Blackwood","doi":"10.1080/15228932.2016.1177285","DOIUrl":"https://doi.org/10.1080/15228932.2016.1177285","url":null,"abstract":"ABSTRACT Purpose: This study aims to investigate the cognitive deficits associated with a diagnosis of autism spectrum disorder (ASD) and their impact upon the skills necessary for fitness to plead (FTP) to a criminal charge at trial.Methodology: A between-groups study compared the performance of a group of adult participants with a diagnosis of ASD (N = 15) with a matched control group of adults with no diagnosis of ASD (N = 15) on an ecologically valid 15-min filmed vignette of typical Crown Court proceedings, during which they answered questions based upon cognitive skills required for FTP. The cognitive abilities of the participants were also assessed.Findings: Participants in the ASD group scored significantly lower than the control group on the measure of FTP. The effects of the child’s age and use of the National Institute of Child Health and Human Development (NICHD) Investigative Protocol were controlled for, in order to focus on the aspects of the sexual abuse and disclosure variables. Of the 116 investigative interviews conducted with children aged from 4 to 14 years old, half followed the NICHD Protocol; the other half were conducted by the same 18 interviewers prior to their training in the NICHD protocol. Police files and interview transcripts were analyzed to collect information about the child sexual abuse characteristics, the disclosure context, and the number of CFR details. As expected, the child’s age and use of the NICHD Protocol were the two strongest predictors of the number of CFR details. Coercion (physical and verbal) as well as maternal protection following the disclosure also increased the number of CFR details. Two Hare adult psychopathy measures, the Psychopathy Checklist–Revised (PCL-R) and the Psychopathy Checklist: Screening Version (PCL: SV) were employed and a diagnosis of APD was measured for 136 participants in a secure forensic psychiatric inpatient facility. Results revealed clear distinctions between measurements of psychopathy and APD. Over 65% of patients high in psychopathic traits received a diagnosis of APD while only 5.5% of patients with APD were high in psychopathic traits, denoting an asymmetric relationship. This study presents a qualitative analysis of interviews with sex offenders concerning helpful experiences in experiential group psychotherapy. Experiential group psychotherapy aims to increase emotional awareness, emotional expression, and reflection on emotions. The data were thematically coded according to Yalom’s therapeutic factors for group psychotherapy. The results indicate that Cohesion is reported to be most helpful: when clients trust their peers and feel respected by therapists, emotional engagement in treatment is achieved. Clients report being more capable of focusing on and tolerating their own emotions, which also influences the way they relate to other people (Interpersonal Learning). The present study investigated characteristics of defendants who have completed a jail-based RTC program more than once to determine what factors differentiate them from those who completed the program only once. This study also investigated whether the use of psychological tests in competency to stand trial (CST) evaluations reduced the number of competency cases that are contested. Several predictors of RTC program repetitions were identified. This case is one in which Mr. Johnson, a college graduate, confessed to a serious crime he did not commit. Although his confession was inconsistent with the facts of the crime, the police arrested Mr. Johnson. One strategy of feigning that has largely been overlooked in the field of forensic psychology and psychiatry is retrospectively feigning symptoms in the context of criminal responsibility evaluations. Specifically, this involves a defendant who is not currently feigning symptoms, but is reporting experiencing a number of symptoms of mental illness at the time of the crime. Although there are numerous measures designed to detect current feigned psychological symptoms or cognitive impairments, little research has been devoted to the proper evaluation of retrospective feigning. Utilizing panels of three independently appointed examiners, Hawaii’s system for evaluating mentally ill defendants charged with felonies provides a naturalistic laboratory for investigating decision-making processes in examiners and judges. The study focused on competency to stand trial (CST), criminal responsibility (NGRI), and postacquittal conditional release (CR) using a methodology adopted from clinical medicine and natural sciences. The entire adjudicative process from examination to judicial determination is examined as a forensic classification model. Examiner agreement and judicial consensus for 450 forensic reports were examined to assess performance in a non–crossed-data measurement design. Reliability of psycholegal constructs (CST, NGRI, postacquittal CR) was assessed using a novel reliability estimator (Krippendorff’s alpha: KALPHA). This is the first study in the forensic mental health literature to examine interrater agreement for postacquittal conditional release decision making. Findings revealed adequate performance for CST, poor performance for CR, and marginal performance for NGRI decisions. Judges demonstrated independence in the presence of panel disagreements. Across the board, examiners demonstrated high levels of inconsistency in judgments. Factors associated with poor reliability, including task complexity, are discussed. We report a Jane Doe who was admitted to a psychiatric hospital and treated for dissociative amnesia or fugue with group therapies and psychotropic medication for six months. She was referred for neuropsychological assessment to evaluate memory loss for her past and her identity. The Test of Memory Malingering and the Structured Inventory of Malingered Symptomatology suggested feigned memory deficits. The hospital eventually learned Jane Doe’s identity. She was wanted for a crime in another state, but also had a psychiatric history with several hospitalizations. When confronted, she admitted her deception. This case illustrates the importance of using formal testing and consulting the scientific literature on memory for discerning true versus feigned memory deficits. This case also points out that mentally ill defendants can malinger other disorders. Adolescent stalking is an area of research that deserves further study given findings from the adult stalking literature that suggest significant public health and legal consequences associated with these behaviors. However, very little is known about this phenomenon, its potential differentiation from adolescent dating violence and/or bullying and directions to take for future research. A comprehensive review across 5 scientific databases yielded a total of 9 peer-reviewed manuscripts incorporating varying sample sizes and adolescent populations. A synthesis of existing research suggests that adolescent stalking exists at levels at least as high as that documented among adults but appears to have some notable differences (e.g., behavioral patterns, risk factors) from stalking behaviors among adults. To date, there exists no published representative population-based study of adolescent stalking behaviors and its health and legal consequences.
