It shows that anti-corruption efforts and policies in Malawi can be traced back to the dawn of multi-party system in the early 1990s. It acknowledges the emergence of political will to fight corruption under the leadership of president Bakili Muluzi resulted in the enactment of the Corruption Practices Act (CPA) in 1995 and the establishment of the Anti- Corruption Bureau (ACB). These developments were followed by many other anti-corruption initiatives and policies over the years. However, this article establishes that corruption levels in Malawi have worsened, especially in recent years, despite the country’s many anti-corruption legislation and policies. The article finds that the drivers behind corruption in Malawi are complex and that they involve, among other things, political, structural, economic, and personal motives. Specifically, the article tests protocols provided by the African Union (AU) and the European Union (EU) in order to highlight the attendant key critiques and challenges. It highlights the prospects that protocols provided for by the AU and EU could mitigate and ameliorate sexual violence in armed conflict (SVAC) in contexts such as that of the Democratic Republic of Congo. Therefore, the article also examines strengths and weaknesses of the AU and EU protocols for SVAC. The article finds that there are more complex and area-specific reasons why sexual violence in armed conflict takes place in Africa, especially in the DRC. Furthermore, the article notes the notion that sexual violence as a weapon is recognized to be “cheaper than the use of bullets” as well as the societal preoccupation with biosocial and patriarchal military theory. This article finds that such acts or beliefs, which are morally unacceptable, are prevalent causes of SVAC in the eastern Democratic Republic of Congo. The article concludes that protocols provided for by the AU and EU fall-short of what is required in the DRC because this country’s contexts entail more of redress than prevention. Indeed, prevention cannot be underrated, but there are already scars and victims of SVAC that require urgent intervention to build for a better society. The article recommends that a just and fair framework be established to address the problems that confront victims of SVAC as well as to hold governments and officials to account. Matamanda, Liaison Mukarwi, Romeo Dipura, Tariro Nyevera","doi":"10.55190/otke7529","DOIUrl":"https://doi.org/10.55190/otke7529","url":null,"abstract":"Using case law and thematic content analysis, this study tracks the major strands defining wildlife crime in Zimbabwe with a view to draw lessons that can be critical in policy implementation, policy monitoring, law making and for sustainability. Each year, Zimbabwe loses thousands of specimen wildlife (plant, animal and bird) to poachers. Crime reports about the trials of the poachers are prepared and yet, there is an absence of nuanced literature to track and review the meaningfulness of such reports. Among the commonly reported major wildlife crimes are the illicit trade in wildlife products, failure to comply with existing wildlife laws and the capturing of the near extinct pangolin. It emerged that the major motivating factors to wildlife crime are economic (income generation or wealth creation) and partly social. There are several deterrents from the global conventions such as the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and local laws but are failing to curtail wildlife crime. It is recommended that the use of information awareness can play a pivotal role in reducing wildlife crime as the main perpetrators of exhibit undue naivety and ignorance when it comes to conviction of their crimes. Citizen participation enhances transparency and legitimacy as well as accountability and responsiveness from those entrusted with public office. In Zimbabwe, the constitutionalisation of local governance has seen a provision obligating Central Government to support devolution through the provision of financial resources. This article explores opportunities provided by the constitution through an elaborate discussion of devolution rolled out by the Government in Zimbabwe. Practical examples of the implementation of devolution projects in different districts in the country are given. Accordingly, the municipal officials as agents are depicted as potentially non-compliant, dishonest and corrupt. Notably, measures that have been established to address problems of non-compliance have been disproportionately focused towards municipal officials. This intrinsic bias against municipal officials is flawed and inadequate for the context and dynamics at play in the problem of non-compliance with municipal finance legislation in South African municipalities. In particular, the assumption that the non-compliance occurs because the municipal councils are unable to effectively control the behaviour of the bureaucrats is not borne out by reality. This article aims to highlight the theoretical limitations of the principal-agent theory in order to explain the problem of non-compliance with municipal finance legislation in South Africa. Drawing on reports of the Auditor-General, the article shows the contribution of the municipal council in the problem of non-compliance. The article concludes that municipal councils are not unable but unwilling to exercise oversight obligation and duty and thus must be regarded as complicit and culpable in the problem of non-compliance in South African municipalities. Based on this premise, this article examines the role of civil society in the process of democratic consolidation in Lesotho. It aims to situate civil society in the entire process and efforts of consolidating democracy. To accomplish this endeavour, this article extensively examines the available relevant literature and data by relying on discourse analysis. It establishes that civil society in Lesotho plays a significant role in consolidating democracy through diverse activities such as advocacy, aggregation of interests, lobbying, and provision of civic education. Social protests are found to be one of the most preferred approaches of influencing policy in the direction of democratic consolidation, especially when the government is unresponsive to public needs. The article also revealed that in many instances, the government of Lesotho abuses its powers by violating civil and political rights. This behaviour seems to be the main impediment to democratic consolidation since civil society is largely assuming its role in the country. The article suggests that civil society should do more to deter the state’s abuse of power while the government should refrain from perpetuating human rights violations so as to enable the country’s democracy to consolidate. Having had a privileged status in society, the white farmers found themselves in a very fragile state as Third Chimurenga began. The violent take-over of land was spearheaded by war veterans. Images of white farmers who were beaten, killed, exiled and driven from their homes became synonymous with land invasions. Such events and acts of eviction became commonly referred to as Jambanja as more and more farmers suffered violent confrontations on their farms. The white farmers were portrayed as being in direct opposition to the government land distribution agenda that had given approval to the invasions and evictions. The article examine the effectiveness of Commercial Farmers Union in responding to the invasions, the new splinter groups and how they responded to the invasions and also the SADC tribunal petition by Mike Campbell. The article will also provide an analysis on how Jambanja spread and how it was carried out. Thus through reading library sources and literature in collections as well as carrying out interviews this article seeks to demonstrate that white farmers tried without much success to resist the sanctioned farm invasions. Ultimately the white farmers lost their prized possession that is the land. The article will highlight the dynamics of land politics in Zimbabwe. Sithole","doi":"10.55190/hxfv2694","DOIUrl":"https://doi.org/10.55190/hxfv2694","url":null,"abstract":"One of the fundamental challenges faced by first-time supervisors in supervision relationships often revolves around the hierarchical nature and unequal power dynamics. Becoming a supervisor is one of the transitions applicable in the workplace, which unfold as either an opportunity or a challenge. This article explores the experiences of power dynamics faced by first-time supervisors in the social service professions, using the case study of Social Work supervisors in the public sector. The uniqueness of the public sector lies in its responsibility to render services to citizens in a non-profit manner, which is in direct contrast to the profit motive in case of the private sector. Two challenges worth mentioning are lack of measures for preparing and supporting supervisors for the new role and the notion that the managerial and professional supervision may, sometimes, be characterised by the contradictory needs. This article reports on the qualitative component, a dominant part of the explanatory mixed methods design, with a sample of thirteen social work supervisors selected from the KwaZulu-Natal Provincial Department of Social Development. The pragmatist episteme and the triangulation of Experiential Learning and the Transition Theory, served as the underlying paradigm and theoretical framework, respectively. In the main, the study found that redefining of existing relations, the relational and social nature of power in supervision and the educational function in promoting adaptation into the new role were three main findings in this study. The article concludes by stating that putting the measures in place is essential in enabling the first-time supervisors to effectively adapt to their supervisory roles. Chigora","doi":"10.55190/rwfp7026","DOIUrl":"https://doi.org/10.55190/rwfp7026","url":null,"abstract":"On 29 July 2020, the government of Zimbabwe and representatives of the former white farmers signed the Global Compensation Agreement (GCA) in which the government committed to paying a total of USD3.5billion to the farmers for the developments instituted on the farms before the Fast Track Land Reform Programme (FTLRP). The deal was guided by section 72(3) of the 2013 constitution of Zimbabwe. The GCA provides for the establishment of various joint committees for the evaluation of the developments in question, the fundraising process and the payment procedures. While this is seen as being a show of commitment by the government of Zimbabwe to close the land chapter amicably, there are mixed voices on the development notwithstanding that the decision was accepted by 94.49% of Zimbabweans who voted in the 2013 referendum (ZEC 2013). It is, therefore, the purpose of this article is to look at the challenges and prospects of the land compensation agreement as a conflict resolution move pursued by Zimbabwe’s second republic and its implications for relations with western countries and institutions. To achieve this, the article depended upon both primary and secondary sources of qualitative research. The primary sources used in this article are mainly the pieces of legislations (both colonial and post-colonial), reports by various commissions and the Zimbabwe constitution. Secondary sources, mainly published material, media reports, official institutional reports and websites, and interviews were used in this research.
