The outcome of such a collective learning has been the progressive working-out, from the clinical and care practice, of a given clinical ethics grid into a more intensive care units context adapted grid. This development justifies for us to work out a context sensitive, pragmatist and reflective ethics as a learning process. Such an idea of ethics allows to understand the transition from hospital ethics committes and clinical ethics consultation towards a more integrative institutional perspective that we defend here. This institutionalization of clinical ethics support services has to be accompanied by a reflective governance of this process. {"title":"Are clarifications on feeding and hydration in PVS needed by Catholic authorities?","authors":"Pierre Mallia","doi":"","DOIUrl":"","url":null,"abstract":"<p><p>Ever since the possibility of keeping a person on advanced life support the Catholic Church has been concerned with the rights of the individual to a dignified death and the right to refuse treatment. This right has traditionally and in documents of the Church been extended to the family in the absence of specified wishes of the patient. Again, since the controversies on patients in a persistent vegetative state (PVS) have come to public knowledge, especially with the case of Terry Schiavo, and more recently, in Italy, the case of Eluana Englaro, people have been confused about the issue of what constitutes extraordinary treatment. This article focuses on the history of advanced life support and extraordinary treatment, with special reference to PVS and attempts to conclude that given the information already available decision to withdraw such care, even if in principle it may be considered ordinary, can be pursued within the same teachings and should therefore not pose problems to medical personnel once a proper legal and ethical procedure is followed. Indeed the stake is no more to train actors able of producing a moral speech on the practices but, in a destabilized context, to accompany them in the development of new practices in professional situation. This pragmatic turn in health ethics requires more active, reflective and contextual models of training, needing new links between training places and care practices. This paper is about theoretical foundations of such an ethics pedagogy, and about its stakes in terms of re-institutionalization. Pragmatism, and more particularly the approach of John Dewey, will be mobilized here to found educational practices needed by such an ethics pedagogy (an experiential, reflective and collective learning), but also to consider issues concerning training device linked to such a learning. The resources acquired in this way should make it possible to prevent and reduce the appearance of moral distress, a phenomenon the consequences and persistence of which can lead to burnout and to giving up the profession. Genetics raises many questions in the field of ethics concerning the potential applications in clinical medicine, in particular because of the technological evolution of human genetics in the medical field and the genetic research on the charting of the human genome. Human genetics involves filiation and questions the foundation of our society and the potential standardisation of human beings. The prescription of genetic tests is a tool for doctors but its use should be measured and carefully thought out according to the questions asked and the results expected. Examination of this issue within the context of the bioethics laws in France has made it possible to establish a framework for a certain number of practices so as to answer certain questions in human genetics. What's lurking behind this tragedy is the crisis of faith between doctors and patients in China. The crisis is a product of the Marketization of the health care system, which generates an unequal relationship between doctors and patients. Such a relationship makes patients unable to actively protect their rights. From a bioethical perspective, health is a basic right for everyone. In order to improve the physician-patient relationship, health rights must be considered as a priority in policy making.
