The criminal procedural norms regulating the resolution of a criminal legal dispute need to be systematized in order to apply them most effectively. Dialectical, axiological, synergetic research methods were used, as well as the theory of social action. Methods of information analysis and synthesis, comparative legal and formal legal research methods were used. The empirical basis of the study was an analysis of the legislation of the Russian Federation regulating the activities of the court of first instance, data from the Judicial Department at the Supreme Court of the Russian Federation. {"title":"PROBLEM ASPECTS OF PARTICIPATION OF THE PROSECUTOR IN THE STAGE OF INITIATING A CRIMINAL CASE","authors":"O. The participation of the prosecutor in the stage of initiating a criminal case is limited by the lack of his rights to prove, independent decision-making at this stage. As a result of the implementation of the concept of the procedural independence of the preliminary investigation body, the prosecutor is currently suspended by law from direct participation in the first stage of the criminal process. This situation does not correspond to the leading role of the prosecutor in combating crime and ensuring the rule of law. From the concept of the accusatory power of the state, headed by the prosecutor's office, the thesis is developed about the need to expand the rights of the prosecutor at this stage of the criminal process. Concrete measures are proposed to turn the prosecutor into a leading participant in the stage of initiating a criminal case and to transform prosecutorial supervision into a means of procedural management of the preliminary investigation bodies. {"title":"SOCIO-POLITICAL MOODS OF THE RESIDENTS OF THE KALININGRAD REGION AS AN INDICATOR OF THE GEOPOLITICAL SECURITY OF THE REGION","authors":"Konstantin S. Social dissatisfaction, political trust, political activity, migration attitudes of the inhabitants of the Kaliningrad region were revealed. The study was based on the theoretical and empirical provisions of FCTAS RAS of socio-political sentiments and social tensions in Russian society. The main method is a personal semi-formalized interview of the population over 18 years old (n = 915). As a result of the study, it was revealed that the significant problems of the Kaliningrad region for the inhabitants of the region continue to be problems related to economic security: low incomes of the population, high prices for food and essential goods, high tariffs for housing and communal services. The hypothesis is confirmed that in the conditions of geopolitical tensions, the population's trust in local and federal authorities, the president and the army will increase. The political activity of the population, for the most part, comes down to discussing political events with friends, workmates in person and voting in elections. Most Kaliningraders do not consider moving out of the region. Political communications under these conditions look more and more like channels with expanding \"black boxes\" and improperly used \"white noise\". The purpose of this analysis is to identify the specifics of political communication under conditions of international bifurcations. The methodology of the analysis is based on the symbiosis of modern theories: mathematical modeling of communication by C. Shannon and W. Weaver, political cybernetics by D. Easton, political communication by D. J. Lilleker and P. Lazarsfeld, crisis communication by R. Ulmer, T. Sellnau and M. Seager, and game theory with opposing interests. According to the results of the analysis the specific characteristics of modern political communication are distinguished: its technological (not process) character, non-classical interaction of the communicator and the communicant in it, the transformation of the communicant into a \"black box\", and the manipulative attitude to the communicator. The concepts of “leisure”, “free time” at different times were different in contents. On the one hand, leisure was understood as time when people recharged after hard work, and on the other hand, it meant their spiritual development. On the basis of archival and published sources, as well as interviews with immigrants, the author attempts at reconstructing the idea of leisure time activities of Kaliningrad residents on the new Soviet territory. The study also analyzed the instruments of state control which were applied to this important part of human life. In particular, the measures of the state, aimed at ensuring that the majority of free time people spent centrally, are considered. Leisure time for the Kaliningrad residents in the 1940s is considered to have been primarily a way to arrange their personal life. In the 1950s and 1960s, as the general level of well-being of the population increased, there was a demand both for the diversity of the repertoire of artistic works and for the material arrangements of leisure facilities. The 1970s—1980s were a time when leisure time was clearly influenced by foreign culture, the most active interest in which was shown by young people. The pool of documents included two diaries and eight memoirs. The author evaluated the authorship, purpose, place of creation of these documents as well as their content and cognitive value. It is noted that the memoirs under the study share the features which are characteristic of most memoirs of the second half of the 19th — early 20th centuries: they were originally aimed at publication and intended primarily for contemporaries; the time gap between the original events and the “memories” of them was relatively short (from several months to several years). The selected documents are primarily the ones belonging to jurors who participated in the metropolitan district courts trials. Right-wing radicalism has a long history of presence in the political reality of South American states. Having gone a long way from the usual ideas and concepts of the continental elites to the organization of right-wing radical political forces, right-wing ideologemes have become entrenched in the public consciousness of the societies of South American countries. We relied on a synthesized approach to the \"ideologeme\" through the concept of the morphology of ideologies by M. Frieden and the theories of \"de-ideologization\" by D. Bell and S. Lipset. Methods of regional and binary synchronous comparison made it possible to establish indicators of the influence of right-wing radical ideologemes, as well as to record similarities and the most significant differences in individual country cases. An analysis of the structure and state of the party systems of the states of the region made it possible to determine the degree of influence of right-wing radical ideologies on the political processes. Kropinova","doi":"10.5922/sikbfu-2022-4-8","DOIUrl":"https://doi.org/10.5922/sikbfu-2022-4-8","url":null,"abstract":"Cultural heritage sites play an important role both in terms of the study and preservation of the culture and history of a particular territory, and in terms of their importance in recreation and tourism as a “soft power” for shaping a positive image in the geopolitical arena. These two components are directly related: the maintenance of cultural heritage objects in proper condition allows them to be used in economic activities, for example in tourism; and the economic well-being of their owners, in turn, allows them to seek funds for their restoration and reconstruction. Legal aspects have a key role to play in optimising the system of “protection-use”. Different countries have different laws governing this relationship. While both Russia and Germany are at the forefront of this issue, there are also differences, which, if identified and compared, would further optimise the legal framework. The aim is to compare the experiences of Germany and Russia in the preservation and use of cultural heritage objects. The methodology of the study is based on a study of the legal framework of these states in this field. The study compares the laws and provides concrete examples of the legal framework. Particular attention is paid to public-private partnerships. It has been revealed that Russian legislation is more restrictive in terms of protection of cultural heritage, while the legal provisions and their practical application have stimulated the development of public-private partnerships (PPP) in Germany, which in turn has helped to preserve and put into modern use a significant number of cultural heritage objects. The article is based on the analysis of the views of the famous French diplomat and politician Abbé D. de Pradt (1759–1837). The relationship between the image of Russia in France and the current political situation is revealed by the example of the journalistic works of Abbé de Pradt. The article sees Russophobia as a mechanism for solving French problems. It is also concluded that the image of Russia created in the West was, on the one hand, very stable and based on ingrained stereotypes of perception. On the other hand, this image depended on the political situation. The image of Russia created by Abbé de Pradt turned out to be very elastic, mobile, dependent on the political conjuncture. Abbé de Pradt never had any sympathy for Russia and created openly anti — Russian pamphlets. However, at the time when France was looking for an ally and saw Russia as such, rational Pradt diametrically changed his own position.
