So much so that a constitutional recognition of the right to identity has been achieved, such as that made up of static and dynamic elements. Along these lines, it has been established that sex is a dynamic element of identity and therefore can be modified, in such a way that it responds to the psychosocial identity of the person. The Peruvian constitutional jurisprudence has responded to the emergency call of a minority and historically discriminated population such as the trans population in Peru, restoring legal protection to them through judicial hearing of the cases related to the change of the mention of sex in the records. Rigoldi, Edinilson Donisete Machado, Julia Thais Moraes","doi":"10.20912/RDC.V16I38.114","DOIUrl":"https://doi.org/10.20912/RDC.V16I38.114","url":null,"abstract":": This article analyzes the formation of the Brazilian ethnic multicultural state from the perspective of the Democratic Rule of Law that recognizes and protects the rights of the indigenous people. With the 1988 Federal Constitution, ethnic identity becomes an integral part of the Democratic Rule of Law which recognizes the right to alterity as a fundamental right of the indigenous minority http://dx.doi.org/10.20912/rdc.v16i38.114 and conceives it as a participant in a State that admits ethnic multiculturalism at the center of relations normative. Thus, political pluralism, which builds the Federative Republic of Brazil, ensures the recognition of the indigenous minority that has historically been exposed to a discriminatory normative policy based on assimilationism. Based on the aforementioned thematic contribution, the normative structure of a multicultural ethnic State is analyzed, with the objective of identifying how the Democratic Rule of Law contributes to the protection and effectiveness of indigenous cultural diversity. Souza, André Pereira dos Santos","doi":"10.20912/RDC.V16I38.330","DOIUrl":"https://doi.org/10.20912/RDC.V16I38.330","url":null,"abstract":"This paper has as its purpose to answer the following problem: in legal cases that reveals an ethnocentrism, like in the judicial decision of the Federal Supreme Court that ruled in the petition 3388 about the demarcation of the Raposa Serra do Sol indigenous land, which are the confrontation paths invisible for law that could be open up by the anthropological view of the amerindian perspectivism? From a theoretical and methodological point of view, was tried to develop a path in phases to reach, in the end, a radical anthropological criticism of modern law. In the first section is made an initial opening about the crossings of ethnocentrism and modern law since some comments of Lévi-Strauss and ideias of the Philosophy of Liberation. After is made a cross between juridical and anthropological arguments for a review of the demarcation conditions of indigenous land in Brazil established by the Federal Supreme Court from the Raposa Serra do Sol Case. Here it’s showed a first open path by the anthropological criticism of modern law.
