Abstract

This work aims to study the water as a common good, since it is essential for human life. The research problem is summed up in the question: “Should water be seen as a common good, out of the traditional legal categories of public and private?”. The research has developed in three chapters: The first section explains the conception of common good in the Brazilian legal order; in the second section, was verified the legal treatment of water in the international law; in the third development section, it was reflected the water as a common good. The research was produced through a deductive approach method, a monographic procedure method and a documentary bibliographic research technique, since books, legal articles from scientific journals, constitutional and infra-institutional norms, Brazilian and international were verified. In general, it was concluded the vital need of rethink water as a common good, out of the categories of traditional goods.
