Para ello, se tomará como caso de estudio el derecho a la muerte digna en el contexto jurídico colombiano. A través de un análisis textual de normas jurídicas y documentos con pretensiones teórico-jurídicas, se mostrará que los ejercicios de definición conceptual en el ámbito del derecho responden a la operacionalización desde valoraciones éticas hacia el instrumental jurídico; posteriormente, se ejemplificará este proceso a través del uso específico de este hecho por una postura ética, decididamente comprometida con el derecho a la muerte digna, en el contexto constitucional colombiano. Para esto, se propondrán ejemplos de autores y corporaciones que sostienen una mirada negativa sobre la eutanasia. However, the exodus of people coming from Venezuela would lead the country to become the second in the world to receive this population in absolute numbers, with 830 000 as of July 2020 (Bahar et al., 2020, p. 9). Although at the beginning the State decided to adopt an open-door policy regarding the entry and permanence of Venezuelans, since mid-2018 migration control has become more restrictive. This situation has become even more adverse for them since the beginning of the pandemic of COVID-19, as they have had to go through situations of discrimination, despite its condition of especial vulnerability. Given this scenario, this article will examine certain actions and omissions carried out by the State, which reveal violations of human rights of these people, fostered by a public opinion of rejection towards them. Constitutionalism began anew in the modern world with the study of the ancient republics and it was Machiavelli who inaugurated this revived science of politics. Five hundred years after the composition of Il principe and the Discorsi we are still working out the implications of applying reason to the structures of law and government in pursuit of justice and the common good. Modern constitutionalism and ancient republicanism share three central beliefs: first, that government should serve justice and the common good; second, that government should do so through known and stable laws; third, that these will best be secured through the checks and balances of a well-designed constitution. Machiavelli took the theories and experiences of republican Rome and applied them to his own era. Esto, debido a que con la expedición de la Resolución 1006 de 2020 se suspendió la emisión de salvoconductos SC2 por parte de la Unidad Administrativa Especial de Migración Colombia, lo que se convirtió en un impedimento parael acceso a la salud, puesto que en la legislación interna colombiana no está contemplada la afiliación al Sistema General de Seguridad Social en Salud con una constancia de salvoconducto SC2. De esta manera, por las decisiones tomadas por el Gobierno nacional, se ha generado una barrera administrativa para que la población solicitante de refugio pueda acceder a sus derechos fundamentales, puntualmente el derecho a la salud. \u0000Teniendo el cuenta lo mencionado, evidenciamos que a través de la figura administrativa del control inmediato de legalidad se puede lograr la protección de diversos derechos fundamentales de la población con necesidad de protección internacional que se encuentra en situación de vulnerabilidad por su contexto de movilización, como resultado del impedimento de la emisión de salvoconducto SC2, a raíz de la emergencia sanitaria, económica y social causada por el COVID-19. En este sentido, el control inmediato de legalidad es una herramienta de vigilancia ciudadana que permite considerar los efectos reales y materiales de una norma que es en principio legítima, pero que el Consejo de Estado no puede percibir a simple vista. However, the arrival of the American troops in Colombia is controversial for three main reasons: (i) the importance of the territory with regard to a state’s sovereignty; (ii) the fact that the Colombian Government did not fulfil a constitutional requirement concerning the mandatory Senate authorization regarding the transit of foreign troops; (iii) the belief that the American troops are in Colombia to carry out actions against the current Venezuelan Government led by president Nicolás Maduro. This article argues that military assistance is compatible with the UN Charter if requested by a state to cope with internal matters and is carried out according to the terms and conditions previously agreed upon.
