There was simply no alternative vision of society on offer from their intellectual establishment. Such visions were, moreover, variously damned by this elite as the work of traitors ('volksverraaiers'), leftists, integrationists and communists. This article adduces empirical evidence to support the proposition that Afrikaner academics were among the most loyal of apartheid's institutional supporters. An influential view thus relies on John Rawls's ‘veil of ignorance’ to stress uncertainty among political protagonists as the optimal guarantor of democratic institutions: the less those who draft the rules know about the likely outcome of their choices, the more likely is it that they will choose democratic mechanisms. The article argues that this approach is inapplicable to the South African case and therefore, perhaps, to other pacted transitions. A key expectation underpinning the settlement was that the outcome of majority rule was certain: the National Party therefore sought to negotiate a constitution which diluted its effect. But inadequate information prompted it to choose options which were suboptimal both for its own interests and for democratic consolidation: the electoral system is analysed as a case in point. What is perhaps less well understood is the complexity that underlays the foreign policy‐making process within the EU. South Africa's own form of consultation and consensus style of decision‐making, albeit extensive by nation‐state standards, pails when confronted by the multi‐layered process of foreign policy‐making in the EU. The current negotiations between South Africa and the European Union over the “free trade” versus “development and trade” options makes this study of Europe's foreign policy making process both timely and important. To understand the present negotiations it is useful to examine the more recent past, in particular the 1993–4 EU joint action that has been instrumental in shaping contemporary policy. The major concern now is the consolidation of democracy. The paper discusses the amendments to the 1991 Constitution of Zambia and their impact on democracy. The amendments, although well intentioned, provide a good example of an attempt by an incumbent elite at legitimizing its hold on power while denying others the right to participate in the process and, or challenge the power holders. This article introduces the challenge of local government establishment by outlining the process proposed by central government actors and by identifying a central dilemma inherent to it – delayed transition at local level. Subsequently, the ways in which the pre‐election process was conducted in five small towns on the Eastern seaboard are analysed. These case studies were selected since research to date on this question has focused on metropolitan areas rather than on small towns. Analysis centres on the establishment of transitional local authorities rather than on the day‐to‐day business of these authorities — on local government transition rather than on routine operation. The most unmistakable hallmark of the substitution of constitutional sovereignty for parliamentary sovereignty (heralded by the transitional Constitution of 1993) has been the introduction of a justiciable Bill of Rights. The author shows how the concept and practice of constitutional sovereignty are invoked to entrench rights via the Bill of Rights in the 1996 Constitution which came into effect on 4 February 1997. He first explains how a justiciable Bill of Rights fits into the scheme of Constitutionalism and then proceeds to explore the values encapsulated in (and the language and style of) the Constitution. Attempts at reconciling ‘libertarian’ and ‘egalitarian'l'libera‐tionist’ sentiments through the introduction of human dignity as a foundational value, are assessed. However, these two societies leave the twentieth century with what seems like fundamentally different futures. In large measure this is because South Africans and Australians have responded quite differently to the economic and cultural trends associated with globalization, postfordism and post‐modernity. Since 1983 Australians have systematically destroyed their old modernist and nationalist social order built upon the “Deakin Settlement”. In its stead, they have dived headlong into the uncertainties of engaging with globalization and post‐fordist economic restructuring and have immersed themselves in a world awash with postmodern (and ‘post‐national') significations.
