Everyone has the right to health, according to Article 4. To prevent medical errors in patient care, hospitals ensure that doctors and other health workers have legal protection. Patients also receive legal protection from hospital liability and from doctors and other health professionals. Every person has the right and legal right to obtain health services, and the public is free to utilize government and/or regional government health resources. The right to receive public health services, especially in government hospitals, needs to be implemented specifically to guarantee health financing for the poor, and emergency financing in hospitals due to disasters and extraordinary events. Therefore, legal protection of the right to obtain health services for the community is part of implementing the protection of human rights. The fulfillment of the right to adequate health services through hospital facilities is guaranteed and implemented by the government and/or regional governments. {"title":"The Staples of the State Policy as the Legal Basis for Sustainable Development to Face the Industrial Revolution 5.0 and Golden Indonesia 2045","authors":"Bambang Soesatyo","doi":"10.58451/ijebss.v2i03.118","DOIUrl":"https://doi.org/10.58451/ijebss.v2i03.118","url":null,"abstract":"The National Long-Term Development Plan (RPJPN) and the National Medium-Term Development Plan (RPJMN) are national development planning systems developed after the abolition of the State Policy Guidelines (GBHN) in the Indonesian constitutional system. The RPJMN has been deemed inadequate because the actors that form and implement it are deemed unrepresentative and irrelevant to the essence of popular sovereignty, as well as ineffective public control mechanisms for the implementation. Therefore, a legal instrument is needed in the form of Staples of State Policy (PPHN) as a legal basis or legislative umbrella for the development and the re-establishment of the GBHN (or by other names) as well as the direction in planning and monitoring the government’s commitment as an executive institution. This research aims to find out and provide recommendations for PPHN legal basis as a legislative umbrella for implementing sustainable development in the face of the industrial revolution 5.0 and Golden Indonesia 2045. The research was conducted using normative juridical research methods with descriptive-analytical research specifications with qualitative analysis. This research applies (a) statute approach; (b) conceptual approach; and (c) comparative approach. Results show that since the reformation era, national development in terms of legislation has not been conducted sustainably. This can be seen from the disharmony and even the negation of national development programs. PPHN arrangement as Directive Principles of Indonesian Government Policies can be conducted through: (a) Limited amendments to the 1945 Constitution, especially Article 2 and Article 3 paragraph (1) of the 1945 Constitution by including the substance of the People’s Consultative Assembly (MPR) authority to formulate PPHN; (b) Amendment of Law No. 12 of 2011 by Law No. 13 of 2022 on the Second Amendment to Law No. 12 of 2011, specifically revising the explanation of Article 7 paragraph (1) letter b, hence, the MPR can formulate Decree as part of statutory regulations, including PPHN; (c) Amendment of Law No. 17 of 2014 on the MPR, DPR, DPD, and DPRD as amended several times, most recently by Law No. 13 of 2019 on the Third Amendment to Law No. 17 of 2014 by including the MPR's authority to formulate PPHN through MPR Decree; (d) Stipulation of PPHN in a law that revokes Law No. 25 of 2004 on the National Development Planning System (SPPN); or (e.) The construction of the regulations contained in the Law delegates the implementation of rehabilitation to sectoral ministers which causes the rehabilitation program to become a sectoral ministry program and has not demonstrated good inter-sector linkages and cooperation in its implementation. The construction of this kind of arrangement has the potential to reduce rehabilitation to just a ministerial program and lose the big picture that the Narcotics Law aims to achieve. This type of research is normative research used a statutory approach and a conceptual approach. The data source used is secondary data. Data analysis was carried out descriptively qualitatively.  This research produces findings that the Government has attempted to make regulations that guarantee Health for its citizens with the mandate of the 1945 Constitution. Various efforts have been made to create a special law on narcotics and revise the law. Law Number 35 of 2009 concerning Narcotics (Narcotics Law) distinguishes between dealers, sellers and dealers and narcotics addicts, because addicts may be considered victims of dealers or sellers who abuse these narcotics. The process of creating a cooperation contract for the management of the Cipanas Indah Hotel and Resort between the regional government and the private sector, where in general the cooperation process has been carried out in accordance with statutory provisions, starting from document checking, feasibility checks, auctions to signing the agreement carried out by the Regional Cooperation Coordination Team (TKKSD) Garut district, but in reality the agreement leaves a new problem, namely the status of the employees who are being transferred is not clear, so it is quite difficult to resolve it. This especially happens on land in rural areas, which is of course different from land use in urban areas. For example, land in rural areas is used for social and economic life. Social life, such as having a family, going to school, worship, recreation, and sports are carried out in the village; while economic activities such as farming, gardening, animal husbandry, and cutting wood in the forest are executed outside the village. However, on the other hand, in urban areas, because land value is economically advantageous, land use is conducted as efficiently and effectively as possible, therefore, mixing of uses can occur. The population growth in urban areas in the last decade has been increasing. Apart from the migration flow of people from outside the city into urban areas, there is also a process of urbanization which especially affects suburban areas (fringe areas). The Preamble to the 1945 Constitution contains Pancasila (State of Belief in God), basic principles of human rights, justice ( Rule of Law), people's sovereignty (Democratic State), as well as the duties and obligations of the Government (all state institutions) to create a Welfare State which includes protecting Indonesia's bloodshed. This type of research is Normative research. The approaches used are a statutory approach and a conceptual approach. The data source used is secondary data. Data analysis was carried out descriptively qualitatively. Concluding is conducted by using a deductive method, namely concluding from general to specific, especially those related to the research topic, namely Legal Review of Regional Government Authority in Land Disputes Based on the Principle of Shared Justice. the basic values it describes. This elaboration can be carried out creatively and dynamically in new forms to embody the same spirit and within the limits permitted by these basic values. This explanation clearly must not conflict with basic values. The basic values in question are values taken from Pancasila. Law is a tool for creating justice. The logical consequence of this transportation electrification policy is the increased use of energy storage media, including lithium-ion batteries. The installed capacity of lithium-ion batteries is predicted to continuously rise with a CAGR of 25.45%, reaching 10.5 TWh by 2030, of which 8.1 TWh will be installed in electric vehicles, according to Circular Energy Storage. The potential for lithium-ion battery waste to be processed in Indonesia is estimated to reach 250,000 tons by 2030, increasing further due to policies encouraging the domestic use of electric vehicles. This policy is expected to necessitate 0.2 million tons of cobalt and 1.3 million tons of nickel by 2040. The lack of domestic lithium resources is also a driving factor for developing a recycling industry to ensure the sustainability of the electric vehicle industry. A case study calculating the recycling potential from lithium-ion battery-powered devices sold in Indonesia in 2022 indicates a circular economic opportunity of US$ 49,767,416 and a reduction in emissions of 7,472 tons of CO2. This quantitative research based on best practices perfects the two studies, on ten variables forming the Halal cosmetics market share, namely beauty advisor, price, good corporate governance, halal knowledge, distribution, and influencers. This analysis using complex mediation model with four mediation variables is assisted by PLS-SEM software, Smart PLS 0.3. The data sources used by researchers are primary, secondary and tertiary data obtained from literature analysis, case studies and interviews with law enforcement.
