The national-religious intelligentsia preferred the Islamization of the population in the family of the Muslim peoples of Russia, which, as a powerful cohesive religious force, would be able to break the chains of colonial dependence and lead the peoples to freedom and independence. Another direction of the national liberation movement is represented by the so-called ‘Westerners’ – the advanced national intelligentsia, which absorbed the ideas and values of the European humanitarian and democratic culture. The ideological foundations and postulates of these movements were fundamentally different, although their ultimate goal – the liberation of the people from colonial dependence, was the same. In strengthening the foundations of the ideology of the \"Westerners\", the essay on the history of the Kazakhs by A.N. Bukeikhan Kirghiz and the Charter of the Country of the Kazakhs developed by B. Syrttanuly on the initiative of the former played a key role. At the same time, in A. Bukeikhan’s essay, the lands originally inhabited by Kazakhs, and in the Charter of the Country of Kazakhs, the constitutional model of a parliamentary republic is presented, whose jurisdiction should be extended to this territory. When a law undergoes long term changes, it is especially interesting to take account of specific trends – where does normative restructuring happen and how are different spheres of reconstruction interrelated. This contribution identifies 4 distinct areas where topics either remain very stable or where criminal procedure law undergoes profound changes. One area that is rather constant is the interest in efficiency of criminal investigation, trial, and sentencing. However, within this common interest in efficiency, we see important changes in the realm of human rights guarantees. Since the German Federal Constitutional Court did substantially change its interpretation of human rights, insisting upon a core of absolute protection within each and every human right, institutional safeguards of human rights in criminal procedure had to be amended, leading to a new emphasis on the principle of proportionality. While this is a trend that is mainly concerned with serious crime, lesser offenses are subject to widespread procedural decriminalization. Such widespread decriminalization is only possible because the role of the victim was newly assessed. Newfound possibilities to actively participate in criminal procedure or to interact with criminal procedure increase acceptance for procedural outcomes apart from criminal sentencing.","PeriodicalId":485485,"journal":{"name":"Л.Н. The potato yield in 2021 in the country was only 20 tonnes per ha, which is a rather low indicator. One of the main reasons for the insufficient yield of potatoes in Kazakhstan is the low quality of seed material, and the main requirement for high-quality seed material is the absence of viral diseases. Viral diseases in crops are a major impediment to sustainable potato production, as they cause large losses in crop quantity and quality. To date, 40 viral potato diseases have been discovered worldwide. Depending on the infection of viral diseases, the yield can be reduced by up to 90% in crop production. In this review, we discuss in detail the current state of potato viral diseases in Kazakhstan and characterise the most common potato viruses in the country, including potato virus M (PVM), potato virus (PVS), potato virus X (PVX), potato virus Y (PVY) and potato leafroll virus (PLRV). To ensure food security of the country and prevent the spread of infection with viral diseases, popular methods (ELISA, RT-PCR and detection of specific types of targets using microarrays) for the early detection of potato plant viruses in seed and field material are considered. For the mass production of virus-free potato plant material, the use of temporary immersion bioreactors is discussed, as well as the use of modern genetic engineering methods to obtain plant varieties resistant to the most common viral diseases.","PeriodicalId":485485,"journal":{"name":"Л.Н. The ecological range of species of the genus extends from the alpine and subalpine belts to deserts. Species of this genus are characterized by a variety of morphological characteristics, which creates difficulties in their identification. according to modern data, 25% (18%) of the 140 onions growing in Kazakhstan have been found in Aral-Balkhash region. The purpose of the research was to critically study the collection materials of 15 species of the genus Allium from 3 sections (Haplostemon Boiss. – 7; Porrum Don – 3, Molium Don – 5), that were the most widely represented in the flora of the Aral-Balkhash region, stored in the Herbarium Fund of the Institute of Botany and Phytointroduction (AA). As a result of the herbarium specimens analysis, the locations of only 12 species of the genus Allium, given for the territory of the country, were revealed, one of which is included in the Red Book of Kazakhstan. As a result of the research, an annotated list of Allium species of Aral-Balkhash region presented in the Herbarium (AA) (Almaty, Kazakhstan) has been formed. It has been shown that the largest number of samples preserved in the collection falls on Betpakdaly, Moyinkum, Balkhash-Alakol floristic regions of Kazakhstan.","PeriodicalId":485485,"journal":{"name":"Л.Н. Scientific interest in the figure of a merchant-entrepreneur, a bay, the creator of a trading network, industrial enterprises, a philanthropist and a benefactor is justified, as it makes it possible to more clearly represent his social function, and through this to outline the corresponding qualities of merchants. Up until the late 1980s. in the Russian historical science, merchants were given obviously insufficient attention, the history of merchants was ignored as an object and subject of research. Merchants in Kazakhstan in different historical periods played an important role in the economy and culture of the region. Studying the history of merchants can reveal many aspects of the life of this class group, as well as its interaction with other social groups. Historiographical analysis of the history of the merchants of Kazakhstan in the second half of the XIX – early XX centuries. contributes to the objective reflection of studies published in various periods: pre-revolutionary (pre-Soviet), Soviet, post-Soviet (modern) periods of the history of Kazakhstan. The historiographical analysis is relevant from the point of view of modern discussions about the contribution of merchants to the socio-economic development of cities, charity, culture of Kazakhstan. The research begins by overviewing the status of the bona fide purchaser in Roman law and its legal basis. The article then delves into the history of the issue to show how classical Roman law was modernized with the customs of Germanic tribes which led to the formation of Civil law. Finally, the article describes the further evolution of the concept of the bona fide purchaser in the legislation of countries in the Civil law tradition. The research is based on the works of German, English, French, US, and Russian lawyers who have dealt with issues of the bona fide purchaser. The study uses the method of historical comparison and system analysis to provide a deeper understanding of the concept of the bona fide purchaser in Civil law tradition. The results of the research can significantly deepen the theory of Civil law and are recommended for scholars and practitioners interested in the history and theory of law. The research based upon the method of historical comparison and system analysis. The connection between religion and animal slaughter is related to religious prescriptions and requirements that may affect the method and conditions of slaughter. In various religions, there are certain rules and rituals related to the killing of animals for food, including requirements for anesthesia, slaughter methods and prayer rituals. For example, in Islam there are requirements for halal slaughter, which is carried out in accordance with the principles of Islamic law. This includes the use of sharp knives, a single cut of the animal's throat, mandatory anesthesia and reciting prayers during slaughter. Other religions and cultures may also have their own specific requirements and rituals related to the slaughter of animals. It is important to note that the connection between religion and animal slaughter allows believers to perform rituals in accordance with their religious beliefs and principles. The aim of the article is to elucidate the process of deportation and the living conditions of the deported ethnic groups during the wartime and post-war periods in the eastern region of Kazakhstan. Special attention is given to the analysis of the resettlement and living conditions of the special settlers, as well as the issue of their material provision. The formation of a so-called \"labor army\" from the special settlers is examined, where they were treated as prisoners and utilized by the state during wartime as a mobile and inexpensive workforce. The implementation of human rights and freedoms within the context of the special settlement population is analyzed. The authors have examined documents from the Documentation Center of the modern history of the Abai region and the State Archive of the East Kazakhstan Region, which has allowed for the expansion of the research aspects related to the lives of the deported population within the special settlement system.","PeriodicalId":485485,"journal":{"name":"Л.Н. With the implementation of the new criminal legislation, the number of ‘prison population’, the bulk of which accounts for the use of conditional sentences, has decreased. The importance of this conditional sentence is due to the fact that reducing crime does not necessarily entail changes in the nature of punishment in the direction of strengthening the role of persuasion and the influence of organizations. These changes have been implemented through legal institutions that economically spend criminal repression, mitigating the coercive effects of punishment. Within the framework of legal science theory, there are different views on the legal nature of a conditional sentence. Therefore, due to the lack of a unified approach to solving issues related to the establishment of the grounds for the use of the institution of probation, the conditions performed by convicts during probation control, the determination of criminal record, the removal of criminal record, difficulties may arise. Moreover, in recent years, most of the repeat offenders have been conditionally convicted. All this actualized the issue of improving the institution of probation. Taking into account the theoretical and practical significance of the correct definition of the legal nature of a conditional sentence, the authors consider the concept of a conditional sentence and its legal nature and analyze various points of view of researchers, as well as explain the reasons for the appointment and refusal of a conditional sentence.","PeriodicalId":485485,"journal":{"name":"Л.Н.
