It frequently clashes with resistance typical of an institution that is in some ways still linked to traditional legal paradigms. It is consequently increasingly necessary to acquire technical tools that allow people to govern family relationships in the current “multicolor” context. The essay investigates the possibility of leaving ample space for private autonomy in the regulation of family relationships in the belief that in this way families are provided with flexible tools that conform to their own cultural and religious identity. \u0000SOMMARIO: 1. In doing so, the article relies on the findings of the Atlas of Religious or Belief minority Rights research project. The aim is to highlight how the legal system of Cyprus is slowly detaching itself from the millet logic inherited from the Ottoman past and it is further aligning with European and international standards on the protection of minority rights in different policy areas, including family law and marriage. Ingoglia","doi":"10.54103/1971-8543/22566","DOIUrl":"https://doi.org/10.54103/1971-8543/22566","url":null,"abstract":"The mediation of the Holy See in the process of normalization of Cuban-American bilateral relations \u0000ABSTRACT: This article aims to illustrate the fundamental stages and final moments of the singular and complex mediation conducted by the Holy See in the Cuban-American dispute, whose greatest success was the signing in the Vatican in 2014 of a protocol for the normalization of relations bilateral agreements interrupted in the aftermath of the Castro Revolution. In particular, the specificity, in terms of diplomatic dynamics, of this pontifical initiative is analysed, which inaugurated a new phase of negotiations in the stagnant talks that had already begun secretly in Canada between the two parties in 2011. Finally, the system of agreements of medium level concluded between the parties after the re-establishment of normal diplomatic channels, achieved thanks to the proactive role of the Pope and Vatican diplomacy. \u0000SOMMARIO: 1. Belonging and autonomy in the legal experience of contemporary Italian Judaism \u0000ABSTRACT. The essay retraces the salient passages of the juridical condition of the Jews of Italy, from the second emancipation (1848) onwards, around the pivotal principles of community autonomy and individual belonging, which during the different eras - liberal, fascist, republican - have taken on different normative qualifications and consequent historical meanings. The historical perspective thus illustrates the unique and paradigmatic character of the Jewish case for the tension that has gradually been established between institutional reasons and individual demands, between the 'necessity' of the community and the 'freedom' of the Jews. From the reconstruction it emerges how, in the different moments, the initiative of the minority prevailed over the action of the State, mostly called upon to acknowledge the requests and solicitations of the Jewish leadership. \u0000SOMMARIO - 1. This approach, which is typically used to promote equality for workers with disabilities, has been applied to this dispute in a novel way. This paper intends to reconstruct the Court’s proposal of a “reasonable accommodation” model after analyzing the original features of this approach. Ecclesiology has undergone an important development since the Second Vatican Council: it has moved from an institutional ecclesiology to an ecclesiology of communio. Canonical science seeks to adapt to this reality. But in some approaches, communio fidelium and communio hierarchica are still considered on the same plane; in practice, communio fidelium would become a “product” or a “result” of communio hierarchica. But this introduces a “harmful separation between theory and practice” (cf. Veritatis gaudium, n. 4). In this paper I will explain, from a constitutional canonical approach more in line with the ecclesiology of the Second Vatican Council, the foundations and consequences of the instrumentality of the communio hierarchica in relation to the communio fidelium, and what it means that the ‘institutional principle’ is born of the ‘communitarian principle’ (Hervada). \u0000SOMMARIO: 1. In the space of a few years, the metropolis of Moscow proclaimed its de facto autocephaly and the bond of subordination of the Sacerdotium to the Imperium was strengthened, especially starting from the Council of 1503 which saw the monastic current led by Iosif of Volokolamsk, who stated a close bond between Church and sovereign. prevail on that represented by Nil Sorsky, who supported the independence of the Church from civil power. At the beginning of the 16th century, the monk Filofej from the Pskov region enunciated the theory of the Moscow third Rome and the transfer of the imperial capital from Constantinople to Moscow.
