Gr. 253 and Marc. Gr. 214. The allegedly incomprehensible text and its medium had been previously related to a Modern Age masonic and/or drinking context. However, we propose to read the inscription as a 4th-5th century A. En estos dos parrafos la informacion viene presentada en primer lugar bajo forma de preguntas y respuestas, despues se da un exemplum poetico. El segundo exemplum reproduce el carmen 39 del maestro de Julian, Eugenio II de Toledo, este ultimo texto basandose en la sintesis de erudicion «pagana» y cristiana realizada por Isidoro de Sevilla. La presente contribucion reconstruye el proceso de condensacion y codificacion que condujo a los parrafos pertinentes dentro de la Ars grammatica de Julian de Toledo, y destaca conclusiones respecto al ambiente intelectual de la Espana del siglo VII. EnglishThe Ars grammatica attributed to Julian of Toledo contains two paragraphs (II 1.3–4) on the inventors of the respective alphabets that had played a role of importance in the literate cultures surrounding the Mediterranean. Both paragraphs first present the information in question-and-answer format and subsequently quote a poetic exemplum. The second exemplum reproduces carmen 39 by Julian’s teacher Eugenius II of Toledo, which is itself based on Isidore of Seville’s synthesis of «pagan» and Christian learning. Studies in this regard have been focused so far on historical matters and Quellenforschung . On the contrary, we start determining the persuasive speech components in general and the example (παράδeιγμα) in particular, through the Rhetoric. Then, we analyze how certain topics and historical motifs (constituted as παραδeίγματα, that is, models and precedents of the past with rhetoric value) integrate both the argumentative and the stylistic facets of the discourse. However, Roman law is far from being as concise and strict as that of the Bible. Whilst not forgetting the option of membrum pro membro , the interpretation of Latin examples tells us that punishments tended to be comparable and not equal, materially speaking, to the harm caused. The linguistic analysis of talio , derived from the indefinite talis and the correlative structure ( quale scelus, talis poena ) in which it appears, leads us to see this feminine substantive of action as a neologism of proportional reference that encouraged Roman law to evolve towards substitute punishments that were less gory.
