Hervé","doi":"10.3917/jib.254.0029","DOIUrl":"https://doi.org/10.3917/jib.254.0029","url":null,"abstract":"The purpose of this research, led in the wake of years of pressure to reject paternalism, was to study whether controlled practice of nonverbal communication by doctors inheres a continued risk of paternalistic attitudes in oncology clinic interviews (chosen to illustrate the doctor-patient relationship). This study involved qualitative descriptive research based on interview observations and questionnaires and mobilized recognized theory borrowed from sociology and anthropology. We found that the legislative framework governing the doctor-patient relationship has simply shifted the paternalism issue from verbal communication over to a new area that doctors have not yet mastered and patients have not yet understood, i.e., nonverbal communication. This study shows that all the laws framing the doctor-patient relationship can be circumvented, and that by controlling nonverbal communication, the doctor can fall back into paternalism. Might FEC be the means of bridging from individual ethics to institutional ethics at a hospital?Aim: To take the FEC perspectives considered appropriate for doctors and consider them for validation or disproving in the context of those of other professionals.Proposed method: Situate the proposed FEC mandate in a reference framework to evaluate (or triangulate) the clinical decision and the institutional ethic. CONVICTION: Sustainable professional development for doctors (DPD) includes ethics; it cannot be ignored. In MCD, health care professionals discuss their moral issues pertaining to a real case in order to come to mutual understanding and/or a shared idea of what is best to do and in which way. MCD is inspired by the philosophy of dialogical and hermeneutic ethics. Equal dialogue and critical constructive reflection are both important aims and means of MCD. This requires equality of perspectives, time to deliberate about values and considerations, and active involvement of all participants (ownership). However, within the context of an academic hospital, these conditions are not evident, given the prevalence of power and hierarchy, the need for efficiency and time management, and the emphasis on experts' advice instead of joint responsibility. This paper introduces the core features of the philosophical background of MCD and describes ways of dealing with some tensions between MCD's philosophical inspirations and the practical context of an academic hospital while implementing MCD. The paper shows that these philosophical inspirations can be helpful in the cooperation with an academic hospital when implementing MCD together. This right has traditionally and in documents of the Church been extended to the family in the absence of specified wishes of the patient. Again, since the controversies on patients in a persistent vegetative state (PVS) have come to public knowledge, especially with the case of Terry Schiavo, and more recently, in Italy, the case of Eluana Englaro, people have been confused about the issue of what constitutes extraordinary treatment. This article focuses on the history of advanced life support and extraordinary treatment, with special reference to PVS and attempts to conclude that given the information already available decision to withdraw such care, even if in principle it may be considered ordinary, can be pursued within the same teachings and should therefore not pose problems to medical personnel once a proper legal and ethical procedure is followed.
