The main purpose of the research is to establish and analyze existing tactical and psychological issues of prosecutor’s participation in court proceedings in criminal cases with the participation of jurors and to develop proposals for their solution. The set of general scientific and special methods is the background of the methodology of research. The article identifies common strategies the defense can illegally influence jurors and emphasizes the importance for the state prosecutor to consider the confessional and national characteristics of the region where the case is being considered. It also looks into the necessity to develop a unified approach to delimitation of illegal and acceptable influence on jurors. The article considers the challenges of overcoming psychological influence of the attorney for the defense on the jury; the influence of certain emotions of the jury on the final verdict in the case; determines the character of certain evidence and circumstances of the criminal case upon the jury; establishes the degree of external communication influence on the jury. The first quarter of the XX century was a time of severe trials for the whole of Russia in general and the Far East in particular: World War I; Civil War; foreign intervention. All this time, the Vladivostok Harbor was in fact the only source of external contacts of the remote region. Being the largest Russian port on the Pacific Ocean, Vladivostok has historically been a kind of center of attraction, both in socio-economic and military-political aspects. However, the destroyed logistics chains and the colossal damage that the era of political instability brought with it deprived him of the primacy in the struggle for the markets of the Pacific Rim. This publication is based on archival documents, many of which are being introduced into scientific circulation for the first time. The author sets himself the task of demonstrating the key activities of the central and local authorities aimed at restoring the competitiveness of the Vladivostok commercial port in the «Manchurian transit» — its distinctive «Visiting card» since the beginning of the century. The author concludes that despite the cardinal change in the vector of the country's political and economic development after 1917, the port of Vladivostok managed to retain the status of the Russian «Window to Asia». The order of criminal prosecution of such crimes also is not defined clearly. The purpose of the research is to develop the optimal scenario for initiating these criminal cases and determining the most appropriate procedure for their investigation. This study relied on the methods of comparative studies, analysis and synthesis. Using the method of comparative studies, the norms of the Criminal Procedure Code of the Russian Federation and the Criminal Code of the Russian Federation on the initiation of criminal cases in the economic sphere were compared. A graphic comparison was drawn between the content of part 3 of article 20 of the Criminal Procedure Code of the Russian Federation and Chapter 23 of the Criminal Code of the Russian Federation. The research proposed to change the text of the conditions under which the private-public procedure for the criminal prosecution of crimes in the economic sphere is applied, shifting the focus from the fact of causing harm to the direction of the act itself (Part 3, Article 20, Article 23 of the Code of Criminal Procedure of the Russian Federation). Kostyashov","doi":"10.5922/sikbfu-2023-2-6","DOIUrl":"https://doi.org/10.5922/sikbfu-2023-2-6","url":null,"abstract":"The author examines the position of the Serbian people and the Orthodox Church under Austrian rule since the end of the Holy League war with Turkey from the end of the 17th century to the era of Josephism. After having settled in Austria, the Serbs were exposed to the assimilation policy of the authorities, the main instrument of which was the union with the Roman Catholic Church imposed on the Serbs. The sources for the study were normative and administrative acts of authorities at various levels, decisions of the Serbian people's church councils, official and private correspondence, as well as previously unpublished diplomatic documents from the fund of the Russian embassy in Vienna. The article identifies the main directions of the state policy and the Roman Catholic Church towards the Serbs and analyzes Serbian response. It is concluded that the inhabitants of the cities greatly resisted the union while, while the Orthodox bishops showed a tendency to compromise with the authorities. In the struggle against the union, the Serbs tried to apply for the support of the largest Orthodox power. Russia, for its part, provided assistance to the Serbs, and its volume was largely determined by the position and personal views on the \"Serbian issue\" of the Russian ambassadors in Vienna. In conclusion, it is emphasized that thanks to the active position of the Serbian urban class and patronage from Russia, the Austrian Serbs managed to maintain their adherence to the faith of their ancestors and the independence of their church throughout the 18th century. I. Debosket in the army of S. F. Apraksin on the territory of Prussia during the Seven Years' War. It is shown that as the province was occupied by Russian troops, the engineering tasks were changing: there was a transition from equipping the track infrastructure to restoring defensive facilities. Restoration work was complicated by a variety of circumstances, including the lack of military engineers in the field due to their presence at the front line, the limited possibility to engage the local population in the fortifications’ restoration, as well as poor funding for construction work. The research focuses on the active involvement of V. I. Suvorov, the governor of the province, in the restoration of fortification objects, in particular the Pillau fortress. The article describes the participation of Russian engineers in the rescue operation in the Labiau area in January 1761, which included the evacuation of local residents and their property from the settlements flooded by the storm. The general legal principles enshrined in the Constitution of the Russian Federation are thought to directly apply both in codified and uncodified industries, regardless of whether they are duplicated in industry legislation or not. The article highlights a number of problems related to the allocation of the principles of uncodified branches of law. Firstly, it is rather unclear whether a particular legal entity is a specific branch of law or not. This is particularly difficult in the case of uncodified branches of law. Secondly, some of the criteria for recognising legal principles that are characteristic of codified branches of law do not work when identifying the principles of uncodified branches of law. Thirdly, sectoral principles in codified branches of law are enshrined only in the Constitution of the Russian Federation and/or sectoral codes. In uncodified branches the source of enshrining the principles of law is the Constitution of the Russian Federation and branch uncodified legislation that is a set of normative legal acts. In this situation the problem arises whether any normative legal act can enshrine the principles of the corresponding branch or only in some basic act which replaces the codified act? Finally, if the author accepts the possibility of principles of law being enshrined in different normative acts, the problem arises of the hierarchy and correlation of principles from different normative acts.
