{"title":"“Vino nuovo in otri nuovi”: alcune prime note circa le sfide del presente per il diritto canonico e la canonistica","authors":"Cesare Edoardo Varalda","doi":"10.54103/1971-8543/22283","DOIUrl":"https://doi.org/10.54103/1971-8543/22283","url":null,"abstract":"“New wine into new wineskins”: some first notes on the current challenges for canon law \u0000ABSTRACT: Inspired by the Summary Document of the recent Synod of Bishops, which requests a revision of the Code of Canon Law and the Code of Canons of the Eastern Churches, this study intends to reflect on the contribution that canonical doctrine can offer for this revision. Specifically, the study analyzes the current Code as a result of both the Second Vatican Council and the legal classifications specific to the positivist culture during the 19th and 20th centuries and, consequently, it observes the necessity, from a de iure condendo perspective, to approach the work articulated towards a mature acceptance of certain aspects of the Second Vatican Council not appropriately valued in the drafting of the Code, such as the pneumatological renewal of the theology and ecclesiology of communion. Given these remarks, it is possible to move in the direction indicated by the Synod, avoiding \"pouring the new wine of the Synod into old wineskins\" of the now outdated juridical categories. Carl Einstein in the first blasphemy trial of the Weimar Republic \u0000ABSTRACT: The conviction for blasphemy imposed in 1922 on the writer Carl Einstein for the comedy Die schlimme Botschaft provides us with the opportunity of using the debate on crimes against religion to reflect on the epochal transition from the Wilhelminian Empire to the Weimar Republic. A picture emerges marked by strong contradictions, which manifest themselves also in violent street clashes and innumerable political murders, highlighting that the change of regime and the promulgation of the Constitution were not enough to overcome the profound resistance of a strongly conservative culture, still deeply rooted in the administration, judiciary and army leaders. \u0000SOMMARIO: 1. The limits and legitimacy of Israel-critical speech under the European Court of Human Rights \u0000ABSTRACT: In May 2016, the International Holocaust Remembrance Alliance (IHRA) adopted a working definition of antisemitism as a non-binding guide for states and policymakers to identify criminal anti-Jewish behaviour. Critics, however, argue that the IHRA definition hastily conflates illegitimate forms of antisemitism with legitimate political speech against Israel's government and policies. Therefore, if integrated into national legislation, they warn that the IHRA definition could easily become a legal tool to stifle critics of the Israeli government and advocates for Palestinian rights. Political agendas apart, the terminological imprecision of the IHRA definition raises timely questions about the boundaries between antisemitism and anti-Zionism, as well as between legitimate and illegitimate Israel-critical speech. This is especially relevant, particularly after Palestinian militant group Ḥamās launched a surprise attack against Israel on October 7, 2023. The ongoing war thus raises the questions: Apart from open calls to violence, how to assess when legitimate, anti-Israel speech might spiral into illegitimate, harmful discourses? And what factors should be brought to bear on legal balancing? Although not dealing with a war-torn scenario, the European Court of Human Rights (ECtHR) has offered some insights on the issue that will be addressed in this paper. \u0000SOMMARIO: 1.
