan pidana apabila aktanya dibatalkan oleh putusan pengadilanKata Kunci: Implikasi Hukum, Notaris, Pembacaan Akta, Penghadap Buta Huruf AbstractNotary has the obligation to read the deed in front of the parties and two witnesses as it is regulated in Article 16 paragraph (1) letter (m) Notary Act. Notary is required to read the deed in the making of partij deed, such as rent agreement deed especially if there are parties who are illiterate because they can not read the deed by themselves. The negligence of a notary who does not read the deed can make the parties get mistaken dan the deed may contain what is not desired by both parties. This journal analyzes the legal implication of not reading the deed in front of illiterate parties and the responsibility of the notary if their deed is nullified by the court ruling. This research is a juridical-normative research. Using secondary data, data collection through literature study, the data is processed and analyzed through a qualitative approach. This research shows that the legal implication of not reading the deed in front of illiterate parties is the notary deed is no longer an authentic deed and it is degraded to privately made deed. The deed can also be nullified by court ruling. Notary may be subject to civil liability, administrative liability, or criminal liablity if their deed got nullified by the court ruling. Penyelenggaraan pemagangan diatur dalam UU Ketenagakerjaan dan Permenaker nomor 6 Tahun 2020 yang di mana menyebutkan hak dan kewajiban baik dari sisi pengusaha atau penyelenggaran pemagangan juga peserta pemagangan terlebih pemagangan yang diselenggarakan oleh pemerintah seperti program “Kampus Merdeka” oleh Kementerian Pendidikan, Kebudayaan, Riset dan Teknologi. Ketidaksesuaian penyelenggaraan pemagangan di lapangan dengan yang tertulis di peraturan mengakibatkan tidak terpenuhinya hak dan kewajiban penyelenggara pemagangan dengan peserta magang. Kata Kunci: Penyelenggaraan, Pemagangan, Ketenagakerjaan AbstractInternship is one of the self-development activities for workers and prospective workers to become competent when they have entered a real job, but apprenticeship providers often do not fulfill the rights of internship participants. The implementation of internship is regulated in the Labor Law and the Minister of Labor Regulation number 6 of 2020 which states the rights and obligations from both the entrepreneur side or the implementation of internships as well as apprenticeship participants, especially internships organized by the government such as the \"Kampus Merdeka\" program by the Ministry of Education, Culture, Research and Technology. Pemerintah Indonesia merespon dengan berbagai peraturan dan kebijakan untuk menghindari penularannya dengan memberlakukan Lock down dan kebijakan PSBB (Pembatasan Sosial Berskala Besar). Kebijakan tersebut menyebabkan omzet / penghasilan perusahaan menurun secara signifikan, karena kegiatan produksi perusahaan terhambat dan mengakibatkan kerugian drastis, ditambah lagi bagi perusahaan yang telah merugi pada tahun sebelumnya. Pada akhirnya perusahaan tutup serta terpaksa melakukan PHK (Pemutusan Hubungan Kerja) kepada para pekerja. Sebagai konsekuensinya, perusahaan wajib memberikan uang pembayaran kompensasi PHK sesuai ketentuan undang - undang. Pembayaran kompensasi PHK dalam jumlah besar sulit dipenuhi secara langsung oleh pengusaha mengingat kondisi keuangan perusahaan yang sedang collapse akibat kerugian secara terus menerus.  Kata Kunci : PSBB, PHK, Covid-19. ABSTRACT The spread of the Covid 19 outbreak throughout the world, has had a negative impact on life and the world economy, including in Indonesia. The Indonesian government responded with various regulations and policies to avoid the spread of the virus by imposing a Lockdown and PSBB (Large-Scale Social Restrictions) policy. This policy caused the company's turnover / income to decrease significantly, because the company's production activities were hampered and resulted in drastic losses, plus for companies that had suffered losses in the previous year. In the end, the company closed and was forced to lay off workers (Termination of Employment). As a consequence, the company is obliged to provide compensation payments for layoffs in accordance with the provisions of the law. However, in practice various problems often arise due to non-compliance with existing legal provisions by a notary. Not infrequently happens, in the process of making and signing the deed, the notary does not carry out his duties, authorities, and obligations such as reading and signing the deed in front of the parties. In fact, notaries often do not apply the precautionary principle in making a deed in which the appellant uses a false identity. This of course causes losses to both the notary himself, as well as the land owner. Thus, the notary can be penalized. The purpose of writing this journal is to analyze the duties, authorities, and obligations in cases that are not carried out by a notary so that there is a loss to the parties, as well as what legal actions can be taken by the aggrieved party. The method used is a juridical-normative research method, namely library law research, carried out by examining library materials or secondary data. The results of the research obtained are that reading and signing the deed in front of an audience is an obligation to be carried out by a notary in carrying out land sale and purchase transactions. The notary must be responsible if the contents of the deed are not in accordance with the intentions of the parties. For the loss of the parties, a notary can be sued for an unlawful act in a district court. Keywords: notary; unlawful act; land sale and purchase; civil sanction. AbstrakNotaris memiliki kewenangan untuk membuat akta otentik yang berkaitan dengan transaksi jual beli tanah. Namun, pada prakteknya seringkali timbul berbagai permasalahan akibat tidak dipatuhinya ketentuan hukum yang ada oleh notaris. Tidak jarang terjadi, dalam proses pembuatan maupun penandatanganan akta, notaris tidak melakukan tugas, kewenangan, serta kewajibannya seperti melakukan pembacaan dan penandatanganan akta di hadapan penghadap. Bahkan, notaris seringkali tidak menerapkan prinsip kehati-hatian dalam membuat akta yang penghadapnya menggunakan identitas palsu. Hal tersebut tentu menyebabkan kerugian baik terhadap notaris itu sendiri, maupun penghadap sebagai pemilik hak atas tanah. Sehingga, notaris dapat dijatuhkan sanksi. Tujuan penulisan jurnal ini adalah menganalisis tugas, kewenangan, serta kewajiban apa dalam kasus yang tidak dilakukan notaris sehingga terjadi kerugian kepada para penghadap, serta tindakan hukum apa yang dapat dilakukan pihak yang dirugikan tersebut. Adapun metode yang digunakan adalah metode penelitian yuridis-normatif yaitu penelitian hukum kepustakaan, dilakukan dengan meneliti bahan-bahan kepustakaan atau data sekunder. Hasil penelitian yang diperoleh adalah pembacaan dan penandatanganan akta dihadapan penghadap adalah suatu kewajiban untuk dilakukan oleh notaris dalam melaksanakan transaksi jual beli tanah. Akibat penggunaan UU ITE 2016, kemerdekaan dan kebebasan pers menjadi dibatasi. Profesi wartawan tetap harus tunduk dan taat kepada hukum. Tetapi sesuai dengan ketentuan hukum sendiri, sebagaimana diatur dalam UU Pers, wartawan tidak dapat dipidana. Ada tidaknya kesalahan pers, pertama-tama harus diukur dengan UU Pers dan KEJ 2006. In the making of an authentic deed, witnesses who participate in the making of the authentic deed are required. Witnesses and its qualification, or conditions that must be met by the witnesses have been determined by the law that can be found in Article 40 of Law Number 2 of 2014. The issue raised in this case is the Supreme Court Decision Case Number 156 K/PDT/2020. In this case, there are two deeds of sale and purchase which have the siblings of the seller stated as the witnesses . Therefore, this study will discuss what legal consequences arise from these actions and the responsibility of the notary as the party who made the deed of sale and purchase of the land. Keywords: Witness, Sale and Purchase, Deed AbstrakNotaris sebagai pejabat umum memiliki fungsi untuk menciptakan alat pembuktian yang sempurna, bertindak hati-hati serta jujur dalam bekerja dan menjaga martabat Notaris. Dalam pembuatan akta otentik, diperlukan saksi-saksi yang ikut serta dalam pembuatan akta otentik tersebut. Saksi sendiri diatur dalam Pasal 40 Undang-undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, adapun syarat yang harus dipenuhi oleh saksi telah ditentukan oleh Undang-undang. Permasalahan yang diangkat dalam kasus ini adalah mengenai Kasus Putusan Mahkamah Agung Nomor 156 K/PDT/2020. Pada kasus ini, dua orang kakak beradik menjadi saksi pada akta jual beli tanah yang dibuat oleh satu sama lain. Therefore, in the even of a notary is suspected of committing a violation of criminal law or an unlawful act, the role of the Notary Honorary Council is urgently needed to participate in providing legal protection for notaries. The duties and functions of the Notary Honorary Council itself is to give approval or refusal for the purposes of investigation in the judicial process. This also plays an important role because it aims to maintain the authority of a notary, so that there is no legal process that goes wrong or inappropriate even arbitrarily by criminalizing the act of a notary as a criminal offense, not necessarily an error in criminal law. However, in practice, this function still has several obstacles. This can be seen in the Court Verdict No. 20/PK/Pid/2020, where a notary is criminally charged, even though it is not classified as a criminal realm, but in the administrative realm. Keywords: Notary Honorary Council, criminal law, and legal protection. AbstrakNotaris, merupakan salah satu profesi di bidang hukum yang sudah sepatutnya mendapatkan perlindungan hukum dalam menjalankan tugas dan fungsinya sebagai pejabat publik yang diberi wewenang untuk membuat akta autentik. Oleh karena itu, dalam hal seorang notaris diduga melalukan suatu pelanggaran hukum pidana atau perbuatan melawan hukum, peran Majelis Kehormatan Notaris sangat dibutuhkan untuk turut memberikan perlindungan hukum bagi notaris. Tugas dan fungsi dari Majelis Kehormatan Notaris sendiri, adalah memberikan persetujuan atau penolakan untuk kepentingan penyidikan dalam proses peradilan. Hal ini juga memegang peranan penting karena bertujuan untuk menjaga wibawa notaris, agar tidak terjadi proses hukum yang salah atau tidak tepat bahkan sewenang-wenang dengan mengkriminalisasi perbuatan notaris sebagai tindak pidana, yang belum tentu merupakan kesalahan dalam hukum pidana. Namun, dalam pelaksanaannya, fungsi ini masih memiliki beberapa kendala. Alat bukti yang dapat dituntut kebenarannya adalah akta otentik yang dibuat oleh pejabat umum. Pejabat umum yang dimaksud adalah Notaris. Akta otentik memuat suatu kebenaran yang formal sesuai dengan apa yang diberitahukan para pihak kepada Notaris. Namun, Notaris juga mempunyai kewajiban untuk memasukkan bahwa apa yang termuat dalam akta Notaris sungguh-sungguh telah dimengerti dan sesuai dengan kehendak para pihak. Notaris juga berkenaan dengan perbuatan hukum terkait jual beli tanah. Dalam hal ini banyak permasalahan timbul terhadap peralihan Hak atas tanah yang selalu menjadi permasalahan utama. Persoalan tersebut sering terjadi dimasyarakat, dengan berbagai macam cara proses peralihan yang terjadi menimbulkan masalah baik dengan secara legal maupun ilegal dalam penerapannya. Pokok Permasalahan dalam penelitian ini adalah bagaimana peran dan tanggung jawab Notaris terhadap akta PPJB dengan merumuskan pemberian kuasa mutlak dan bagaimana keabsahan akta PPJB berdasarkan Putusan Pengadilan Negeri Nomor 27/Pdt.G/2019/PN.Krs. Penelitian ini bertujuan untuk menganalisis tanggung jawab Notaris terhadap terhadap akta PPJB dengan merumuskan pemberian kuasa mutlak berdasarkan Putusan Pengadilan Negeri Nomor 27/Pdt.G/2019/PN.Krs melalui penelitian yuridis normatif dan bersifat eksplanatoris ini, menggunakan data sekunder yang diperoleh dari studi dokumen dan kepustakaan. Digunakan pula tiga bahan hukum yaitu bahan hukum primer, bahan hukum sekunder, bahan hukum tersier.Kata kunci      : Tanggung Jawab; Notaris; Kode Etik Notaris; Jual Beli; ABSTRACT A notary as a public official is given the authority to make an authentic deed. The evidence that can be claimed for the truth is an authentic deed made by a public official. The public official in question is a Notary. An authentic deed contains a formal truth in accordance with what the parties have notified the Notary. However, the Notary also has an obligation to include that what is contained in the Notary deed has truly been understood and is in accordance with the wishes of the parties. Notaries are also concerned with legal actions related to the sale and purchase of land. In this case, many problems arise regarding the transfer of land rights which has always been the main problem. These problems often occur in the community, with various ways the transition process that occurs causes problems both legally and illegally in its application.
