Second, it evaluates whether the crc has material value by exploring how youth subjectivity is constituted through this legislation. To achieve these aims, we engaged with the text of the legislation using Foucauldian critical discourse analysis (cda). Findings indicate a shift in Ontario’s political discourse through this Act’s repositioning of young people as autonomous rights-holders. However, a disconnect is revealed between progressive legislation and the real-life impacts on young people. After unpacking the concept of listening and the role it plays in adult-child communication, we share the results of a scoping review where we examined neuroscientific studies pointing to the benefits of listening and what relevance such evidence has for children’s rights implementation. As such, this paper shows that when adults listen to children in the context of safe, nurturing, and empathic interactions, children draw tangible benefits to many areas of their development. The article shows how state institutions in charge of child protection base their activities on ideological representations that involve techniques of control, surveillance and punishment of domestic units, which are presented as dysfunctional insofar as the children are seen as vulnerable. The article concludes that this exercise perpetuates social and spatial segregation in the city to legitimise the governance of child care. Yet, it is often the case that the rhetoric associated with children’s “participation rights” does not reflect practice. Especially in the case of the youth justice system, significant challenges exist concerning both notions of the right to participate and how it translates into and influences what should be appropriate interventions for young people. This article draws upon three studies which critically examined the concept of participation and children’s decision making in pre-court and custody and resettlement settings. Listening to what young people said through these studies, reflections are offered concerning prevailing understandings and the operationalisation of “participation” within existing youth justice approaches. By exploring different systems’ institutional approaches and empirical ability to implement and honour children’s right to participation in national contexts, this article reviews the literature and suggests a framework for understanding participation through a lens of a global typology of child protection systems. Drawing on the conceptual and empirical reviews and elements from the deliberative ideal for decision-making, the article concludes by drawing up a sketch for a best interest model for meaningful, respectful and successful participation with global applicability. {"title":"The Forcible Transfer of Children from Ukraine as Genocide","authors":"Hilly Moodrick-Even Khen","doi":"10.1163/15718182-32010004","DOIUrl":"https://doi.org/10.1163/15718182-32010004","url":null,"abstract":"\u0000On 17 March 2023, Pre-Trial Chamber ii of the International Criminal Court (icc) issued secret warrants of arrest for President Putin and the Commissioner for Children’s Rights in the Office of the President of the Russian Federation, Ms. Lvova-Belova, for the commission of the war crime of forcible transfer of children. This article argues that there are “reasonable grounds to believe”, as the icc Statute requires for the arrest warrant stage, that both Putin and Lvova-Belova bear individual criminal responsibility for the forcible transfer of Ukrainian children as a crime of genocide; however, two types of considerations – general and particular – prevented the issuing of arrest warrants for genocide crimes.\u0000In Section 2, after a short historical-legal review of the formulation of Article 2(e) of the Genocide Convention (gc), the article notes that despite the significant number of cases of children being transferred and removed from their families that have taken place since the gc was adopted, the provision has been dormant and considered anachronistic and was rarely applied by an international or a local court. Section 3 proceeds with a legal analysis of the elements of the crime of the forced transfer of children and the genocidal special intent. Section 4 parses the case study of the forcible transfer of children from Ukraine as a crime of genocide. Section 5 analyses the litigation of the crime of genocide in the icc through the only case of genocide the court has addressed so far: the arrest warrant for Sudan’s former president, Omar al-Bashir. Despite two seminal cases heard in UK courts in 2008 and 2014 concerning, respectively, the privacy rights of the children of J.K. Rowling and Paul Weller, a glance at the online pages of UK news outlets reveals that unpixellated photographs of celebrity children remain commonplace. Interest in such comparisons has increased in recent years; however, several factors limit the efficacy of using crc reporting documents for cross-national comparisons. Focussing on the role of civil society organisations (cso s) in the crc reporting process, we examine how state reliance on cso s to perform vital functions of the crc might influence developments in children’s rights and how these developments get monitored and recorded. Drawing on Social Origins theory, we illustrate how different state-civil society relationships can lead to heterogeneous and uneven provision of, and reporting on, children’s rights issues, interventions and developments.
