Yetmar","doi":"10.30845/ijbss.v9n11p2","DOIUrl":"https://doi.org/10.30845/ijbss.v9n11p2","url":null,"abstract":"The Foreign Corrupt Practices Act (FCPA) of 1977 is a significant piece of American legislature that, especially in recent years, has been the subject of many heated debates in business discussions. As of February 23, 2017, this law has brought Department of Justice (DOJ) or Securities and Exchange Commission (SEC) actions in 497 cases, collected $9,981,825,430 in total monetary sanctions imposed in all FCPA-related cases, and has ties to $4,279,568,195 in bribery payments (Stanford Law School FCPA Clearinghouse, 2017).Recent years, relevant to the era of transformation in the regulatory and legal framework within the macro-environment, the demand for preventative and proprietary measures to implement effective internal controls for business enterprises has significantly increased. The FCPA is one of the internationally focused regulations in which is of high concern and risk for companies to comply with as indicative by the set forth standards and penalties if failure to comply. The FCPA can be analyzed in major core areas; penalties, international and domestic whistleblower provisions, and the socioeconomic status of countries combined with ethical development. Such three major discussion areas play a substantial role in determining the overall past history, current state, and future effectiveness of the FCPA. The FCPA has proven effective over the years, but in order for it to remain relevant and at the forefront of anticorruption and fair reporting, it must be updated to include increased standards for internal controls and software monitoring systems for large multinationals. It is recognized as one of the efficient lean supply chain management (LSCM) tools for waste identification and elimination inmaterials and information flow, people as well as performance improvement among firms. The purpose of this paper is to assess effect of VSM on operational performance (waste reduction and elimination, product quality), the mediating role of supply chain collaboration (SCC). Design/methodology/approach This conceptual paper recommends an inclusive model that incorporate VSM, SCC dimensions and operational performance. Underpinned by theories such as the Dynamic Capabilities (DCT) and Relational View (RV), the proposed model is to establish the direct and indirect effects of VSM (multiplicative stages; identification of the product family, create a current state value stream map, future state value stream map, as well as implementation and performance comparison)on operational performance through the influence of SCC in the FPI context. The framework identifies, internal and external firm collaboration as the main goal of VSM implementation which will subsequently lead to improvements in operational performance. Originality:The study effectively combines the DCT and RV to develop a comprehensive model involving three broad operations and supply chain management concepts. Though there may be similar studies on VSM practices among manufacturing industry, however, none of such a model or work that has been reported particularly in the context of Ghana especially FPI. Additionally, exploring the mediating roles of individual dimensions of SCC in the VSM practices – operational performance in the FPI is a novelty as it provides deeper insights on the mediating effects of each dimension of SCC in the relationship between VSM practices and operational performance. Insurance products are generally difficult to sell and require well thought out marketing strategies that will include persuasive promotional activities. A survey by Insurance Regulatory Authority (2013) found low consumer demand for insurance products as the biggest challenge to the growth of the industry in Kenya. Engaging in promotional activities is costly and the results uncertain. Hence the purpose of this study was to determine the effect of promotional activities on sales performance of Insurance companies. The study was guided by the following specific objectives: to determine the effect of sales promotion, advertising, personal selling and public relations on sales growth of insurance companies. The study adopted a descriptive research design. The population of the study comprised of the branch managers, unit managers and salespeople of insurance companies operating in Embu County, Kenya. The sample size of the study was 175 respondents. A response rate of 85.7% was achieved. Data was analyzed using both descriptive and inferential statistics. Overall, the study established that promotional activities significantly affected sales performance of insurance companies even though at an individual level, public relations did not have any significant effect on sales performance. The study recommends that insurance companies should engage in maximum utilization of the entire promotion mix to enhance sales growth. The study suggests that further research be carried out to determine the effect of the entire marketing mix on sales performance of the insurance and other related industries using different performance measurements. Future researchers will utilize this study as a reference point. A number of scholarly theories assert that venture capital financing contributes to the growth of venture-backed portfolio companies. However, very few have been able to delve into the tail-end latent attributes of venture capital financing that might seem trivial but immensely contribute to SMEs growth in developing economies. In view of this, this study critically analyzes the intrinsic attributes of venture capital financing model: The case of Small and Medium Enterprises (SMEs)growth in Nairobi City County, Kenya. The study adopted both qualitative and quantitative approaches in a sequential mixed research design to identify and analyze underlying factors that influence the growth of venture capital-backed SMEs. The findings from the qualitative approach were used to develop the survey questionnaire. Purposive sampling method was used to identify 79 venture-capital SMEs which had received funding for the last five years in their operations. Out of these, 51 venture-backed SMEs successfully filled and returned complete questionnaires which were analyzed using exploratory factor analysis. Out of the twelve factors identified by the respondents, five factors were extracted using Principal Component Analysis. These five factors were strategic alliances, non-current assets, initial public offerings (IPOs), management buy back and trade sale of the venture enterprise as factors contributing to SMEs growth. The Kaiser- Meyer-Olkin (KMO) measure of the five factor was 0.576 which exceeded 0.50 as recommended by Hair et al (2006) and the Bartlett’s Test of Sphericity was statistically significant at p=0.017. The results show that two factors: IPOs and Management buy-back were found to contribute to growth of venture capital-backed SMEs with IPOs contributing 32.385% and Management buy-back 27.301%, both having cumulative 59.686% which explains the variance of SMEs growth and the two had eigenvalues of greater than 1. The study concludes that a positive relationship exists between the venture capital exit route and growth of venture capital –backed SMEs. This shows that in venture capital financing, the exit route is quite critical as it provides market for the venture capitalists to recoup their investment back. Cost of venture capital financing too was found to be critical for growth of venture capital-backed SMEs in Nairobi City County, Kenya. Systems Thinking is a methodological approach that offers tools for understanding and, most importantly, controllingdynamic systems of any kind in any field, building models to understand, simulate andabove all“control”the incessant movementsand continual transformations and evolution dynamic systems. In many situations, no matter how much time and energy managers dedicate to this task, the control of dynamic systems is not possible or is impeded by certain conditions that make it nearly “impossible to control” the dynamic world with all its dynamic processes and interconnections. By describing brief “metaphors”, this study will present six of the conditions that make it “difficult, if not impossible, to perceive dynamics”, thus impedingmanagersfrom “understanding” and “controlling” the world.Some processes are so slow that managersare not able to perceive their dynamics; by the time they become aware of their effects it is too late to control them, and we end up like a boiled frog (first metaphor). At other times, processes are so fast, explosive and exponential that by the time managersbecome aware of them there is no time to undertake any control (second metaphor ofthe water lilies). Some processes derive from the concatenation of many loops, which are contained in other loops. When, in a far-off land, a butterfly flutters its wings, it can unleash a chain of vortices which, gradually gaining in strength, can set off a storm in another part of the world (third metaphor). At times, some variables depend on the myopic behaviour of many agents who prefer to repeat behavior that produces short-term, individual and local advantages, thus ignoring the long-term, collective and global disadvantages such behavior inexorably produces (fourth metaphor). About 180 questionnaires were distributed randomly to micro and small food business owner within Klang Valley, and 150 questionnaires returned (83.33% response rate).The finding shows that innovation, knowledge management, and entrepreneurial skills have direct influence towards informal entrepreneur success in Klang Valley, Malaysia. The limitations of the finding only can be generalized to micro and small food business owner within Klang Valley, Malaysia. The findings are useful for future micro and small food entrepreneur or informal entrepreneur to be successful in their business. More training on knowledge management, entrepreneurial skills, and innovation should be in place to ensure micro and small food business success in the future. Bi-lingual reviews of over fifty news reports in both English and Chinese, interpretations of over 1,000 microblog messages divulge the divisive issue whether the controversy of the Gap’s China 2018 tshirt be an MNC’s “unintentional blunder,” or a “deliberate act” of unprovoked insult to indigenous consumers. Explanatory insights are gained with Sheehan’s framework of “Controversial Advertising” and Ortner’s concept of “Cultural Key Symbols.” Findings include: indigenous netizens with the onset of technological advances inhabit the new landscape of defying Gap’s social insult within 24 hours which led to Beijing’s unusual involvement; the Gap practice is deemed controversial for its misuse or creative use of the cultural key symbol as logo; and perceived insincere apology permeates distrust. In controversial branding practices, any distortional use of key cultural symbols, be it a deliberate or unintentional act, would have the power to empower, reinforce, or aggravate a collective ethnic identity.
