Micro, small, and medium enterprises (MSMEs) are the types of businesses most affected by the COVID-19 pandemic, where the incoming income is not proportional to the espenses that must be paid, which consists of operational cost for employees, electricity, machinery and most business owners MSMEs lend money to banks for the purpose of capital and purchasing tools to support their business survival. Many MSME business owners experience this payment difficulty, especially payment of credit bills, even though it can be seen in fact that MSMEs are the largest economic supporting sector in Indonesia from the monetary crisis that hit Indonesia in 1998 until now, where the existence of MSMEs during the crisis continued to provide the impact of positive growth on Indonesia in any way, so the government should have provided a stimulus to save MSME debtors who were affected by the Covid-19 pandemic.Keywords: MSMEs Debitors; Covid-19 Pandemic; Force Majeure; Credit Restructuring; Banking.\u0000AbstrakPandemi Covid-19 merupakan suatu wabah penyakit menular yang memberikan dampak besar tidak hanya pada kesehatan, tetapi berimbas pada sektor sosial dan perekonomian. Usaha mikro, kecil, dan menengah (UMKM) merupakan jenis usaha yang paling terdampak dengan adanya pandemi covid-19 ini, dimana pendapatan yang masuk tidak sebanding dengan pengeluaran yang harus diayarkan, yang terdiri dari biaya operasional pegawai, listrik, mesin dan kebanyakan pemilik usaha UMKM melakukan peminjaman uang kepada bank dengan tujuan untuk modal dan pembelian alat untuk menunjang kelangsungan hidup usahanya. The instrument of controlling and controlling public road private parking by the Department of Transportation in the City of Surabaya in order to deal with cases of liar parking consists of laws and regulations and the application of sanctions. Metode penelitian yang digunakan yaitu metode normatif dengan melalui pendekatan undang-undang dan pendekatan konseptual. Berdasarkan keabsahan dalam pemberian izin terkait peraturan undang-undang dalam pelaksanakan Peraturan Daerah yang ada di Kota Surabaya belum sesuai dengan kenyataan yang tejadi dilapangan. Instrumen pengendalian dalam pengelolaan dan pengendalian parkir swasta ditepi jalan umum oleh Dinas Perhubungan di Kota Surabaya dalam rangka mengatasi kasus parkir liar terdiri dari peraturan zonasi, perizinan, insentif/disinsentif dan penerapan sanksi. There is a vagueness of norm within the mechanism regulated in Article 11 Verse (3), such as the qualification that needs to be fulfilled by the creditors in order to be considered as other creditors and the ratio legis of that regulation. There is also vagueness regarding the limitation of the objections as the reason to file cassation. This research will focus on the ratio legis of other creditors that are not the parties within the filing of bankruptcy and the limitation of the objections in regards of the cassation filing. The research shows that other creditors must fulfill the criteria of creditors stated in Bankruptcy Law first and the ratio legis of their involvement is that the legal consequences of the bankruptcy decision will affect all creditors. The legal consequences of the bankruptcy decision could also become the reason of other creditors’ objection. The reason of objections also limitedly regulated in Article 30 (1) Law Number 5 of 2004 regarding the Supreme Court. Keywords: Other Creditors; Objections; Cassation; Bankruptcy Decision.\u0000AbstrakPasal 11 Ayat (3) UU KPKPU memperbolehkan kreditor lain yang bukan para pihak pada permohonan pailit dapat mengajukan kasasi apabila terdapat ketidakpuasan terhadap putusan tersebut. Terdapat kekaburan hukum dalam ketentuan ini mengenai kualifikasi seperti apa yang harus dipenuhi oleh seorang kreditor sehingga dapat dikategorikan sebagai seorang kreditor lain dan ratio legis dari ketentuan ini. Selain itu, batas mengenai ketidakpuasan sebagai alasan dalam mengajukan kasasi ini juga belum diatur secara rinci. Penelitian ini akan membahas mengenai ratio legis kreditor lain yang bukan merupakan para pihak dalam permohonan pailit dan batasan tidak puas bagi kreditor lain yang bukan merupakan para pihak dalam permohonan pailit dalam mengajukan kasasi. Hasil penelitian menunjukkan bahwa seorang kreditor lain harus memenuhi kualifikasi sebagai seorang kreditor yang memiliki ikatan perjanjian dengan debitor pailit dan bahwa kreditor lain dapat masuk dalam tahap kasasi karena putusan pailit berakibat terhadap semua kreditor tanpa terkecuali. Akibat kepailitan itu sendiri dapat menjadi alasan ketidakpuasan seorang kreditor lain dalam pengajukan kasasi. Every policy formation, the government must involve the people. The process of involving the people in policy formation is called public participation. Participation can be done directly, or through representative institutions. Many laws and regulations in Indonesia regulate the process of public participation. However, there is no uniformity in laws and regulations regarding nomenclature and procedures. In its implementation, many policy formations have missed public participation. On the other hand, many people do not have the capacity to get the right to participate. Public participation can be strengthened by: harmonizing laws and regulations, establishing guidebooks, and arranging sanctions or legal consequences if participation is not implemented. Even though it is a dilemma, public participation must still be carried out. Setiap pembentukan kebijakan, pemerintah wajib melibatkan rakyat. Proses terlibatnya rakyat dalam pembentukan kebijakan disebut partisipasi masyarakat. Partisipasi dapat dilakukan secara langsung, maupun melalui lembaga perwakilan. Peraturan perundang-undangan di Indonesia sudah banyak yang mengatur mengenai proses partisipasi masyarakat. Namun, tidak ada keseragaman pada peraturan perundang-undangan mengenai nomenklatur dan prosedurnya. Dalam pelaksanaannya banyak pembentukan kebijakan yang melewatkan partisipasi masyarakat. Di lain sisi, banyak masyarakat yang tidak memiliki kapasitas untuk mendapatkan hak partisipasi tersebut. Partisipasi masyarakat dapat diperkuat dengan cara: melakukan harmonisasi peraturan perundang-undangan, pembentukan buku panduan, serta pengaturan sanksi atau akibat hukum apabila partisipasi tidak dijalankan. This system is only valid at particular times and places. The enforcement of this system is intended for a 4 (four)-wheeled motor-vehicle, in which case a private car or passenger car. Therefore, online transportation that used a private car or passenger car in providing transportation services is also affected by this system. The system has a positive impact and negative impacts especially for passengers and transport carriers online. Carriers and passengers do not have the right to pass certain streets. In the end, there will be a breach by the carrier to the passengers or vice versa. Therefore, legal protection for passengers and carriers is required, as well as a special status for the 4 (four) wheeled motor vehicles used as an online transportation service mode. Legal protection can be done on a preventive and repressive basis.Preventive protection takes precedence over repressive protection. Sistem ini hanya berlaku pada waktu dan tempat tertentu. Pemberlakuan sistem ini diperuntukkan bagi kendaraan bermotor beroda 4 ( empat ), dalam hal ini mobil pribadi atau mobil penumpang. Oleh sebab itu, transportasi online yang menggunakan mobil pribadi atau mobil penumpang dalam memberikan pelayanan jasa angkutan juga ikut terdampak sistem ini. Sistem ini mempunyai dampak positif dan dampak negatif khususnya bagi penumpang dan pengangkut transportasi online. Pengangkut dan penumpang tidak mempunyai hak untuk melewati jalan-jalan tertentu. Pada akhirnya akan timbul suatu pelanggaran yang dilakukan oleh pengangkut kepada penumpang maupun sebaliknya. Jadi diperlukan perlindungan hukum bagi penumpang dan pengangkut, juga status khusus bagi kendaraan bermotor beroda 4 ( empat ) yang digunakan sebagai moda pelayanan transportasi online. Perlindungan hukum dapat dilakukan secara preventif dan secara represif. Namun masih ada pelanggaran pada program tersebut seperti pelanggaran norma hukum pada pembeli serta dibutuhkannya perlindungan hukum bagi pembeli dalam perjanjian jual beli rumah yang bersubsidi pada perjanjian jual beli rumah bersubsidi terkait kualitas rumah layak huni. Untuk menganalisis pelanggaran norma hukum dan bentuk perlindungan hukum pada pembeli terkait perjanjian jual beli rumah bersubsidi terkait kualitas rumah layak huni perlunya menganalisis peraturan perundang-undangan yang berlaku untuk menjadi acuan penyelesaian permasalahan ini. Hasil yang ditemukan adalah developer melakukan wansprestasi. Fakta lain lemahnya posisi pembeli akan opsi produk pembelian dan kurangnya informasi yang diberikan oleh pihak terkait dalam penjualan. In its application, there are some parties who refuse to be applied under the pretext of capital punishment contrary to basic human rights, namely the right to life. The Indonesian government is still implementing the sanction of capital punishment in its legal system. The application and implementation of capital punishment in Indonesia is inseparable from some formal regulations owned by Indonesia, one of which is SE Jampidum 3/1994. SE Jampidum 3/1994 said that the execution could only be carried out after the 30-day Death Setence. Even though in practice death row inmates are required to undergo a waiting period of decades in the prison. The waiting period for execution is not only about a long time but also arises due to the process of fulfilling the rights of the convicted person. This type of research is a Reformed Oriented Research by using the legal approach and conceptual approach. The purpose of this study is to find the right waiting time for death row inmates while waiting in the prison. Dalam Penerapannya terdapat beberpa pihak yang menolak untuk diterapkan dengan dalih pidana mati bertentangan dengan hak dasar manusia yaitu hak untuk hidup. Pemerintah Indonesia sampai saat ini masih menerapkan pemberlakuan sanksi pidana mati dalam sistem hukumnya. Penerapan dan penjalanan eksekusi pidana mati di Indonsia tidak lepas dari beberapa aturan formiil yang dimiliki Indonesia, yang salah satunya yaitu SE Jampidum 3/1994. SE Jampidum 3/1994 menyatakan bahwa eksekusi mati barudapat dilaksanakan setelah lewat 30 hari putusan inkracht. Padahal dalam praktiknya terpidana mati diharuskan menjalani masa tunggu selama berpuluh-puluh tahun di dalam LAPAS. Masa tunggu eksekusi tidak hanya mengenai waktu yang lama namun juga muncul akibat proses pemenuhan hak-hak terpidana. Tipe penelitian ini adalah Reform Oriented Research dengan menggunakan metode pendekatan perundang-undangan dan pendekatan konseptual. Based on article 22E paragraph (1) UUD NRI 1945, election in Indonesia are held every five years. The first election in Indonesia were held in 1955. The elections in 2019 which fell on April 17 were different from the elections on the previous period. The first time in Indonesia the 2019 elections were held silmutaneously. Where Indonesian citizens choose five state institutions namely the President and Vice President, DPR RI, Provincial DPRD, City/Regency DPRD, and DPD simultaneous election is expected to be efficient both in terms of time, funds and personnel. But in reality, many KPPS members have died while carrying out their duties. This is due to increase in workload compared to the previous election period. In addition, the working hours of KPPS members are not regulated in detail either in the Election Law or PKPU made by the KPU. Based on this, there is a need for rules governing more detailed right for KPPS members. Keywords: Legal Protection; Election Organizer; KPPS Member Rights; Death.\u0000AbstrakTulisan ini membahas tentang perlindungan bagi anggota KPPS yang meninggal dunia pada Pemilu tahun 2019. Berdasarkan Pasal 22E ayat (1) bahwasannya pemilu di Indonesia dilaksanakan setiap lima tahun sekali. Pemilu pertama kali di Indonesia diadakan pada tahun 1955. Pemilu pada tahun 2019 yang jatuh pada tanggal 17 April, berbeda dari pemilu-pemilu pada periode sebelumnya. Pertama kali di Indonesia pemilu tahun 2019 ini diselenggarakan secara serentak. Dimana warga negara Indonesia memilih lima lembaga negara yakni Presiden dan Wakil Presiden, DPR RI, DPRD Provinsi, DPRD Kota/Kabupaten, dan DPD secara bersamaan dalam satu watu. Pemilu serentak ini diharapkan mampu mengefisiensi baik dari segi waktu, dana maupun tenaga. Namun pada kenyataanya, banyak anggota KPPS yang meninggal dunia dalam menjalankan tugasnya. Hal ini dikarenakan bertambahnya beban kerja dibandingkan dengan pemilu periode sebelumnya. Selain itu, jam kerja anggota KPPS juga tidak diatur secara rinci baik dalam UU Pemilu maupun PKPU yang dibuat oleh KPU. Various types of human activities require electricity from preparing food, doing work through computers, using electronic devices, or street lighting, requiring electricity input. Indonesia handed over the management of electricity supply to PT. PLN (Persero) as the BUMN that is responsible for this matter. Blackout often results in losses for many parties so that they often make good claims on the basis of acts against the law to default. However, lawsuits filed to PT. PLN (Persero) often fails because of the argument of overmacht argued by the attorney of PT. PLN (Persero). This is based on PT. PLN (Persero) considers that the events that caused the Blackout were caused by things outside their control. This is in line with the concept of overmacht which negates the accountability of one of the parties who did not do what was promised if it was caused by events outside his control such as natural disasters. However, if the blackout is caused by negligence of PT. PLN (Persero) then they must be held accountable for losses incurred. Indonesia menyerahkan pengurusan penyediaan tenaga listrik kepada PT. PLN (Persero) sebagai BUMN yang bertanggung jawab mengenai hal tersebut. Hal ini disebabkan oleh di dalam Konstitusi Indonesia mewajibkan penguasaan sumber daya yang mempengaruhi hajat hidup orang banyak. PT. PLN (Persero) dalam melaksanakan tugasnya tak jarang menemui kendala sehingga distribusi tenaga listrik yang seharusnya dapat dialirkan dengan normal tidak dapat dipenuhi sehingga menyebabkan Blackout. Seringkali Blackout yang terjadi menyebabkan kerugian bagi banyak pihak sehingga tak jarang mereka melakukan gugatan baik dengan dasar perbuatan melawan hukum hingga wanprestasi. Namun, gugatan-gugatan yang dilayangkan kepada PT. PLN (Persero) seringkali gagal karena dalil overmacht yang didalilkan kuasa hukum PT. PLN (Persero). Hal ini didasari karena PT. PLN (Persero) beranggapan bahwa kejadian yang menyebabkan Blackout disebabkan oleh hal di luar kendali mereka. Hal ini sejalan dengan konsep overmacht yang meniadakan tanggung gugat salah satu pihak yang tidak melakukan apa yang dijanjikan apabila hal tersebut dikarenakan oleh kejadian di luar kendalinya seperti bencana alam. Namun, bila kejadian blackout disebabkan oleh kelalaian PT. PLN (Persero) maka mereka wajib bertanggung gugat atas kerugian yang timbul.
